My complaint is about trying to have the funds dispersed to me from a lawsuit filed against my Insurance Co. concerning reparations due to the damages my property sustained from Hurricane IDA on 08/29/2021. The law firm has received two checks from the insurance co. dated 11/26/2022 for $3,185.04 and another dated 12/15/2022. I signed two "Partial settlement breakdown" one dated 12/20/2022 for $3,185.04 and the other 12/27/2022 for $8,414.73. It appears they have been engaging in delay, mis direction, avoiding answering enquiries and "stalling of dispersal of my funds. They use the excuse that the complaint "is still in negotiations. Please take note of the attached documents. I would like the checks for the settlements sent to me through overnight mail. As Soon As Possible.

    Better Business Bureau:

This letter is to inform you that McClenny Moseley & Associates PLLC has carried out to my satisfaction the resolution it proposed for my complaint, filed on 1/3/2023 and assigned ID ********.

    Regards,

    To whom it may concern:

Hello.  I think my complaint has been resolved.  This morning I got a phone call from the law firm I filed the complaint against.  The reason for the delay had been explained to me satisfactorily.   I was informed that the funds in question have been processed and there was one more step and then the checks will be *****, overnighted to me in the next two days.  I am satisfied with the explanation and the resolution to the delay.  I don't know how my complaint will be handled from this point forward but I felt it necessary to inform you of the change and the satisfactory explanation and resolution of the matter.  Regardless, I wish to thank you for the quick response to my complaint and wish you all a happy and prosperous New Year.

On 2/16/22 we hired mcclenny moseley &assoc. in regards to a dispute with *********** ins. Over hurricane ida damage. As part of our contractual agreement MMA was to be paid 15% of any monies received that did not involve any filing of lawsuits or meeting with insurance company prior to settlement, but was to receive $0 for any settlement amounts paid before original date of contract. This is important to our first dispute involving a check in the amount of $31,077.15. We believe that amount was settled and dispersed prior to the contract date but was sent after the contract therefore was sent to MMA. We have asked for the original check on several occasions to be sent to us so we could see the date. MMA will not send it to us. Instead we were told MMA deposited the original check into their escrow account and wrote 2 checks in the amount of 309.22 and 30,767.93 totaling the amount above. So that they can ensure to collect 15%from it. Also there was a second dispute - second settlement of 105,000 MMA is entitled to 33% of that amount. They negotiated on our behalf for this amount. However we have not received any of our money. MMA has closed our case since September 6, 2022 and never sent us any money that we signed for .. they kept it all. Resolution- we want all of our money that is owed to us 31,077.15 plus 67,200.00 total 98,277.15

I called this Law firm to help me with my home owners insurance or carrier didn't not give me enough to cover the damage from IDA Hurricane so they took the case I am not sure the exact date around May 2022 and they called back to discuss how much additional money do I need to fix the damage and I told them around $20 to $25K so the Attorney and me agreed with amount and he told me they will get back to once the claim settled. After a month or so they called me back told my they settled $35,000 and one third was their fee plus an additional admin strive expense and said okay. However, they haven't gave me my portion yet and Just told me they need to send the check for Mortgage company for endorsement after me be three month holding it. And the check still not sent to me or the Mortgage company.

I hire this firm to sue my insurance company due to hurricane ida claim. The firm was fast and great with getting things done and getting the settlement. When it came done to me recieveing my portion of the check they won’t awnser emails or phone calls. They have been holding my settlement check and my ACV check for 4 months. I’ve signed all the paper to receive what portion comes to me and now its October and I still haven’t received anything. My ACV check that’s supposed to go to my mortgage company for endorsement they haven’t sent it to my insurance company yet because my insurance company has a check number for the check that I had to report and they haven’t received that yet. I’ve try calling and emailing and they don’t respond to emails or phone calls. I read reviews on the website and I’m not the only one going through this situation. I emailed just to see can I get the settlement check as soon as possible because I have bills that’s due because my trucking business is struggling right now and they refuse to respond. I feel like I’ve been taking advantage by this company and they don’t seem to care about there clients.

It’s been months since we’ve settled in court and since anyone has contacted us about our claim. We need the money to fix our roof. If another hurricane comes our home will be at an incredible risk due to the lack of response on behalf of MM&A. We had trouble finding a notary to sign our settlement. It took 2 weeks for us to get an appointment. During that time we received MULTIPLE calls asking when we would be returning paperwork. Since we signed it, no contact. I’ve called four to five times this week and been told someone will call me back. Nothing. No one ever calls. Genuinely becoming concerned that this is a scam. No one seems to care. I have 2 kids under 6 and I’m a stay at home mom. We cannot afford to make our home safe and weather resistant without this money, but there is no concern from the “law firm”. They went on and on about how we probably wouldn’t have to pay them because chances are the insurance company would be found in “bad faith” and be required to pay our legal fees. It wasn’t until we settled that they informed us that this can only happen IF you go to trial. Our representative informed us that we would not go to trial because we would lose more money and not have enough to fix our roof. So since we settled, we will have to pay out legal fees. We settled in June. It’s now mid-September and we haven’t even gotten an exact number on what we will receive. They also repeatedly spelled my name wrong ***** ** ****** ********* ******* ** ****** ********

This company does not answer calls , they have a answering service to take their call I have left serval messages to have someone call me back no one as of now from that law firm contacted me back yet. I am trying to request a letter of termination from this firm to whom I never ask to represent me, I have been calling because I want to ask how they became an attorney for me that I didn’t need. At the point I never seen a law firm handle people like this, the office in New Orleans don’t answer, the office in Alabama don’t answer and the office in Houston has a line that has all the options to choose from but all day everyday the answering service answers the call. I have emailed per their Email address that was sent to my insurance company. I guess those offices in Alabama and New Orleans don’t exist because I went to the one in New Orleans. I have contacted my local tv station to have them investigate. I feel like I have been scammed
