I have been working with McDonald/ ****** Law Firm out of Texas since 2018 when i agreed to hire them for hernia mesh lawsuits. When initially in paperwork and medical records process there was a lot of communication via phone and email. Once this was put into litigation and trials came and went and nothing, no mention of settlements, no mention of ANYTHING. EVERY client gets the same response, 'these MLD cases take time and we will reach out when there is news. THEY DO NOT!!!!! It is all a smoke screen, and they KEEP accepting new cases to shorten ANY settlements for others, JUST to pad their pockets. I have had 9 hernia mesh surgeries since 1998 and THIS firm does not care about a single client's health or well being. At the very least i would like DON to talk to me on where this is at and possible settlement amounts. I believe this firm is scamming people and using our information to get money for their selves. I will not refer them to anyone because of how they treat people.

John, I apologize for any dissatisfaction you may have experienced regarding our communication with you. We attempted to reach you by phone to speak directly about the matter, but we were unable to connect. We will try again to ensure we have your current contact information if you are not receiving our monthly updates.

Your lawsuit has been filed and served, and we are now waiting for a potential offer to be made based on your case and injury level. We understand that this process can be lengthy and appreciate your patience. Unfortunately, we cannot predict how long negotiations will take since we have no control over the defense's response time. Until a settlement is reached, there will not be much change on the monthly updates.

We hope to speak with you soon and appreciate your understanding during this difficult time.
      -Don ******

This, as with multiple other complaints filed with the BBB, is a generic response to "quote un quote" try and mitigate the false information this firm gives to clients. When questioned upon retaining services they say a settlement and/or finalization takes about 1-3 years. THIS HAS BEEN 5, and with the MLD filed, they are still taking more clients and adding to the case load which is MORE money in the end for them and MUCH less for any clients. I would like answers, some form of concrete direction this is headed and what exactly they are looking for settlement wise. When approached I get NO ANSWERS.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.

Don ****** has been accused of scamming multiple people over the years involved with hernia mesh lawsuits. There are hundreds of complaints ALL saying the same thing. This firm takes on an over abundance of clients to "steal" "profit" as much as possible with case load. The current case number for the CRBARD is over 24,000 cases and counting as they keep adding and they avoid helping ANY client. They lead clients on with false information and have legal aides do all the work in computer reply the same bullshit paragraphs to everyone. They ARE NOT out for the best interest of the client or injuries, they are bottom feeders with one goal and that is try to accumulate as many clients and rip them off if a settlement happens. So as an example of hard math, if the contigency based % is 33% and a settlement was 60000 dollars for each client, and there is 24,000 clients/cases, that means DON ****** makes $432,000,000 million dollars off this. Tell me where the logic is in helping clients then

      Regards,

Not sure how to respond to this.  I have not been accused of stealing money from anyone and I have not stolen any money.  There has been no hernia mesh settlement yet so there would actually be no money to steal.  I understand that you are frustrated with the leave of time these types of cases to resolve.  We are certainly frustrated also.  But I think it best that you find another attorney to help you.  We are in the business of helping people but not someone who falsely accuses me of stealing.  Let me know if your new attorney needs anything from me and good luck in the future.  - Don ******

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution would be satisfactory to me.  Don and I have emailed back and forth and built a positive communication base. As it stands with ****** Law and it's employees I have sincerely apologized to Don for the outburst and false allegations as I was mislead by prior reviews and prior comments from others in the past. I accept the fact I was in the wrong for this and regret the harsh comments. I KNOW the due diligence these law firms conduct with the vast amount of cases and many of them being tedious or different.

I look forward to more constant communication between Don and I and for the case to resolved as quickly as possible. I would Definitely recommend this firm to those seeking help.

