I am filing this complaint due to ongoing inaccuracies on my credit report caused by this company's reporting. Please be advised that all of our calls are recorded and after pulling your account up and reviewing your calls. A request to us was never made, however we did speak with you back on 12/18/2023 and you wanted us to call you back after 430. The next call was on 12/20/2023 and you wanted us to call you on a different number because you were at work. We did that on three other dates and you did not answer. We will request a copy of your contract from the original creditor, by law that is all we have to provide within 30 days of the request. Hillcrest Davidson and Associates LLC was hired by ************** to collect a payment from me for candy that I tried to return that I did not agree to them sending and specifically told them not to send it. Months later, my family started receiving threatening, demeaning, and vicious phone calls, text messages, voicemails, and messages on my ******** Page. These people have gone as far as to pose as family members by somehow calling from their phone numbers. For example, my husband was laying and the bed next to me and my phone rang, and it was my husband's phone number. When I answered the phone, it was ***** ******** from Hillcrest Davidson Associates LLC. They have called my family lying saying that I used them as a reference and was demanding that they do something about the balance that was owed. They have been using tactics to threaten and embarrass people by calling their family members and posting on social media. These people are the worst of the worst and they need to be investigated.Business Response

I am a victim of identity theft. I am writing to request that you block the following fraudulent information from my credit report. I have no idea how the theft took place. Once we receive that police report we will deal with the account accordingly. Also keep in mind that we have requested payment history as well to see who was paying for the services rendered. I was contacted by Hillcrest associates , they have been leaving several vague voicemails , so I called them and was speaking to a representative , His name was **** he didnt want to provide me with his last name initial . I was trying to see what the debt was in regards to try in work something out but he got very argumentative and hositle over the phone. I asked to speak with someone else that could help me because by this time , he was talking over me and talking down to me as well. I disconnected the call which are recorded by the way so there is proof as to how he was speaking agressivley over the phone , and they kept transferring me to the same person even after I stated I wanted to file a complaint. Please be advised that all of our calls are monitored monitored and there was no such abuse on the call. I am rejecting this response because: The calls are recorded and the ***resentative by the name of **** was rude . I do have a right to state the call was abusive because the *** was argumentative. Talking at the same time I was trying to explain and not allowing me to speak. And just because mail was sent doesnt mean I received it . Had I was able to speak **** would have known but because he refused to acknowledge and became combative nothing got resolved. We have responded to the complaint and you are entitled to feel however you would like we cannot change that. After reviewing the call there was no "abusive" behavior. As previously stated your account was marked as disputed and a copy of your contract was requested. You are correct just because something mailed doesn't mean you got it however it was not returned to sender either. Neither was the notice we sent you. Keep in mind you no longer have an active account and you no longer speak with customer service. Your account is in collections.
Your complaint stated we left a vague message by law we cant go into detail on your voicemail. We notified you the account was in collections by law that is all we are required to do. Your complaint states you have repaid issues and we do not install or repair alarms. We reach out due to breached contract. If you would like the alarm company to address that concern you will need to file the complaint under the correct company. And as previously stated just like the conversation I had with **** this response is a back in forth. Im guessing this is how you guys handle all your clients seeing the reviews on ****** . However my complaint is with this company. I am well aware of my rights and like I stated the only mail I got was from safe streets and it was a bill not . For any equipment or breach of contract. And just because the mail was not sent back still doesnt mean I received it like I said . You can say what you want but as I said I attempted to work with safe streets to get out of my contract and the only response from them was an email that I responded to and I didnt receive nothing else . The calls from this number comes up as spam and because of the lack of information on the voice mail I dont have to answer when it could be scams . Now moving forward I will gladly work on trying to resolve this matter amicably but I do not and will not work with **** because of his nasty attitude which Im sure you are aware of . I have proven this "debt" invalid numerous times and explained to the team of fraudsters at Hillcrest Davidson the situation, in which they "understand" until a month or so later they'll assign it to a new "collector" who will contact me. Enter big bad ****** *******, ****** decided to Harrass myself and my family, ****** used explicit language and made verbal threats over the phone concerning my family for their wellbeing.****** used software to spoof phone numbers to where my mother sees my contact calling her but in reality it is ****** making false claims and threats, naturally causing a panic.Business Response

I may be a victim of identity fraud. I recently received my credit report and found these fraudulent accounts that I never opened, unknown addresses and inquiries I never authorized. My information may have been a part of a data breach as the occurrence has only been happening for these past years. Extremely shady business as well as their practices. This company called all family members telling them I had a civil action filing being served against me which threw my whole family into stress calling me and if this was true maybe they could of called me I called the number one of my family members gave me and I ask them what this was and he proceeded to tell me how I took money from ace something and never paid it back I ask more questions and he said you will be served it will be in there and I hung up on me. The call to them was made at 11:58 am pacific on 07/26/2024. I have not been late on a bill nor not paid a bill in over 12 years. I tried to sign up for ADT through a company called Safe Street. During the installation they cameras did not work. After trying multiple times they could not fix the issue there for refunding me anything paid and canceling the account. Then I see on my report Hillcrest Davidson trying to collect an amount of $4461. I called Hillcrest and spoke with a manager. His name was ****. I have all the videos of the technician telling me they would cancel the contract. I am requesting this account be closed.Business Response

Please be advised that if you have all the documentation you will need to file this complaint under the correct company which is Safe Streets. Hillcrest Davidson is the collection agency, we notified you that the debt was in our office and even offered a settlement to resolve this . That is all we are required to do is notify you of debt. If you have an issue with the original creditor please file the complaint so they can respond. This will give them the opportunity to pull the account from collections. We cant just close an account, the the client can. Please give them an opportunity to resolve this as we have abided by all FDCPA guidelines.
