Receive multiple calls from a Robocaller. After pressing 2 to speak with someone, I am redirected to another recording where I must press 1 to speak with someone. After waiting a few minutes I get a female who speaks a name very quickly. No identification of the name of the business. They claim to have a medical payment debt but one time it has kept changing. I confirm my identification. I have told this company and have been told several different companies. I have requested to have them send the notice through the US postal service but they claim they will not unless I verify my address. Excuse me, I do not know if they are attempting to scam me and my rights by law do state that they must send through the mail upon request. If they call my number and I have stated that I am the person but I get nothing on who they are but need to "verify" my information. After 3 different times with them claiming, this is the first time they have stated a company name that has been verified to exist. They refuse to send through the mail unless I give them all this information. If they own the debt and I claim to be the person requesting them to stop calling and send through the US mail then they must comply. I do not need to give them all my information which they should have. Each female I have spoken to also do not give me the same name when asked who they are and what company. I have even been told to go to the main office to verify my information and get the information I need. The medical bill claimed also is not correct either. The claim is with an orthopedic surgeon of *********** but they do not state the actual name of the orthopedic surgeon. They also claim different dates. The only bill I still owe on is with a different doctor and that is being taken care of directly with the doctor. When asked about any closed debt from last year, they request the information directly with the proper department and none show up on my record.Business Response

We have restricted the consumers account so that no further calls will go out to him.
In order to be compliant with all PCI and HIPAA regulations, we are required to verify the identify of the person calling us to ensure we do not give out any personal or health information to another person that could be pretending to be the consumer. We do this to protect the consumer as well as our business from the liability of discussing information about a debt with a third party. We are sending the consumer copies of his itemized bill which will include the original creditor name as well as the date services were provided and the collection balance remaining on the account. If the consumer wants additional information, he will need to request via US Mail; or by email to ***************************. The consumer should reference File # ******** on all correspondence. We have also generated another statement to the consumer. If he wishes to pay his debt, the instructions for payment by mail, online, or phone are included in that statement that he will receive within the next few days.

I am rejecting this response because:
I was not calling the business. As stated in my complaint, I was contacted by the company through a robocall. ************ is claiming to be collecting a debt with listed of different amounts each time.The company has shown no evidence that they have an actual debt and has been attempting to make claims that are not actual claims. Claim that the books of a business I have no real indication of has wiped all accounts for this claim. This would indicate that a business is falsifying their books, a felony.
In regards to me mailing to them a request to have all correspondence through the mail, this is ridiculous. If they have a valid claim and are a valid debt collection agency, they use a robocall is the same as if they called direct which means, I do not have to give them any information and have a legal right for them to mail me through their own information evidence they have a debt to begin with.
In regards to HIPPA laws concerning medical records, they now need to prove they have my consent to have any medical record. A debt or accounting or money owed is not a part of HIPPA and many medical facilities mail out through the US ************** bills of medical nature all the time.
Now that they claim that they are in possession of medical records and attempting to use this as an excuse not to mail out proof they have any real account so that I may challenge it or pay the original debtor directly (which is also my legal right), now they are required to show proof that I have consented to them possessing any medical record according to the same law. I also ask the BBB to have them prove this to the appropriate legal authorities.

The laws require us to verify we have the right consumer on the phone before discussing any info with that consumer, in order to avoid third party disclosure. This applies to both outbound and inbound calls.
As stated before, we have requested the itemized bill from the original creditor and it is being mailed to the address on file.
We have not requested that he mail us a request to correspond to mail. Per our previous response, we stated we will cease all calls and only communicate with him via US Mail. As stated previously, the itemized bill is in the process of being mailed to the consumer.
As previously stated, yes, we are mailing validation through the US Mail to the address on file.
We have not stated that we are in possession of the consumer's medical records and are NOT in possession of such records. HIPAA regulations apply to both medical records as well as any personal identifying information related to a consumer such as account numbers, addresses, phone numbers, birth dates, etc.