Ive repeatedly over the years tried to keep up dated only to get same excuse. "We need more info".. I have SEVERAL times given them any all info they have requested.. after dozens oc times i refused to keep sebding same info. I believe theyre just giving me a run around push. Idk if theyve gotten paid on the case n not wanting to let me know truth or not. Or if theyre just stalking it til time expires or what.. I know it shouldnt take no 13 yrs to solve. I want this settled!! They have all the information theyve ever requested for me to get which was their job to so in the first place. Dont mean to be rude but an occasional email now n again requesting SAME info over n over is bull. Ive even called n told them this. Just to keep being told same line. I have been working with McDonald Worley Law firm for several years regarding my two defective hernia mesh implants that are in the same area. They cannot be removed per my surgeon. Each month I'm sent a report from the law firm. In the recent video Mr. Worley stated that, if your letter has the word" "Inventory" on it, which mine does, you are required to have your mesh removed or you will not receive a settlement. I have enclosed the letter, from my surgeon. and the law firm has a copy as well. It states that it's not an option for me to have revision surgery. So, I would like to know when I will receive my settlement for my case? At one time, Mr. Worley stated that those who were not able to get the revision surgery, would receive their settlement, at a later date. Some time ago I was contacted by a lawyer from this firm. He asked some questions, I explained to him, I was not able to have the mesh removed and I was told that I would need documentation from the surgeon stating why. I did that and sent it in to the firm. I would like some sort of confirmation regarding my case. From Mr. Worley’s video he’s saying. people in my situation are not entitled to a settlement, yet I have the necessary documents that were requested by your firm. I would like to know how you’re going to resolve this issue and at what point will my case will be heard. Danette ********

      Hello Danette,
We understand your frustration and empathize with your situation. As previously communicated, we have spoken with your paralegal and have received the document from your doctor. We have submitted your claims to determine if you are eligible to be a part of the settlement. However, mass tort cases are known to take a very long time, and it may take some time to receive potential offers. We will keep you updated monthly and are available to answer any questions you may have about the mass tort settlement process. Thank you for your patience and understanding.

Regards, The reason I'm not comfortable with their response is that my case should not be included  with the tort cases.I have injuries resulting from the hernia mesh and as they have been informed, having the mesh removed is not an option for me. My case needs to be included with the  the cases of those with injuries .Mine doesn't belong  in  with the tort cases.

I will send you a direct email to better explain it to you.  We didn't say that we didn't think you are injured.  We simply explained that the defendant will not settle.  Their position is if this is a defective product case and you are keeping the product inside you, then it must not be defective.  We do NOT agree with that position but we were just communicating their response to you as we are required to do as your attorney.

I'm waiting for the settlement from the firm regarding my Hernia Mesh claim. I have two defective mesh's, that cannot be removed, revision surgery is not an option. I've attached a copy of the surgeon's letter, the same one Mr. Worley's office received, stating the reason why. At the end of last year, I was told my case would be heard soon and that it would be resolved early this year. Yesterday I received the monthly email with Mr. Worley's video stating that if you don't have revision surgery, you're not going to be paid for injuries. My injuries will be lifelong, revision surgery will only cause more injuries. I would like to know when this issue will be resolved. My upper right leg is numb, with revision surgery, I chance losing all feeling in my entire leg. That's not a risk I'm willing to take. Thank you.

I hired McDonald Worley to represent me on my IVC filter case they have reached a settlement but refuse to pay me my money saying that they have to check with Medicaid Medicare or the VA to see if I have any medical liens. And I have told them I have not ever had Medicaid Medicare or been a part of the VA. They stated to me that they are working on it and it has been several months now since they have reached the settlement. They also expressed me that they work on a Case by case basis even though it's a tort lawsuit. I would like to receive my settlement check as I don't have any medical liens and stop getting a runaround

Joseph:  I just sent you the following email to your email address:

      Joseph:

This is Don Worley, the owner of the firm.  I'm responding to your BBB complaint also but I wanted to reach out to you via email also to give you a better explanation.  When a Defendant settles a group of cases which were consolidated by Judges into one court, the Defendant wants the lien resolution to be done on all of the cases which are settled before all of the funds are released.  The reason for this is that the Defendant and/or attorneys could be held liable for not paying a lien such as Medicare or Medicaid.  A lien resolution company is hired to identify and negotiate all liens.  In your case, this company is called MASSIVE.  So we have to wait until all liens are resolved before we can release funds.  This means that our firm does not get yet either.  I am just as frustrated as you are on the amount of time that it takes.  I just wanted to explain it better to you because it is not that they think that you personally have a VA, Medicare or Medicaid lien.  They just have to check everyone in the consolidated litigation settlement group.  I know this is not what you wanted to hear, but we are putting pressure on everyone to get this done.

Hope this is a better explanation and we will reach out as soon as we have the green light to disburse funds.

