Contractor placed tile on balcony 9 months ago. Started leaking 3 months later . I have called multiple times they came back teice to assess the problem and no solution was provided. A second contractor reviwed the work and stated it was done wrong.Business Response

Balcony was waterproofed with Ardex 8+9. After balcony started leaking **** was sent out to assess the situation and found out that the balcony had shifted due to foundation issues. The patio cover underneath was buckling and there are foundation crack on both sides. When **** went out to look he informed me that even the inside of the house above the balcony was leaking. **** did inform *************** and said he would look for a decent foundation company since we dont do foundations. We were looking until **** receive an obscene phone call from **************** and thats when we stopped trying to help them with an issue that had nothing to do with us. I tried to attach photos to this but they were too large.

I am rejecting this response because:No issue with the foundation. We hired a company called Fry roofing. Waterproofing was done wrong. Using screws created holes every where.
A second contractor *************************** agreed with the assessment. New roofing company is going to demolish the work done by RR and will waterproof with TPO without doing holes with screws.
will send a copy of their estimate once available this week.
I will provide photos once the demolishing uncovers the work done wrong

TPO goes on for roofing. When using tile you use other waterproofing materials such as Ardex 8+9, which is what we used. When using Ardex you do use screws and then you apply the Ardex. The tile setter that install the tile is certified in Ardex. In order to tile you have to put down a backer such as Dura ***** ********* Wedi,or similar material, that has to be screwed down. Once that is screwed down you apply the Ardex 8+9 over that, with the mesh at the seams and over the screws. Two coats of Ardex are applied, three where the seams and screws are. The balcony shifted so much that to column we had just stuccoed cracked. Again if there is to send the pictures I will send them. When I try to attach to this file its to large. R&R values every customer however we can not be responsible for the foundation shifting causing cracking causing leaks.

We signed a contract with R&R ********************************************* on 05/16/2023 to renovate our modest sized master bathroom and replace flooring in our master bedroom with a 4-6 week project time-frame.Demolition started on 06/12/2023 and our house has been a mess since then.We are currently starting week 19 of this project and to-date, we have paid $32,211 (of the $37,211 contract) and R&R has installed a beautiful new walk-in tile shower, shower glass, flooring, window, paint, cabinets, and countertop, but they have misplaced the light fixtures & plumbing fixtures, and haven't delivered/installed the toilet, *********** frame, flooring transition, float/tap/paint damaged sheetrock...all of which R&R is contracted to provide & install. They haven't installed the tub, ceiling fan, mirrors, towel bar, etc that we purchased & have on hand. To my knowledge there are no Supply-Chain issues. I've texted both owners and the project manager daily since the beginning of Sept (week 13 of the project) but they don't read my texts and they don't respond. At times, I call them but most of the time they let my call go to their voicemail and they only return my call 1 out of every 10 calls. One of the owners, ****, agreed with me, that this project is taking too long, yet he is doing nothing to finish the project and he's the one in control of the scheduling of contractors, of the ordering/pickup of fixtures...there are tasks that can be done as we wait for the owner to reorder the missing fixtures. The other owner isn't reliable because he defers all questions to the ****.I want the owners to provide a schedule of when tasks will be completed (needs to be before Oct 27th...which would be week 20), I want them to stick to the schedule and I want this project from h*** to be finished or a refund of $10,000!Business Response

**** spoke with ******************************************** on Wednesday November 1st. Fixtures should be in on the second and schedule of install shortly after. Unfortunately all the fixtures were misplaced somehow and R&R Construction has repurchased all the fixtures. We at R&R understand the frustration that the ************************ are going through and are working on completing their project.

I am rejecting this response because:Week 21 of our 4-6 week project and nothing has happened with the project since the countertops were installed on Sept 28, 2023 (over a month ago). **** tells us he will schedule tasks, but it is only to appease us, tasks such as a delivery date of 11/02/23 for the reordered electrical and plumbing fixtures or a completion date of 11/03/23, but they dont honor their word. To specifically address R&Rs BBB response, the fixtures arent the only outstanding issues...they still haven't delivered and installed the toilet, switch covers, 2 doors, door frames, flooring transitions, etc. and they havent installed the items we purchased & had on hand since June 12th (such as the tub, ceiling fan, mirrors, towel/toilet bars, etc.). Additionally, there are holes in our walls and ceilings that need to be repaired due to the running of electrical wires and can-lights/fan had been delivered but still sit in their boxes.

