On 11/17/2023, I registered for the Dreamcatcher Event "********************* Vive en *********." I bought the insurance against our cancellation of the event from Active Refund, which was linked to the Dreamcatcher website, for $1,135.44 on the same day with Order ID C-5L94TVQJ. On 11/25/2023, Dreamcatcher cancelled the event. Dreamcatcher fully refunded the event amount.I disputed payment of the Active Refund Fee to my credit card company, **** of America. They blocked the payment on 12/29/2023. On 3/7/2024, the bank sent a letter denying my claim based on Active's response.I then sent an email to Active on 3/25/2024 stating that the activity was completely and solely for events in ******, ****, which is not in accordance with the Active Terms and Conditions clause Active responded on 3/25/2024:"As stated in the Terms and Conditions (****************************************************************), the purchase is final and non-refundable. Your purchase does not qualify for being cancelled or refunded." Their response is incorrect on two accounts.1. The activity that Active was supposed to insure against was completely situated in ****, which is contrary to the Terms and Conditions that they point to, as noted in my email. Their response did not address this, but, per their terms, they could not issue the insurance in the first place. I.e., they took my money with no intention of even providing the service that I thought that I was getting; the definition of fraud.2. In their email response as well as their response to **** of America, they state that the fee is non-refundable. However, this is not what the Terms and Conditions says, "The cost of purchasing ACTIVE Refund is generally non-refundable, except as expressly outlined in these Active Refund Terms and Conditions."The full $1135.44 should be refunded to my Mastercard account because ********************** fraudulently took money for a service that their Terms and Conditions said that they could not pay.
