      For over two years we have been struggling with Allied Outdoor Solutions in Dallas to have them build a quality colored stamped concrete deck on our property, as they promised and contracted to do. See the PDF document included is this complaint to get a list of issues we faced in dealing with Allied. After sending sub-contracted crews with apparent limited knowledge and interest in fixing properly the agreed deficiencies, Allied has informed us that it can not meet the contractual deliveries they had assured us they could, and would, nor correct the defective workmanship, and decided to abandon this project, incomplete, with serious workmanship related problems. In so doing, Allied has moved to a breach of contract. Is this what Allied's “Built Different” really means? We are left with an expensive and defective stamped concrete deck, an “Allied deck”, which can keep deteriorating and lowering our property value. As per Allied, “We (they) never get comfortable with the quality of our (their) builds”. Apparently Allied is comfortable with the quality of this botched build. The poor quality and deficiencies are evident, embedded in the concrete of this deck for all to see. All issues have been documented extensively, and have been identified to Allied. However, they had just wanted to have another Zoom meeting without guaranteeing that they will abide by the new mutually agreed expected outcome. We do not want to have another Zoom meeting like the one we had in March/21, where Allied and us agreed on the major remaining items to repair or complete, and Allied later decided unilaterally not to do, and to issue baseless threats of property leans. We have finally requested Allied to either complete the major missing or defective contractual deliveries, without causing further damage to our property, or to remove this defective deck at their expense, plus refund in full all payments we made to them so that we may contract another company to build a quality deck for us.

      No, Allied’s proposal for a meeting of discuss further is not acceptable.


      We have been discussing the project issues with Allied for over two years, and have stated in writing to them such issues,

      including the missing and defective contractual deliverables. 


      To avoid misunderstand and/or misinterpretation, we prefer to have Allied state in writing how, in their view, they have honored

      the contract, and how they plan to proceed.


      As requested by the BBB:  “To protect all parties, any and all communication regarding your (our) complaint is required

      in writing only."

      The contract scope of work called for a demo of the existing wood deck and pergola, removing a small tree and underbrush, pouring a stamped concrete patio with drainage for downspouts, as well as, a few miscellaneous items that haven't been a documented course for concern. We've have completed this scope of work and documented such on 09/20/2020 with a filled out and signed Job Performance & Completion Form.

      Two of the questions on that form are copied below:


      "Has all of the work been completed to your satisfaction?"
      Answer: Yes

      Further,


      "How would you Rate your job on a scale of 1-10 and please explain why?"
      Answer: 6 The job took way longer than expected.

      The items of concern that involved workmanship have been corrected and documented. The items outside of the warranty, explicitly cracking, have been addressed verbally and in writing on numerous occasions.

      While responding to the 1/11/22 message from the business (Allied Outdoor Solutions), I was not able to enter the text of my detailed response, only the selection of “rejection” of the business comments.


      Our desired resolution is for Allied to finish the project as contracted and paid for, or to remove their faulty deck at their expense and without causing further damage to our property, plus refund to us all moneys we have paid to them for this project.

      The reason why the company’s response is unacceptable is as follows:


      Allied continues to refuse to meet its contractual obligations. It’s statements in their 1/11/22 BBB message are incorrect and were already addressed in my attachment to the complaint filed on 12/30/21, and also addressed to Allied’s personnel in Dallas.

      In their 1/11/22 BBB message statement, Allied claims that they have completed the contracted deliverables. However, 
      1) “pouring a stamped concrete” required stamping throughout, not stamping only in some areas, not in others, and double stamping with raised hazardous concrete ridges in others. This contractual delivery was incomplete, and done with poor workmanship. An attempt was made to correct some of these conditions to a passable state, but many are still present in the deck. Please come and see.
      2) “a few miscellaneous items that haven't been a documented course for concern” need to be listed to know which they are for us to be able to respond properly.

      The expansion/isolation joints to be built at the house foundation, brick wing wall, and stone planter, as stated as deliverables in the 10/4/19 & 10/5/19 emails from Chris *. / Allied Project Consultant, and acknowledged by Chad ** / Allied Director of Project Management during our Zoom meeting on 3/22/21, were not built. This contractual delivery was not done and it is still pending.