I am rejecting this response because:We still don't have a scheduled completion date. We are at the end of the 23rd week of this simple renovation and it is still not complete, with outstanding issues such as the broken glass globe, missing the two doors & framing that should had been made/ordered at the beginning of the project since they were part of the contract (and not a change order), 2 new outlets aren't working, a missing vanity faucet, insta-hot connections incomplete, need to install towel bar & hook, etc. Update from the last correspondence: today, Saturday, November 18, 2023 the contractor finally installed our toilet!

The business owners ******************* and *********************** along with other contacts provided to me have all stopped communicating . My texts and phone calls go unanswered. Workers have been to my house 2 days in the last 2 weeks. After 7 weeks and $37,000+ in payments I am still waiting for: my bathroom to have the vanity, the door lock, shower glass and fixtures (that were supposedly ordered weeks ago) to be installed. The den is still lacking the crown molding and window blinds need to be re-instalked.The kitchen cabinets have been primed but not painted (can still see the wood grain). A tiled backsplash and 7 floating shelves have yet to be installed. The fixtures for the kitchen sink, the garbage disposal and water filter have not been installed. Two of the kitchen cabinets that were ordered were returned and I asked to see the receipt so I could get the credit. The transition pieces on the floor were made an inch high and squared and that needs to be fixed. The water has been turned off in the kitchen and refrigerator hasnt been hooked up. Debris from the demo is still in my carport. ALL of these items have been discussed as oending and needing attention. I was told this renovation would ***********-8 weeks. This is week 7 and no one is working so I have requested a schedule, a list of items they are still waiting on if backordered and at the very least a callback. Various payments were made when the fixtures, shower glass, counter, bathroom tile were ordered. The agreement shows my final payment of $3,000 upon completion.This past week I paid $10,000 which included installation of my granite counter. I chose the piece of granite in July (I thought). When I saw the counter top it was the right color but the piece itself has a large black splotch that I would have never approved.Business Response

The countertop in question is the exact piece the homeowner approved. All of the delays began when a check that ***** gave the bounced. After that point all checks coming from here were put on a 10 business day hold as per the bank. Bathroom fixtures were not in yet as ***** ******* the order in mid project. The kitchen sink fixtures were dropped off by *******************. When **** stopped by to see the project ***** refused to let him see it and has told him that we are not getting our last payment and she will find someone else to finish. We at R&R pride ourselves on completing every project, ***** has not allowed us this opportunity. All we want is the opportunity to finish the project we started.Customer Answer

I am rejecting this response because:The check I gave him did not bounce, it was not enough per HELOC procedures so I replaced it with $1000 more as soon as he told me it did not clear. The bank holds have nothing to do with me since the money was withdrawn from my account when the checks were deposited.
The counter had a black area that I would not have chosen. The granite was not cut to fit my counter and has 1/2 inch gap between the wall and counter edge. The fixtures he said were delivered were never purchased per the vendor. I have an unpaid invoice to prove this. The manager knew who this contractor was and said they will no longer do business with him due to previous problems with unpaid bills.
He was not allowed in my house because he was no longer trusted. The shower was never completed and come to find out the opening he was going to leave for an 18 door is not up to code.
The vanity he said he would buy was never delivered. I never received proof that the counters he purchased and that werent used were ever returned. I asked many times for receipts and never received them. This person demolished my house then made a mess of many more items. I cannot trust him to do any further work after he promised to send a plumber in the next day and disappeared. This was 2 weeks ago.

The check on our end was deposited and about a week later was reversed with NSF fees and checks written for ****** job from that check also created more NSF fees. When checks are deposited from ***** our bank does put a 10 day hold on any of her checks because she handed us a check that her bank would not honor for whatever reason.
The granite installed was exactly the one she picked out. Everything else wrong no one has verified since she will not let us into to house. In order for us to complete the job or address whatever she would like addressed we need to have access to it.
We have not disappeared we just need access to address issues.

I am rejecting this response because:I discussed all of the pending items multiple times and provided pictures. I was in contact with the workers supervisor and they were never scheduled to complete the painting, missing cabinet wall, crown molding, *************, etc because they were not provided materials.
The check he received was not NSF and I have my bank statement to prove that my funds were paid and no NSF charges on my part. Their inability to handle their finances is not my fault and my request for receipts for items that should have been installed within the first few weeks were never provided because they never made the purchases. I have the unpaid invoice from the vendor to prove he has lying when he claimed he had delivered the parts to me. I cannot trust this company to show up after they failed to show up on multiple occasions after promising to finish the work. They are all talk and no commitment to quality. Please lower their BBB rating to protect future consumers.
