Mr. ****** agreed to build a palapa (patio) with outdoor kitchen for $24,000 that would be paid in previously agreed upon installments (see attached contract for breakdown). He began the day after signing the contract pouring the concrete foundation. He worked on and off for a week or two at a time. By August of 2023 (3.5 months after beginning the work), we had paid Mr. ****** $18,000 in installments. He began not showing up to work. We eventually got some heavy rain, and because he had left the roof frame unfinished, water flooded the ceiling of our master bedroom and got water everywhere. We alerted him of the issue, and he sent someone to fix it. We impressed upon him the importance of finishing the roof so this didn't happen again. He assured us he would. A week passes and another rain comes. Our bedroom floods again. We gave him two weeks to come finish the roof or he would be fired. He never came back after multiple promises to complete the work. Meanwhile, we receive a citation from the City of ****** that the building permit that Mr. ****** was using and had displayed at our house had been falsified. We are now facing a court date to explain the situation to avoid a $2,000 fine from the city. We feel that the $18,000 paid to Mr. ****** was too much based on the actual amount of work that was completed. We also feel we are owed money from him due to the damages to the ceiling in our bedroom, and due to improper construction that our new contractors have had to fix. Lastly, we feel we are owed because we now have to take time out of our work schedules to deal with a court date over a citation we did not merit. We would like $8,000 back from the $18,000 we gave him.