      The “Job Performance & Completion Form” referenced by Allied, was presented to my wife for signature in a hard to read electronic tablet, with no hard copy to read, evaluate, and to properly rate the work. This issue was raised to Stephen W. / Allied Senior Project Manager assigned to this project, in my email of 10/12/20. Stephen agreed in his email of 10/13/20 to change the rating to reflect the correct condition of the work and to inform Allied’s Office of our displeasure. Allied has not taken into account such agreed corrections to the form.

      Various items of concern that involved workmanship have not been corrected, as per my emails to Stephen and Allied’s Colton *., and as listed in my document attached to this complaint when it was filed.

      The wide cracks that have formed by the house foundation is the result of poor workmanship as stated in my emails to Colton, cc to Chad, and Reed *. / Allied Field Supervisor. Such poor workmanship related wide cracking is within Allied’s warranty and responsibility to repair. 

      Allied is ignoring the poor workmanship applied to this project and is skirting its responsibility to correct it.

      All of the items mentioned in our meeting in March of 2021 were either addressed or determined to not be good long-term construction decisions. We fixed all workmanship items and even attempted to help with imperfections that are not covered within the workmanship warranty. The rationale for the construction decisions have been repeatedly documented and addressed. Additionally, cracks are specifically not covered within our workmanship warranty. This is addressed clearly on the contract in the "Facts about Concrete" call out:  "Cracks and other imperfections may occur and are not warranted against."

      Neither all “items” agreed to be fixed during the Zoom meeting on 3/22/21, nor the original contracted deliverables have been completed. This has been addressed already several times to Allied's personnel and management, which continues to claim that such contracted deliverables have indeed been delivered. i.e. The expansion/isolation joint at the house foundation has not been provided, as contracted, and as an essential construction element needed between old and new concrete structures. Allied should provide documentary evidence if this deliverable has been provided, as they claim, and if not, why not.

      To define something as "determined to not be good long-term construction decisions” is not stated as to which deliverables it relates to, why not good long-term construction decisions, and defined by whom. In any case such should have been stated early on when we were deciding on which company to hire to build our deck, and before we contracted Allied, not unilaterally defined by Allied after the fact, and after it delivered a faulty workmanship and substandard construction solution.

      Allied’s classification of "even attempted to help with imperfections that are not covered within the workmanship warranty” is undefined, as to which imperfections, etc. Please clarify with detail.

      Please provide the documentation for the construction decisions that Allied claims to have been repeatedly documented and addressed.

      Cracks which are clearly caused by faulty workmanship are indeed covered under Allied’s warranty. If this is not so, please provide documentary evidence to support such statement. 

      One set of cracks that have formed relate to spalling of the new deck caused by the new concrete in that area being built on top of the house foundation ledge. Both and/or either undergoing even minor differential movement causes such spalling cracks, which formed shortly after the concrete was poured. The new concrete built on top of the foundation is certainly not industry standard, which even the subcontractor foreman declared that they had messed up. Please come and see if still in doubt.

      Another crack relates to the differential movement within the deck itself, caused and aggravated by the lack of an expansion/isolation joint with the house foundation, and the brick wall which has a substandard thin foam material as the expansion/isolation material. Failure by Allied to prepare the soil under the deck before pouring the concrete also causes and/or contributes to “cracks”, which Allied claims they do not warrant, even when such cracks are due to faulty workmanship. as in this case. Do come and see for yourself.

      Before we decided to hire Allied to build our deck, its personnel assured us, and lead us to believe, that Allied would provide an unsurpassed high quality solution, therefore the high price. With all the deficiencies we have encountered with this project, and Allied’s resistance to correct them, we can not find such high quality, nor a good reason to hire them again, nor recommend their services to others.

      This response from Allied is premature as to acceptable or not towards completing this project as contracted, addressing the faulty workmanship, and resolving this complaint.

      Yesterday, Feb 2/22, we received a voice message from Shea, self identified as an Allied Director in Garland, requesting if it would be OK:   
          "to come out and take a look at your project, like to go over your concerns with you”.

      Returning his call, we have agreed with Shea to come and see the project on Feb 17, as Shea is on vacation and out of the office next week.

      The on-site meeting on the 17th needs to be for Allied’s management to see in person Allied’s missing deliverables, plus the structural failure to date, which are not just “concerns”, and develop an executable course of action to correct them.

      Further, this latest response from Allied indicates that their purpose for the on-site meeting is:
          “to take a look and determine how we can help further”.

