I purchased my home from Sumeer homes in 2015. I've had to habe my floors replaced 3 times due to buckling issues. We thought it was flooring but this last time we found extreme moisture coming from slab. So extreme that the red barrier that blocks all moisture was put down and it still is coming through. Due to this finding my flooring company will not put flooring down until issue is resolved. I've had a master plumber, hvac tech and foundation engineer out and they all agree that the builder probably did not install a moisture barrier blanket or punctured holes in the barrier. I would have had no way of knowing this. But it's so extreme that every part of my home is registering over the limit on a moisture machine. One of my children has asthma related conditions and had to be hospitalized and I am now thinking it may stem from this issue. I've contacted the builder and they keep trying to push me off on a 3rd party warranty company. When speaking to them they said I would have to pay 250 to start an investigation but it would only be for things like the foundation is falling apart not the issue I'm having. I am told to fix the issue we need to have dryers brought in to dry it out and install the red barrier again on all the floors in the home. I'm asking them to pay for that cost and make this right. I'm a single mom who doesn't get child support and I trusted sumeer to build me a quality home and I should not be having these issues. I'm asking someone to help me resolve this so me and my children have a safe place to live and I don't have more issue because of this.Business Response

********************* and her Fianc first reached out to Sumeer Homes late August *************************************************************************************** 2015. We informed ********************* that the only warranty remaining on her home was her 10-Year Structural Warranty held by StructSure, we recommended ********************* reach out to StructSure to address any potential issues. The $250 processing fee is per the warranty handbook and is a fee for StructSure to send out a 3rd Party Engineer to make an evaluation, this fee is not for Sumeer Homes. Sumeer Homes provides homeowners with an Industry Standard 1-2-10 New Construction warranty, 1 Year on Workmanship, 2 Years on **************** (HVAC, Plumbing, Electrical, ETC.) and a 10 Year Structural Warranty (held by StructSure). Each Sumeer Home goes through a vigorous inspection process with City Officials and Engineers throughout construction, including prior to the Foundation being poured, to ensure all building codes are being followed and the home is being built per approved plans. With a closing date in 2015, the only remaining warranty ********************* has is through StrucSure. We recommend ********************* files a claim through StructSure to see if any of the issues she is experiencing of warrantable via her 10 Year Structural Warranty.Initial Complaint

Issued a warranty claim on 2/1/2024 . Builder has yet to address a tile floor and sub flooring issue. Claims issue was addressed and it has not been.Business Response

We have a follow up appointment scheduled with the Homeowner for May 1st, 2024. This appointment is to observe the area in question and determine if the subfloor is within tolerance per the Structural Warranty Specifications. We purchased our home with the condition that our draining problems would be taken care of. We had excuses that the backyard was too wet for equipment to address the issue. My last conversation with *** in my yard that that this was going to be taken care of. I'm not the only homeowner affected by this issue. I have been to the city and viewed the plans that were submitted by Sumeer. Swells were not installed as per the plan to divert runoff to the street. I have called numerous times leaving voice messages to ***. No return calls. I have been to our district 4 with this issue but was told this is a civil issue. I just want this to be corrected by sumeer as promised. I feel that they sumeer knew that there was a issue with draining but never disclosed it to us. I have documents and pictures. We are ******* and *************************** and we reside in ********************** phase2 in ******, **. We purchased our Sumeer home in **** which makes it 20 years old. I have reviewed all documents from the home purchase. I did not find evidence of an *** was included in the sale. If we had known, we would not have purchased the property. ***s can be a nightmare. The ***** *************************** laws require the developer provide bylaws and CC&Rs to the homebuyer during closing as proof an *** exists. Sumeer Homes, the developer, retained themselves as the *** governing board. Again, not communicated to us. Sumeer is also in violation of the ***** Deceptive Trade Practices Consumer Protection Act by falsely misleading homebuyers to believe there was no *** in our community. We submitted a 60 days list back in January 2021 and have followed up on it with no communication from the seller. We have office doors that have had issues and were due to be replaced and have gotten the run around since April/May and the last 2 follow up text messages was in June 2022 and Sept 2022 and was told that the painter has not yet painted the doors but they did have them. We have now submitted our 11 month list before we get anything done on the 60 day list which is still not completed. That is horrible way to run a business and I have also reached out to my Realtor to inform her of the issues we have had and that I will not be referring anyone to buy in this area with this builder.Business Response

I'm writing to you about something we find serious in my neighborhood of Brighton estates. The builders have done an awful job in putting these houses together. I have been here barely 3 years and the roof is leaking inside the house. I have called the person that's over the builders numerous times and he said he would get someone out here to fix it. Two months have passed *** I still can't get him here. All he tells me is file it on my insurance. Why should I have to do that when the roof should should still be under warranty. It's not fair we're paying over 300,000 for these houses for them to put them up this way. The person who is over the build should not be. They make these homes in not good quality. The neighborhood has met up to talk about this and how even though our home is in warranty they still won't send any one out to fix it. I know your busy but could you please help us/me we would really appreciate it. The leak repairs have been made and we are in the process of scheduling the interior repairs. Sumeer Homes, like most new construction builders has a 1 year workmanship warranty that has expired at this house as they closed more than 3 years ago, but we were able to get the homeowner in contact with the roofer to repair directly. We should have all needed repairs completed in the coming days/weeks. Sumeer Homes will always honor their warranty obligations as long as they fall within the time guidelines associated with the Builder's Warranty.
