      On June 3rd, I contacted TBar Fence regarding the failure of the concrete posts on our less than a year old fence, resulting in three leaning panels that should be covered under their workmanship warranty. ****** from TBar requested photos, then insisted on an in-person inspection. I explained the need for coordination with my neighbor to view both sides of the fence since my side did not have the metal poles. During this coordination, ****** told me he happened to be in my area and could go by immediately to check the fence while I wasnt home. He claimed that the poles were bent, but Im not sure how he was able to make those claims from only inspecting my side of the fence. Another fence company confirmed insufficient concrete and improper installation.

      We inspected this fence as well as the warranty department the home was built by.  Both parties determined this is not a warranty issue.  Torrential rains along with straight line winds, an act of God caused this problem.  We observed the concrete still intact on the post and the hole wallered out.  This fence was installed per specifications.

      I am rejecting this response because:
      The fence was not inspected from the side where the poles are in my neighbors backyard. How can you determine that the poles are bent? Both builder and subcontractor only inspected the side without the poles. 
      Again, the winds blew east and the fence is leaning to the south. Our house faces north and the poles are loose due to improper installation which is causing the fence to lean as shown in the photos.

      Although we regret that they had issues with their fence this problem did not occur due to installation.  Inspections were done as required when the fence was installed.  This was an act of God which we have zero control over.