I am rejecting this response because:1) 3 phone calls requesting the law to be followed and have requested not to be called but to send through the US mail, including certified as that is a way to not only establish receipt but also verify identity and had been rejected on the phone calls.
2) first response through the BBB indicated I would need to mail a request for establishing any corespondents to be through the US mail
If the above was meant to establish no further contact on the phone, the Federal Law states that a person being called has the LEGAL right to request communication being conducted by US mail and not on phone. The agency MUST comply immediately.
3. The previous response by the company was they were using HIPPA as a legal reason for not following a law. HIPPA is an act, the communication and bill collection rights are laws. Acts do not over rule established law. Because the company has established HIPPA, they must have protected information that must need verification to submit through the electronic US postal service. I have requested verification that they have my authority, according to HIPPA. Their response is they do not have protected information or actual medical records. If they do not have protected information according to HIPPA, why is the company hiding behind HIPPA? HIPPA has established that 3rd party billing companies that are either associated with or contracted are included in parties with right to protected information and must ensure that information remains private through electronic means. This company has established by their claims for medical billing or debt protected by HIPPA and therefore must now establish their right by HIPPA to be in possession of protected information according to HIPPA.
4. This response only clearly shows how insulting these people are. They treat individuals with distain and disrespect. The first call, this so called company claimed they were the clinic then changed the information they were seperate. I was told I would need to either write or to go into the main office to have the evidence of debt. I was told on 2 of the 3 calls, I would have to verify my identity before they will comply with my LEGAL rights. Now they insult not only my intelligence buy also the integrity of the BBB with claiming they never claimed I would have to mail to a particular address to have my legal rights.
5. The complaint was 3 different calls establishing 3 different amounts allegedly owed. Complaint also established alleged debt to clinic not known. The only clinic coming close to the one indicated has been requested and has informed me they have no record of any debt owed from the time indicated on the first call.
6. The company had never identified themselves of being a legitimate company, for all intents and purposes, many scammers are claiming to be with legitimate companies and even using robocallers and pushing people to pay them without showing any proof the claim is real. This company has used insulting tones and pushy tactics that is the exact same nature of these scammers.
7. This alleged company has established they are using HIPPA as a reason for not following law. My complaint has now established they are hiding behind HIPPA, which means they must be either an established 3rd party billing company which protects electronic transmission or electronic communication of protected information or they have my authority. I am demanding the authority to have any protected information if mine according to HIPPA.
8. I am in communication with the State's DA's office and have invoked this request. Any further refusal by the company within 30 days will constitute a violation of law. The BBB is not the place for a legal discourse. If this information is not received according to HIPPA and to Federal and State Law in 30 days, legal authorities will be contacted and I will be obtaining an attorney. The State DA's office will establish with an attorney on full disclosure a full list of names of other complainants with this company for a Class Action Lawsuit.

I receive multiple robocalls a week from DataSearch, all simply requesting a call back at an 800 number in reference to "a letter I should have received" with no additional information regarding the nature of the call. Unfortunately, I have received no such letter or any other communication from this entity aside from these vague and suspicious calls. In researching the company, they appear to be a debt collection agency for medical claims; however, as far as I am aware, I have no outstanding or unpaid medical bills. I would like this company to either provide a statement of validation of the alleged debt, detailing the dollar amount, date of service, and facility that provided service, or stop all attempts to contact me.Business Response

We have left messages for this consumer approximately once every 9 - 12 days; however, we have not received a response from her. We did notice that the apartment number has changed on her address and have updated our system and generated a statement that she should received within the next week.
If the consumer had called us back, we would have been able to resolve her issue much sooner.

Unfortunately, due to the abundance of internet and telephone scams in today's world, I am not in the habit of responding to automated messages, which is why I felt more comfortable using the BBB as in intermediary. Had a living, breathing individual reached out to me, I may have been more inclined to contact the company directly. Despite this flaw in their business practices, I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. I will await the verification letter and I am happy to address any debt owed should it be proven to be legitimate.Regards,
