CQ ID#******** Original Claimant Name: ***** ****** I am a claimant in the Fire Victims Trust Settlement for the 2018 Camp Fire in ********, **********. The settlement fund has issued my payments to ******************** on behalf of Guerra LLP in January 2024. Since then both ******************** and Guerra LLP (formerly Watts Guerra, formerly *** ****** Law) have pointed the finger at each other saying the other way "processing" the settlement statement so the check could be issued. They've supposedly lost paperwork, then had additional forms be invented to be completed, then after they both swore everything was done in October 2024 now they've just continued holding the funds saying each is waiting on the other. While thousands of claimants have received at least partial payments over the last 5 years, I have received $0. They are holding the entirety of $114,245.79. After they deduct their fees, I am owed $79,189.46. For the amount they've been paid in fees they could hire a single employee for an entire year to do nothing but solely process my check. Yet, still they are unlawfully withholding the settlement funds. When a lawyer receives funds on behalf of a client they have to keep them in a separate account, which is what ******************** was hired to do. However, once in that fund the lawyer's fees should be separated and the remainder issued to the rightful owner, the client. This company is making millions on interest by keeping funds that rightfully belong to victims of the Camp Fire. They claim they have to "calculate the settlement" and since they clearly are struggling with that I am attaching a spreadsheet with the calculated funds outlined for them.Business Response

I am rejecting the response I received from Guerra LLP, attached here, because the response suggested that additional time was needed to "process ledgers" and implied that I may have "misunderstood" prior communications regarding the timeline to releasing my funds. I want to be clear: I did not misunderstand. Guerra LLP's continued withholding of client funds is not only unacceptable but also a violation of legal and ethical standards. The proposed resolution does not align with the legal obligation to release funds promptly upon request and is not a legitimate method of addressing my demand.In *****, law firms are required to "promptly" disburse client settlement funds once all legal and financial obligations are resolved. ***. R. Disc. Prof'l. Cond. 1.15: Texas law outlines clear requirements for the handling and distribution of client property, as well as professional conduct standards that all attorneys and law firms must follow;
Rule 1.15(b) of the Texas Disciplinary Rules of Professional Conduct explicitly states: "Upon receiving funds or other property in which a client or third ****** has an interest, a lawyer shall promptly notify the client or third ******. Except as stated in this Rule or otherwise permitted by law or by agreement with the client, a lawyer shall promptly deliver to the client or third ****** any funds or other property that the client or third ****** is entitled to receive and, upon request by the client or third ******, shall promptly render a full accounting regarding such property."
The generally accepted industry standard for processing such transactions is 5-10 business days. However, Guerra LLP has retained more than $65,000, for more than 13 months, with the remaining funds held for more than 6 months. There is no circumstance under which this delay is acceptable.
I expect immediate action to release my funds and resolve this matter in accordance with Texas law and professional conduct requirements.Regards,

This Lawfirm is representing me in the 3m lawsuit and I have never dealt with a bigger hassle in my life. Its bordering on criminal. Ive spent over 100 hours just trying to speak to a live person and get a call back to submit documentation. After finally contacting the ********************* I got a response and an email address to send the docs to. I was told the docs would be submitted then later on, on my end it showed that no documentation was submitted. I contacted their question submission form and got a response saying they were. Now I just recieved the settlement award email from them for tinnitus only even through the docs I sent in were before and after audiograms showing hearing loss. For documentation they made the determination on it said N/A for every option. Reference audiogram date was N/A. Injury audiogram date was N/A meaning no documents were reviewed for the determination. Also the award determination basically says I HAVE TO TAKE IT because if I decline well Ill let you read it for yourself there is no basis to request a reconsideration, and any such request will be denied without further review. You need to go to the link below to accept your award determination by October 7, 2024. We will then make this election on your behalf in the ***** ***** Portal, which will be your final acceptance of your EPP award. If we do not receive a response from you accepting the settlement award, we will assume your acceptance and make the election on your behalf in the ***** ***** Portal. This law firm is representing me in the 3m lawsuit for Veterans. I have attempted to contact them on numerous times and am unable to either get a person or get told they will "call me back". The Watts-Guerra firm is "representing" me as a claimant in the 3M ear plug lawsuit. I have tried to contact them on numerous occasions and cannot get through. Messages have been left with no follow up. I have questions regarding my case and would like to speak with someone. One of the numbers I was given is no longer in service. This law firm is representing me in the 3m lawsuit. The deadline is tomorrow to sign my documents. I have contacted this office via email and via phone with every number listed over 25 times a day for the last week. I have yet to have get the answers I need in order to pursue my claim. I only receive and automated message with the incorrect documents still in my email to sign. I need this rectified immediately in order to continue my claim. I hereby assert that Watts Guerra LLP, acting as my legal representative in the litigation against 3M, has demonstrated significant negligence in managing my case. This includes, but is not limited to, failure to appropriately process essential paperwork, thereby obstructing my ability to meet court-mandated deadlines. Furthermore, the firm has implemented a telephonic communication system which I allege to be fraudulent, characterized by non-responsive behavior and a lack of follow-through on callbacks. The contact information provided by Watts Guerra LLP, including telephone numbers and email addresses, appears to lead to ineffective channels, effectively rendering them non-operational. This conduct, I believe, constitutes a direct breach of recent court orders mandating the timely submission of claimant information into ******** portal. As a result of these actions, or lack thereof, by Watts Guerra LLP, my ability to comply with the lawsuit's procedural requirements has been severely compromised, due to their failure to fulfill their duties as my appointed legal counsel.Business Response

Watta Guerra law first was picked to do my daughters Tylenol Autism case. I didnt do much research when following through with them helping me file my daughters claim. Now after reading there reviews and seeing how they are really for themselves I called and asked that they send me a letter stating that I dont want them to proceed with filing the claim for my daughter. They are saying that it could be days to weeks before me not wanting to proceed could get approved. All I am asking for is a letter that they will no longer be helping me. I dont feel that it should take longer then a day. All I am asking for is a letter that they are closing out the claim. As quick as they took on the file I want them to close it. Our Mass Tort docket, which includes our Autism case the client is referencing takes a lot of initial screening information (records of purchasing the medication and use during pregnancy that could have occurred years ago). The litigation process is also lengthy, as we warn clients. To help appease the length of the case, we send out monthly newsletters, video updates, and other materials to explain to clients what is going on in their case. What some people do not realize is that lawsuits, especially ones like this, can take years which is not always ideal, but that is how the court system works.
To address the paperwork being returned - just like a lawsuit, the process for closing out one also takes time. The client is more than happy to contact us in the many methods we have provided in our updates in order to receive updates on everything. I will have someone contact the client internally to help clarify and resolve any questions they might have.
