This issue is in regards to a property purchased threw New Western Acquisitions, **** ******* St, Phila. Pa's location, between realtor Daniel ******, license# ********. In the start of last year 20**, Daniel and I established a email notification system of 'for sale' investment properties he'd had under contract to sale to investors like myself. March 3, 20**, Daniel was contacted by myself in regards to a property located in ****** Park. Pa., ** ********* Ave to be exact, for interest in purchase. The same day, I went down to the property to establish my assessment for construction rehab cost's and estimated time to execute property rehabilitation. After the onsite assessment, the same day, Daniel share to me that the roof of the property was replaced 2 years ago and was in stable condition. With this information provided by Daniel, helped establish a predicted rehab cost estimate. This step in determination of property purchase is extremely important, being as it will be the determining factor wether or not this will be a profitable investment. I'm the mist of construction came rain, which exposed a severe leak not only in the main property, the house, but also in the garage, which turned out to be roof related. With multiple roof assessments by roofing professionals, it was determined that the roof could not be merely 'patched' due to the age of existing shingles and condition of underpayment. In order to correct the issue, an entire roof replacement would have to be established. The cost of this ended up being $17,500 in finances completely halting the project due to depletion in rehab budget and extension cost with hard money lender. In attempts to contact Daniel in regard to this, Daniel continued the deception in roof's condition by acting as if he'd been looking for a roof certificate that did not exist and claiming to contact the previous owner. The previous owner's info had been found by myself, who states to had never stated this claim of a new roof.Business Response

Hello, my agent Dan ****** had an investor show up at his father's house in Delaware last night looking for Dan. The investor's name is *** ***** ****, she recently bought ** ********* Ave, ****** Park PA from us. Closing took place at the end of March. After contracting the deal, *** had questions about the status of the roof. We communicated to her that we were unsure of the condition of the roof. We do not have any correspondence via text or email that the roof had been replaced or needed to be replaced.
*** reached out to Dan 4/26 asking for the prior sellers contact information, we did not have authorization from the seller to give her this info so we communicated that to her. There had been correspondence between *** and Dan about another deal in between but nothing about ********* Ave. On Wednesday, *** reached out to Dan who was in Europe, Dan did not respond. Dan then got a call at 7pm last night from *** which he did not answer, about an hour later Dan received a call from his father saying that *** had shown up at his house in Delaware looking for Dan (please see below link to Ring video). Dan then got 2 more calls from *** later that night along with the below text message.
Please advise how we should proceed.

Diana ******, though very pleasant in our conversations neglected to help satisfy with the completion of the due diligence I requested and the sending of accurate pictures I was entitled to in order to determine an accurate assessment of the rehab project with this home purchase. Holiday timing and short close of escrow contributed to this problem. Later I was informed by the lender that there was more damage in the kitchen and debris left in the house. When asked how he knew he stated in the picture he had of the property for which I was never provided. When I enquired with Diana she couldn't explain why my link never included them. I tried to get a licensed contractor over to access the damage but she claimed we didn't have time to now enter the premises. The lender for which she provided terms appeared excessive and unreasonable. Timing and the holidays played a big part in the inability to correct these issues. She indicated that since we were unable to close by Jan 3, 2023, they were going to keep my $5,000 earnest money deposit. I asked if we could apply it to another deal with New Western but she denied my request. I believe given the circumstance and the holiday timing and no tangible loss to New Western that they in good faith return that deposit.Customer Answer

We worked with New western company to invest our capital in a flip property, a duplex in copperas cove tx. The man was very nice but very demanding to get us to get a signed contract. When my partner and I were looking at the duplex, they wouldn't let us look at the other half of the duplex. This was said there were renters on the other side but I think they were trying to hide the damage and the work it needed for the other side of the duplex. We had a purchase agreement for 100k but he was saying if it's all fixed up you can get 170 to 180 for the property. That was a blatant lie, later on, that day I looked at the comps around the area and nothing was going for 170 180. After we signed he followed us to the bank and made us hand over 5k down for the property, Also told my partner to put it in their business name and not the title company name. That is profoundly treacherous because ordinarily when you buy property you want all the money to go through the title company, not into the company's pocket. More than likely they have spent the money, and they refuse to give it back to me. Furthermore, they only gave us 14 days to close. When we were looking for hard money loans no one would fund it because the ARV and LTC would not work out, also it was pushed so soon just so no company will support the deal. Do not under any condition should you invest your capital in this corrupt extortion company. Unless you want to be swindled. They refuse to give back our money and it's so barbarian that they would do this to army vets that blows my mind. We already don't make a lot of money so they took a portion of what we got if they did this to us they most definitely will do the same thing to you.Business Response

In March of 2022 I purchased properties from New Western Acquisitions a licensed real brokerage. I gave them my full trust because they were licensed and should be held to a higher standard. I later found out that they were not "using their license in the transactions with me and only acting as a middle person to facilitate a sell between buyer and seller." This is very misleading and a major cause for concern. Every person who works for this company has to be licensed in order to deal with clients, so I am not sure why they are required to be licensed if they aren't using them to deal with customers. It is my presumption that there is mass fraud going on here and that their practices could easily be harmful to others.Business Response

