Weston Dean Custom Homes' role is to hold a high standard of quality in the homes we build for our customers in the Hill Country.  Part of that role is to hold subcontractors accountable to the terms of our scopes of work together and protect our clients from trade partners with frivolous claims.

This review is from a trade partner ********* ****, owner of Torro Construction, who worked as a subcontractor for Weston Dean Custom Homes from 2018 to early 2024.  Torro Construction decided to invoice Weston Dean Custom Homes for work they claim they did without a Work Order, Change Order, or Subcontract to perform said work.  When Weston Dean Custom Homes responded to Torro Construction that this claimed work was done outside of the terms agreed on in our scopes of work together, Torro Construction hired legal counsel and below is correspondence from our legal attorney's regarding the dispute.

    "******,

Please call me to discuss the Torro liens following your meeting with your client later this week.  In a nutshell, Torro has now been paid in full for all projects on which it has asserted liens (which were not timely and/or properly perfected to begin with)yet it continues to maintain those liens in violation of Chapter 53 of the Texas Property Code and Section 12 of the Civil Practice and Remedies Code.  Those liens have to be removed ASAP to avoid growing damage to the homeowners and Weston ****.

The balance of Torros claims are for work it alleges to have performed on a Weston **** Project without any Work Order, Change Order or Subcontract or for work that it did not invoice for several months or more.  It appears that Torro is unlawfully seeking to leverage its defective/fraudulent liens to obtain payments for its unlined work.  The parties overarching master subcontract agreement expressly provides that all claims are waived for work performed in the absence of a Work Order or Change Order or where the work is not invoiced within ninety (90)days.  Some of Torros invoicing was sent more than a year after it alleges to have performed work.

I am optimistic that, with your involvement, this matter can be resolved quickly and amicably.  I appreciate your assistance in that regard.
