      This company continually sends physical mailed solicitations despite multiple reach-outs to stop. 12/27/21 - Received an unwanted mailer - emailed to [email protected] to opt-out 1/18/22 - Received an unwanted mailer - emailed to check on status 3/18/22 - Received an unwanted mailer - emailed to [email protected] to opt-out 4/17/22 - Have received another letter from Insperity Company has failed to respond to any emails. Request is simply for them to stop sending me physical mailers, placement on any opt-out lists, and respond with an update.

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution would be satisfactory to me.  If the business continues to send out solicitations, and will not resolve properly via the provided email address, a new case will be opened.

      Nov 2021, I changed my IRS withholdings W-4 to lower my number of dependents from 1 to 0, using Insperity's website. Jan 2021, I get a letter from the IRS saying they have locked my withholding as I am not exempt from withholdings. I did not at any point claim to be exempt, I only changed my number of dependents.

      Mr. ****** contacted us yesterday with questions regarding the IRS lock letter he received.  He was quite irate and used abusive language with several of our employees which is not acceptable.    He was routed to Ms. Christina ******* who explained to him that Insperity has nothing to do with the lock letter  but is required to comply with it and send him a copy. Insperity does not know why he received a lock letter from the IRS but advised him to contact the IRS as often these are sent in error.  There are multiple reasons why someone may receive a lock letter, none of which are disclosed to Insperity.     We confirmed with him that he did not claim exempt while co-employed with Insperity.   At the end of their conversation, Ms. ******* thought Mr. ****** understood that and that he was satisifed with the explanation.     I am assuming  he filed this complaint before he spoke to Ms. *******.   If not, we do not know why he filed the complaint after she explained the Insperity has nothing to do with the lock letter he received from the IRS.

      Insperity is in charge of the payroll for ********** ********** *******. When I started, they had someone who oversees all changes needed to be made on the W4 before adding people to payroll, review my information submitted to check for any errors or changes that have to be made. I was advised incorrectly and I am now finding out I am still considered a non resident of GA and supposed to be exempt from taxes. I received a severance payment from Northpoint Commercial and Insperity confirmed yesterday that I was taxed incorrectly. They refuse to fix THEIR error, refuse to refund me the amount and are trying to get me to wait until the 2023 tax year for the funds. This is against policy and procedure as a company who is overpaid for taxes has an obligation to fix their error by paying out the money during a regular payroll period, if the person is still an employee. If the person is no longer part of the company and the error which causes overpayment of taxes at the fault of the company, they are obligated to payout the money owed through a lump sum refund. Insperity refuses to fix the error done by their payroll team and have been very negligent in updating the IRS as well. They are trying to keep my $1,200 I am owed and that must be paid out immediately or else this WILL become a legal problem and be taken to court.

      When the complaining party onboarded with Insperity,  she completed a W4 & a G-4 GA State Form.  Those forms included her residential address of 2*** ******** ** *** ******** ** *****.  The NEIS form also has this address as her residence and **** ******** **** *** **** *********** ** ***** as her worksite.

      We do not know why she believes she is a nonresident of Georgia or who told her that as Insperity did not given the information she porvided.  We deductibed $70.00 in GA state taxes from her severance pay and the rest were federal (SS, Medicare, federal tax). Severance pay is considered to be fully taxable at the supplemental rate.


      From our review of her withholdings based on her W4 and G-4, they are accurate.

        The best part about having phone calls with a payroll specialist is that they are tracked and can be recorded. Whoever wrote this clearly has a lack of knowledge regarding GA residency and tax laws and perhaps needs to take a course or something on them before spreading misinformation. By LAW a person is NOT a resident of GA until 183 days has passed. I have a legal address in MA and I am residing in GA temporarily. A person can have a GA address and not be a resident by LAW until 183 days has passed. You can dispute the LAW because you aren’t higher than it. Severance pay to nonresidents is NON TAXABLE and their specialist Latasha actually called me to confirm this information (I have proof of the call and can provide it). I also consulted with a lawyer who confirmed this. How can you have your tax specialist call me and tell me I overpaid and that I’m owed money but try to turn around and lie to cover up the truth, which is whoever handles the W4 didn’t do their job correctly when it came to verifying my information and whoever that was had an OBLIGATION to be sure all information was correct before adding me to payroll, which wasn’t done. If the company wants to lie to cover themselves, that’s fine and I will take them to court (will file a small claims lawsuit today) if they don’t refund me the rest of what I’m owed within the next two business days. Stop trying to dispute the law.