      Thanks,

This practice, the NYC office specifically; has not been honest and communicative with me as to where my funds are. I received an email in May of 2021 as to the release of my funds, over 2 years later I still have nothing. They promise to call me, email me, nothing! I call and my number is ignored, I call back with a blocked number, they pick up. They state there's a process left to finish, they have been doing this July 2021 and say "in about 2 wks up to 3 months" it will be done with. I've been told that about 5 times now. Any other suits against essure has been settled and participants have received their money...while I have not from this office! Get me my money so I can be done!

I know you are frustrated with this process.  As we discussed, the delay is due to the lien resolution process.  The lien resolution process is handled by a court appointed lien resolution company so it is out of our hands.  We are frustrated with the delay as well because we do not get paid until you do.  You should be receiving monthly updates from the firm via email and text message.  I will check with the team to ensure that we have the correct email and cell phone number for you.  I will also give you a call and I apologize for any communication delays on our part.

I spoke with Wesley ***** after the initial complaint and offered him $1,000 to settle and close out his Risperdal case which our firm handled.  The majority of all Risperdal cases nationwide settled for $750 to $1500.  Please be advised that Mr. ***** accepted the $1000 check, cashed it and is still trying to extort additional funds beyond the value previously accepted.  He contacted our office last week and spoke with myself and my paralegal asking if he could get "just an additional $500". Our position and belief is that Mr. ***** was paid in full for his Risperdal claim which concludes our business with Mr. ***** and our attorney-client relationship.  We believe that Mr. ***** is improperly using the BBB complaint process to attempt to secure additional money to which he is not entitled.

Mr. ***** is not being truthful regarding that conversation.

Mr. ***** spoke with attorney ***** Fraser twice who explained all of the settlement terms to him.  We paid him according to those agreed to terms and took no attorney fees.  Mr. ***** called us a few days later and said that he wanted an extra $500 in order to resolve his claim.  The attorney explained to him (1) that we had an agreement and that we paid him according to that agreement, and (2) that we cannot just arbitrarily award additional funds because the client wants it after the fact.  The award was objective and based on the award given to other planitiffs similarly situated.

Regarding the comment as to a settlement range of $75,000 to $150,000, our case management software has a column for the actual offer and a column that is internal to our firm which projects an estimated settlement range when the case opens.  An after-hours call service agent read both numbers to Mr. ***** by accident.  The attorney immediately upon knowledge of this clarified that mistake.  Mr. ***** knew that he was only being awarded $1000 and was again trying to use that mistake to raise this complaint in the hopes of getting more money than what he agreed to.

Please note that the BBB process has gone from a regular customer complaint to a process of using the BBB as a vehicle to get more money than he agreed to. We respectfully ask that you close this complaint as it is not a good faith complaint and is an attempt to exhort our firm for additional funds. In our opinion, that is not what the BBB process is for.

I have been working with McDonald and Worley for about 8 years. When I first started they let me know every month what was going on. The real problem started in December of 2022. I was told that my lien was done and I should hear something by first week in January. My email isn't working that good so I was calling 2 times a week to see what was going on. I had to pay something to my bankruptcy so 3 weeks ago I got a letter from them said they got their closing statement and it was signed so I called and was talking to Twanna the paralegal and she said mine was sitting on lawyer desk had to be signed I was told that I call to much but when you're told that you would hear something by end of week and you don't so I was pretty well told I can't call anymore. I was told the last 2 weeks the lawyer would call and explain everything to me but there is a lot of money not counted for and lawyer still hasn't called so they are sitting there laughing at me because I can't call and find out anything. I believe this firm is scamming people and using our information to get money for their selves. I will not refer them to anyone because of how they treat people.

BBB Business Profiles are provided solely to assist you in exercising your own best judgment. BBB asks third parties who publish complaints, reviews and/or responses on this website to affirm that the information provided is accurate. However, BBB does not verify the accuracy of information provided by third parties, and does not guarantee the accuracy of any information in Business Profiles.

When considering complaint information, please take into account the company's size and volume of transactions, and understand that the nature of complaints and a firm's responses to them are often more important than the number of complaints.

BBB Business Profiles generally cover a three-year reporting period. BBB Business Profiles are subject to change at any time. If you choose to do business with this business, please let the business know that you contacted BBB for a BBB Business Profile.

As a matter of policy, BBB does not endorse any product, service or business. Businesses are under no obligation to seek BBB accreditation, and some businesses are not accredited because they have not sought BBB accreditation.