      The issues raised in this complaint, and documented extensively to Allied, are not those in need of “help”, but in need of completion and addressing the structural failure due to faulty workmanship.

      A point to correct Allied’s response:
          “our expert to visit on-site again”

      Shea has not been to this site before.

      Allied is misunderstanding, and/or still resisting and refusing to accept the real nature of this complaint.

      This latest Allied's comment is OK as it is, but the issues that resulted in this complaint are still to be resolved, and the complaint can not be closed.

      Shea *. / Allied Director Client Service Specialist & Reed *. / Allied Field Supervisor came today (2/17/22) to see the issues which we have raised to Allied on various emails last year and detailed in the attachment to this complaint.


      Shea wrote some notes and took several pictures of the deck and stated that he will evaluate the issues against the related contractual commitments and issue his recommendation on how to address them no earlier than 2/25/22, as he will be traveling until then.


      It is to be noted that Reed had also taken similar pictures last summer, and informed Allied’s Management of his findings.


      We will wait for the recommendation and proper implementation of any agreed comprehensive solution to issue a formal & final acceptance of Allied’s response. This might take several weeks.

      After their visit to evaluate the faulty workmanship on Feb 17/22, Allied has not issued their promised recommendations on how to address the deficiencies with their delivery. There have not been any discussions with us on those pending recommendations.

      The wheels at Allied turn very slow. As in the attachment to our original complaint, it took Allied 5 months to email to us the “color selection" documents they had asked us to sign on a hard to read electronic pad. On receiving the delayed “signed” documents, we found out that they were not color selection documents, but instead were terms and conditions on their delivery, which we had not seen before.

      Allied has known about the deficiencies with their product for over a year and a half now, and still they offer no adequate solution.

      In the meantime, Allied continues to advertise in our area, and using the BBB Logo to attract new customers.

      It still premature to close this complaint, as we are early in the discussion phase as to how Allied is going to address the outstanding issues with their delivery.

       

      Shea Ledford - Allied Director Client Service Specialist and Ryan - Allied Field Supervisor are scheduled to come to the site next week on Friday,  April 8, to discuss in detail their proposal on how and when to address the outstanding issues.

       

      After the issues are addressed and the work is successfully completed, we can then proceed to close this complaint.

      Shea *. (Allied Director Client Service Specialist) and Ryan (Allied Field Supervisor) paid us a visit on April 8/22 to explain in detail their proposal to add one of the missing contractual deliverables, the expansion/isolation joint between the deck and the house foundation, and we have not heard from them since.


      Their proposal was to remove the lower step-down part of the deck next to the foundation and add the missing expansion/isolation joint, pour a new replacement section of the deck, stamped, colored, and sealed. This was to be done by making about a one inch deep cut with a hand angle grinder at the four inch thick deck and remove the remaining three inch part using a sledge hammer, or similar device. This approach could result in damaging the remaining higher part of the deck, it would have an expansion/isolation joint also with the remaining part of the deck, and the new colored section would not be assured to be the same as the higher step-up remaining part, all of which would create another set of problems.


      Shea then suggested to leave the deck as it is, without the missing expansion/isolation joint, and wait to see if the current cracks in the deck worsen or another problem surfaces, in which case then Allied would come back and make the one inch cut, etc. in order to add the missing expansion/isolation joint, which it was already agreed that such approach would not provide a safe nor suitable solution as in trying to solve a problem, another set of problems would be created.


      I have suggested several times to Allied to secure the services of a company that specializes in creating an expansion/isolation joint where there is none, but to this date they have not secured such service.


      Separately, while discussing the bad quality of the stamping of this deck, Shea stated that the quality is high and consistent with what is delivered by the industry. I requested a list of other sample concrete stamping work that Allied has done in this area to compare them to this deck. Shea agreed to provide such list, but to this date we have not received it.


      It has now been almost two years since the concrete was poured in our patio, during which time we have been communicating with Allied about the missing contractual deliveries, with no resolution in sight, but with their threats and unproductive delays.


      In the meantime, Allied has increased their advertising in the DFW area, and using the BBB logo to attract new customers, likely increasing the number of complaints raised to the BBB, with delays after delays in achieving, or not achieving, resolution, and with no compliance with their contractual obligations. 


      Is this the type of business that the BBB wants to have as an accredited member?

      On June 22, Shea ******* - DIRECTOR Client Service Specialist, Reed Brentlinger - FIELD SUPERVISOR, and Carter from the Phoenix office came to the site to review options to complete the missing deliverables.

