Contract signed Jan 8, 2022. A privacy fence and chicken pen was to be put up. He first asked for$7800.00 in which I wrote a check. They came out and removed all the damaged chain link fencing. Then he didnt show up for weeks. Told me via text he wasnt answering his phone. He asked again for $3800.00 then $1500.00 I gave him the money hoping my fence would be put up so I could finally move in. More weeks go by. He wouldnt answer the phone or any other type of contact. I told him via message that I need the fence completed. I have to move in my house. I need it finished by 3-30-22. He showed up a week before that date. Had 1 young man ******** put up the fence posts.. He left And showed back up 2 hours later. Then left. That is the extent of work he did. No fence, no pen. No contact and no returned calls. Needing to move and unable to due to no fence for my dogs. I left another message stating I found another contractor who can do the work. That day, he came out and took his sign down. This person took thousands of dollars from me and never did the job. I am asking for reimbursement due to Breech of Contract and false representation of his work and work ethics.Business response

******************************* was my customer. I know she is fully aware of what was encountered when we started digging the post holes. At about 6 inches below the surface in all 43 holes dug we hit solid rock. I set all post at 24 inches and in most cases the rock we encounter are individual rocks that can be pried out, but this was not the case and a 90 lb ********************* was needed. Any time a remodel is done, there is the possibility of finding hidden obstacles that can bring a worksite to a halt. I found a hammer large enough to do her job and had it for one day...a day in which an ice storm hit. The tool had to be returned to *********** ********** where it was rented from, and they had it rented for an extended period afterwards. The fact is that we dug 40+ post holes and everyone at 24 inched deep, and it took on the average of 4 hours per hole. On March 10, I told her that I could do as I've done in the past for other customers, put up a temporary fence to allow me to get the job done. She refused my offer. On March 30, she sent me a voice mail that the transcript reads: "I have found someone else I can finish it in like three days and I need it done you know that fast cause I've got to get moved...". The question of did she get $9000+ work done, yes she did and more. 43 post at 4 hours each, and we **** at $154/hr. Her previous fence was falling over because the last person quit digging when they hit the rock and the post were set to shallow. The work that was by my company was done correctly. It is difficult to find some equipment and hold on to it, and I bought a ********************* and the rock was so tough it burnt it up because one large enough was not available. A temporary fence was offered and she refused it. She told me she found someone else, and I honored her decision. I have full documentation of our business relationship. I do understand her frustration, but the times we are in with supply chain issues and a shortage of equipment and man power due to the boom in the construction industry makes some situations difficult, and this is a good example of many different factors that I nor she can control and it requires patience which she did not practice.
