poor quality for a high price. I bought a greenhouse for 1,000. After setup, my greenhouse collapsed in normal weather condition. For 1,000 for a small greenhouse, I expected more out of it. Company said it is not their responsibility which I think it is. The product failed to withstand what it is built for.

      Business response

      03/22/2023

Business Response /* (1000, 5, 2023/02/20) */ Hello: The customer's purchase for 1 Large Walk-in Nursery Greenhouse - 40'x16' Clear with Round Arch was made on 11/7/2022, shipped and delivered to MN on 11/11/2022. We received notification from the customer on 2/7/2023 stating the following: "Hello, I ordered a green house recently. See attachment. I was very excited to use the green house this early spring. I set up the greenhouse before winter at my farm. Unfortunately, to say the least, i was disappointed with the quality of the product. The green house collapsed! The green house couldn't sustained the least amount of snow on top." Now, the area of the country where the customer resides has received a substantial amount of snowfall within the last month. The units manufactured for our company are not designed to withstand any loads of frozen precipitation resting on top of the units. Customers are instructed to remove any and all accumulation from the top of units due to the excess weight leading to the possibility of the structure becoming damaged. Our company informed the customer that the limited 30 day structural warranty (6 month limited warranty for GH cover) for this product does not cover any weather related damages that may occur. Especially when the framework collapsed due to the accumulation of frozen precipitation. On our website, it states the following under the FAQ section in regards to the use any of our units under winter conditions: Q: Tent/Greenhouse Use during Winter Conditions? Freezing weather conditions can be problematic for event tents, but they do not have to be. Tents, canopies, structures, greenhouses and shelters are not designed to carry any type of snow and/or ice loading. Also, plastic products can become brittle when forced to endure extremely cold environments, which can make them prone to cracking and shattering. The materials manufactured for our units are not recommended to be put into use if any form of freezing weather is present or expected (i.e. - wind, ice, snow, etc.). If units are forced to endure extremely cold environments, they will lose some of its pliability and it can actually become damaged if it is flexed with enough pressure. If you decide to have your item assembled while it is extremely cold (not recommended), you will need to keep the interior of the tent heated and also keep moving the snow away from the base of your unit. If you cannot heat the tent, then the snow and ice will make the tent too heavy just like the roof of any other structure and your walls will experience what was discussed above. Please be aware that for any products that are damaged due to any act of nature, inclement weather and/or being left up overnight unattended (Not Recommended), the customer is responsible for the purchase of ALL replacement parts. Our company cannot be held responsible for products damaged due to any of the reasons listed above. Our website also has the following statement as the last sentence section describing the Greenhouse Limited Warranty - 15'x7' Round, 20'x10' Round, 20'x10' Triangle, 26'x12' Round and 33'x13' Round, 40'x13 Round, 40'x16'Round, 40'x20' Round, 40'x23' Round: "...This warranty also does not cover any damages due to acts of mother nature (wind of any speed, rain accumulation, snow accumulation, or any other forces of nature.)". Due to the customers desired resolution request being unable to be processed because the item was damaged by snow accumulation, the customer can provide our company with a list of parts to receive a quotation to repair their greenhouse. Thank you, DELTA Canopy Management

I purchased Delta product and 2 main pieces were broken. The item was purchased on August 6, 2021. Due to Covid I could not get help to install it until October. I reached out and Walmart said they would refund me and then Delta said they could not do anything. All products have a one year warranty or do I need to contact the faded real Trade Commission?

      Business response

      01/10/2022

Business Response /* (1000, 5, 2021/11/22) */ Hello: This customers order was placed on August 06, 2021 and delivered on August 12, 2021. The first correspondence that was received from the customer was from a case opened on Walmart on October 23, 2021 stating that the customer went to put the item together and there were (2) broken pieces. Our Walmart customer service representative let the customer know the following: "We regret to inform you that your 30 day warranty period has expired therefore we are unable to accept the item back nor provide replacement parts. Our company provides a 30 day warranty from the date of delivery of the product for any product received damage by FedEx, missing items or manufacturing defect. Customers are responsible for doing inventory of their product for any damage by FedEx, missing items or manufacturing defect and should contact our company right away and let us know so we can replace those parts. Any other damages even damage by FedEx, missing items or manufacturing defect and outside our warranty period, the customer is responsible for purchasing the replacement parts. Again we are sorry to let you know that we are unable to accept the item back nor provide replacement parts due to warranty being past due for your order. Please let me know if you would like a quote for the requested part/s?" The customer replied back that she was under the assumption that the item purchased had a one year warranty. We informed the customer that she was incorrect with her assumption and the item only had a 30 Day Limited Manufacturer Warranty that started from the date of the delivery of the product. If the customer purchased an extended warranty for the product, they will have to file a claim with the extended warranty company to recoup the cost for the purchase of the necessary replacement parts for their unit. As stated by our representative, we will not be able to accept the item back as a return nor will we be able to provide the customer with free parts due to our company being contacted outside of the warranty period. Our company will be more than willing to assist the customer with providing them with a quotation to purchase the necessary parts to repair their unit. They will need to reach back out to our Walmart representative with the part numbers they will need to purchase. Thanks, Delta Canopy Management Consumer Response /* (3000, 7, 2021/11/23) */ (The consumer indicated he/she DID NOT accept the response from the business.) This response is not acceptable. According to OCGA § 11-2-314 Georgia has an implied warranty and I want the item replaced or refunded. Business Response /* (4000, 9, 2021/11/29) */ Hello: Under the listing that the unit was purchased (08/06/2021) from on Walmart.com, found under the About Seller section, the actual (express) warranty for the customers purchase is as follows: Limited 30 Day Warranty. By purchasing from our company and there being a stated warranty for the product, the customers "implied warranty" is not valid. If our company was contacted within the Limited 30 Day Warranty period, we would have been more than willing to provide the customer with free replacement parts for their unit. But since we were contacted on 10/23/2021, the request was outside of the warranty period. Due to our company being contacted outside of the stated warranty period for the purchase, we are unable to provide the customer with free replacement parts. Our company will be more than willing to assist the customer with providing them with a quotation to purchase the necessary parts to repair their unit. They will need to reach back out to our Walmart representative with the part numbers they will need to purchase. Thanks, Delta Canopy Management
