Starting on 5-1-23, i took my car to ******'s ***************************** Shop. We agreed on a Paint job & the price ($3500) that he was supposed to charge me. On 5-4-23, ****** asked me to put half of $3500 that we agreed on which is $1750 but i gave him $1800 to keep it at an even number(i have both receipts). i told ******, "i wasn't ******* him to do my car because i knew i was behind all of the summer cars he had ahead of me. But i do want my car to be started on by August or September. & i didn't start calling him to find out when the actual finish date was going to be starting 10-1-23. That day, he said the car would be finished by the end of the month or by the beginning of November. The dates came & went by without a call about why it's not ready or when the next supposed date may be. i called again, asked, when are u going to be done? He said, he would have the car ready by, 12-1-23. Again the date comes & goes, still no painted car. The next time i talked to ******, i asked, could u have the car ready by 1-12-24? He said, sure. i definitely didn't believe him didn't have no reason to. That date came & went. No car! So then, he tells me on Tues., 1-30-24, that the car will be ready to be picked up, painted on that Friday (2-2-24). On that ******************** doesn't call ******* never has(the whole 9 months my car has been there). Explaining what's the deal with my car, what's the hold up, no sample of paint or anything. On 2-2-24, he doesn't call all day to say, your car will be ready at this time or nothing. It's never nothing. So I called **** **** didn't answer his phone. So i called the office part to ask the secretary. She said, he missed my call because he's painting my car right this moment. i said cool, but i drove up there to see if he was painting. **** wasn't. Hadn't put a drop of paint on the car in 9 months. So i told **** I'm done, drive my car out of the booth because i have been fed lies since 10-1-23. i asked about the $1800, he said something stupid, the police were called, so, that's what led me to this.

    Business Response

    Date: 02/13/2024

In response to the case of ***************************** and his desired settlement of $1,800 back, Adrian's Paint and Body put a lot of work on ******************** vehicle. When he decided to get it out of the shop on February 2nd, 2024, the car already had several labor hours listed below:

    1. Vinyl top removed     3 hours @ $75 per hour                                       $225
    2. Repair rust around all windows      10 hours @ $75 per hour                $750
    3. Repair dents all over the car      10 hours @ $75 per hour                    $750
    4. Mechanic labor: Transmission Diagnosis   1.5 hours @ $90 per h.       $135

A total of at least $1,860 dollars in labor have been invested into this vehicle so the technicians had already been paid for the job they did. **************** is ignoring the fact that every single step of the process counts and every single step of the process have a cost.

Adrian's Paint and Body has never been closed to negotiations but **************** showed up and started to escalate the situation and being aggressive to the point that 9-1-1 (police) had to be called before things got out of hand.

Working with our customers and serving them in the best possible way is in our best interest and for the same reason, certain amount of labor hour were put into his vehicle and the shop needs to charge for it.

Hoping this email gives you a clear point of view of our business, we will be more than glad to provide you with any other piece of information you may require.

    Sincerely,

    Adrian's Paint and Body

    Customer Answer

    Date: 02/14/2024

I am rejecting this response because: the response he's giving now, was NEVER discussed at the beginning. He got $1800 from me because he gave me a total & a receipt totalling $3500 to do the whole paint job! (i still have both receipts he gave me) The initial $3500 total receipt that he gave me. & the $1800 receipt that he gave me for giving him half the money for PAINT. He never said that $1800 had anything to do with nothing that he's talking about in his response. & to let him know that i could afford the job since it wasn't an insurance claim, it was out of pocket. If he would've explained what he's talking about now in his response, in the beginning, i wouldn't have even left my car with him or his business. i also have text messages to prove some of our conversations.