Business Response /* (1000, 5, 2022/12/05) */ Hello, In regards to BBB Complaint Case# XXXXXXXX, we had our LA GM reach out to ***** as it says he's based in California, he replied with the following: From *****: This purchase was in Oklahoma, so I'm not sure if this is relevant to you, but I was basically led to believe that one of "your agents" was representing me in the capacity of a licensed real estate agent, but turns out that you guys are "wholesalers" which I don't deal with at all. Brenden Harrison was my contact at New Western. (He is licensed in Oklahoma) He insured me that he would take good care of me and promised to be upfront and honest about everything. He said that he was very knowledgeable about the market and based on him being licensed I felt that honesty and integrity would be essential. Brenden presented me with a lender for the purchases, he also put me in contact with contractors, basically serving as a one stop shop. He told me that he had done multiple deals with the lenders and contractors. I later found out that the ARV's of all of the homes were heavily inflated and that the contractors bids that "his contractors" provides are far lower than what they'd actually do the work for. Everything that he did was false and misleading, including the lenders involved and the pitch that is used to reel me in. The whole practice there is to boost sales and profit for New Western, with very little concern for the affect it will cause clients. This situation has caused me to lose a lot of money and to be hospitalized due to high blood pressure, depression and anxiety. Once we realized he was working with the OKC office, I reached out to the local GM and he explained that ***** is a wholesaler who was fired from his previous company (the company that we work directly with) and is based entirely on baseless claims and is spouting baseless lies. Brendan is a top agent in the company and has never had a bad complaint since he's been working with us. The GM thought this was resolved 2-3 weeks ago whenever we spoke after he blatantly ran a smear campaign on social media. Please advise and let me know if you need anything else from me. Concerning property located at 1710 S 43rd St Temple, Tx XXXXX XX-XX-XXXX Met with agent at property. He was very verbal about mulitiple interested parties interested and it was very obvious that he was using pressure to lock up a deal. Viewed the property and I asked several questions concerning earnest/deposit money. Whether or not it is given back depending on the numbers and all CMAs-Agent verbalizes New Western isn't in the business of stealing people's $5000 deposits. He states they will find a different buyer and refund my money if things don't go accordingly. Along with inflated ARV (after repair value), company says there is more than enough room for making back my money depending on figures that were proposed. Sales price $180,000 ARV-$240,000 Based on these representations 11-10. I signed to put property under contract. Wired my $5000 earnest/deposit money. 11-17-BPO comes back way under what was portrayed by the broker 11-17-I called to back out of contract because numbers do not support proposed ARV and numbers from broker. Talked to agent multiple times between 11/17-11/22 to reason with and get a refund of my initial deposit. He stated that it was tough finding another buyer when there were plenty of buyers lined up when I was looking at the property and he was showing the property, but now I want my refund and there is no one to be found. The numbers portrayed by broker did not line up and it didn't make fiscal sense. Bottom line is they need to refund my earnest/deposit money due to misrepresentationBusiness Response

I went under contract on a home with New Western Acquisitions (NW) at 6157 W 65th Ave Arvada, CO. I'm requesting a refund of my earnest money because a) the condition of the property was misrepresented by my NW agent and b) NW has re-listed the property and will receive earnest money from an investor. This will eliminate any damages to NW and they need to refund my earnest money payment. 1) I believe that both New Western and the seller had information on the true condition of the property. This info. wasn't disclosed to me and indeed, the problems with this property were minimized during my property showing. For example, the NW agent indicated the roof was in great shape, there were no foundational problems and the rehab budget would be under $60K. The reality is that there were three layers of shingles, the roof needed to be replaced and there was major foundational damage to one of the basement walls. Subsequent contractor bids came in at $135K to $185K. If this information had been disclosed to me, then I surely would have decided not to purchase the property. 2) Once I realized the scope of this project I decided not to proceed with the property purchase. The NW agent and his general manager declined to return my earnest money and instead, used it as leverage to apply pressure on me to purchase the property. They insisted that it is a surefire money maker, even though it's clear that this is a highly complex project where I, as an inexperienced investor, could very easily lose a lot of money. 3) NW has re-listed the property. Because it has been re-listed at $20K less than the original listing, it will likely go under contract very quickly. NW will then receive a fresh $10K injection of earnest money and secure a quick close with a more experienced investor. Because, according to the NW agent and his GM, NW's business model is not profit from the earnest from failed deals with new investors, I'm simply asking for NW to return my earnest money.Business Response

Since April 18, Anthony F***** has been contacting me via text/email regarding the sale of our home. Anthony visited on April 19 and was fully aware of the offer Opendoor had given us, and that we had 2 companies offer the same price or better. On April 20, Anthony sent an offer that was approximately $75k less than Opendoor's overall offer and over $40k less than their final offer (after fees). I told that it wasn't even in the same ballpark as the other offers. He proceeded to ask if the price I told him was the net earnings, which I explained again that it was. On Thursday, April 21, he texts saying to let him know if the other offers fall through. I told him that what he offered still wouldn't work and that if that were the case then we'd just sell the house ourselves. On April 28, he text asking if we'd executed a contract yet. I didn't reply because I already said I wasn't interested before. On April 29, Anthony emails me asking if we were under contract. At this point, I am beyond annoyed and I sent him a reply saying, "We are and still had another better offer than you gave, so we aren't interested, but thanks." He then asked what price we were under contract for, to which I didn't reply. May 6, he says, "Do the other two offers have option periods? Give me a call if they terminate. Thank you." I replied, "We are not interested and ended up going through Opendoor. They offered us, as I told you initially, $210,500, and that is after all the fees they charged from the initial $237,000 they evaluated the house at. We are closing on the 12th, so we don't need your assistance. We wouldn't sell the house for what you offered for any reason, so there is no need to further contact us. If we had the time, we'd just sell it through a realtor and still make way more than you offered. I am not interested in your $170,000, low-ball offer, and already explained on multiple occasions that we already had a $210,500 offer!" May 9 and today he emailed again!Business Response