      I proposed a simple option to provide the missing expansion/isolation joint at the house foundation by cutting a narrow strip of the deck close to the foundation using a type of concrete saw that can be positioned within 1 to 2 inches from the house foundation, and install suitable expansion/isolation material. I provided Shea with sample saws that appear to be usable in that mode. Shea agreed that that seems to work and would look into the saws available and requested Reed to prepare a work order to do the job.

      Shea then reviewed what needed to be done to complete the missing part of the beam at the edge near the wood fence and requested Reed to prepare a work order to do that job.

      Shea informed me that he is currently looking into the availability of the saw and the implementation of the two tasks has not been scheduled. We have requested Shea to have the two tasks completed by July/22.

      After completion we will reassess our response.

      The missing deliverables are still missing. Allied informed us on June 30 that they had procured a saw to cut an expansion joint next to the house foundation. To this date, July 25th, they have not yet scheduled the work to deliver the expansion/isolation joint at the house foundation, nor the missing contracted beam at the wood fence side of the deck. In the meantime, the section of the deck that had cracked and moved way from the house foundation has moved further. It appears that the isolation joint at the brick wall is ineffective, as we had indicated previously.

      The missing deliverables are still missing. Allied is in the process of preparing work orders as we had agreed on June 12, and the work has not been scheduled.

      We hired allied outdoors do remodel our existing pool and add stone around the pool as well. The workmanship is poor and when we requested some warranty work be done they sent out a person who was 3 hours late and spent less than 5 minutes at the house looking at the pool. The guy said it’s definitely warranty work and someone would be contacting me shortly. A months later someone else contact me and asked a few questions and said someone would contact me. A few weeks or a month later another guy called and said it was not warranty work and gave me some genera I’d reason why and when I requested a reason in writing so I could investigate there findings he hung up on me. It;s been 3 months with no contact and I just called again an no one will respond. I spent 30k with them on this job and 13 k the year before. This is not right.

      Allied installed a cover on top of our pergola. In order to create rainwater run off, they cut/shortened the pergola support beams. This was not the correct approach as it has resulted in the pergola ripping away from the house, damaging the section of my home it fell on, damaging the pergola itself, exposing my home to water/weather damage, the pergola sagging/hanging and pulling electrical cords with it. My project manager has not returned my phone calls. The hanging structure and stress on the electrical cord is very dangerous. I notified allied 3 weeks ago and have no idea when they intend to repair it.

      Signed a contract on May 13th. They did not start until August 13th. First day of work, two of the workers get into a fight and the Austin Police were called to my house. Also, they hit my pool line which caused my yard to flood. They had to have know about this because it was flooding the area where they were digging, but ignored it. They did not fix it. I am trying to figure out the damage and get my pool fixed. At 11AM of the second day, I asked to cancel the project and for them to refund my deposit. They are attempting to deduct unauthorized amounts from the deposit for uncompleted work. They have damaged my pool, pool equipment, and my yard is a disaster. I am requesting my full deposit back. If there are any amounts owed, I will deduct them from cost to fix the damage to my house. Additionally, the fight and police took up about 2.5 hours, and I am not paying for this time. BBB submission term link does not work so I did not view this.

      After I filed my complaint, Allied Outdoor Solutions responded that they were in contact with me. They sent someone out who said the patio should’ve been primed and wasn’t that’s why we are having problems. They said it needed to be removed and totally redone. After that they would not respond or return my emails. So I am stuck with a horrible looking patio that they clearly have no intention of fixing. I tried reaching out on Facebook and they have blocked me. What is my recourse here?

      I contacted this company over 4 months ago to build a patio cover attached to my house. They were paticularly attractive because they claimed to deal with my Home Owners Association and the city. On March 29, 2021, I signed a contract and paid the down payment to start the project. Nothing happened for probably two months including updates, phone calls, texts, etc. Once they started actually building, it was exciting and a nice looking profile to my house. This company claims to be waiting on a business partner, an inspection or the weather but it's all just excuses because I'm here everyday and even I know that the roof inspection has nothing to do with the build going on underneath. If I am wrong about this someone from this company needs to explain why people come to this work site and spend about 30 to 45 minutes to do one or two small things and they're gone again. This week there were no weather issues but no one is working and whole weeks have gone by with little action.
