I rented a studio from banded property management and moved out about 2 months ago and am yet to receive my security deposit back or an explanation on where it might have goneBusiness response

*************** moved out of the unit 27 days ago, we have 30 days in **** to collect information to accurately provide a deposit disposition and any refund owed. That disposition is scheduled to be mailed out tomorrow to ***************. Additionally, the refundable deposit she paid is only $500, not the $600 she is claiming.Initial Complaint

SCAM! SCAM! SCAM! These people just farm applications to collect the non refundable application fee. They rushed me into applying and then once I paid the fee said that I didn't meet the criteria, refused to give me an explanation, refused to show proof they even ran a credit or background check. I never got a notification or receipt for any background or credit check's to be run. Then they tell me they do not have to show me anything and stop responding.. Mind you this is after my mother in law had the exact same issue with this company about 4 months before.. Should have just listened to her when she said they just post listing and collect hundreds of applications with ever even checking credit or background. Didn't believe it until now. A waste of money and the reason why everyone says dont go thru BANDED PROPERTIES. THIS COMPANY IS A COMPLETE SCAM!!! BUYER BEWARE!!!Business response

There are requirements that applicant's need to meet in order to be approved to rent one of our units, their credit score needs to be over 600, we do not approve applicants with felonies or misdemeanor's where people or property are damaged, we verify that they have good rental history as well as ensuring their monthly income is at least 3 times the rental amount. *********** did not meet one or more of these qualifications during the processing of their application. We lose far more money collecting application fees on a unit than we would just renting the unit out to a qualified applicant. We do not deny qualified applicants and are always eager to fill our vacant units.Initial Complaint

This company like many other property management companies in this space is a scam to collect application fees as revenue. We applied for a place with them because we had to be out due to a water issue at our old place. We contacted this place, and applied. During this time the manager said we had until Thursday, and then moved the goal past to Tuesday afternoon to meet the requirements. Which was very unprofessional. They have over 100 contacts but they just want your "application fees." It's why they have a huge amount of listings and no close. They provided with no copy or request of the background check or credit check. There was no inquiry on either applicants credit. They have zero proof to show they ran these checks, and paid for the services. Many use the same 3rd party company to obtain a "rental score" so they can deny anyone without proof of any real background check. STAY AWAY from BANDED PROPERTIES! We will notify Gephardt to look into them, and other companies. So that they can be held accountable for charging non refundable fees & not even running the checks that they are for. What they are doing is against the law, and class action lawsuit will be considered.Business response

Mr. ******* applied for one of our vacant units mid October 2022 along with 3 other individuals who would be living there with him. We use Transunion to process credit and background checks, and our system requires that all applicants approve the background and credit check being run and allow it to be provided to us. Once we started processing the application, our leasing agent submitted all 4 background checks, which triggered an email being sent directly from Transunion to each of them at the email address they entered on their application. Mr ******* and his roommates approved the background via email within the next 48 hours, during which time our leasing agent was working on verifying their income and rental history. The application fees paid cover the background and credit checks as well as the time we spend working on processing the rest of the application. No refund is warranted as we did process all 4 background and credit checks and our leasing agent spent time processing the applications.
Additionally, all 4 of these people applied for another one of our rentals in March of 2022. At that time there was a list of people applying for the house, and Mr. ******* and his group were further down the list of interested parties. We only ever process one application (or group of applicants who will live together) at a time, and we process them in the order we received them. A group that was in line in front of Mr ******* and his roommates was approved and moved into that property. Based on that, we cancelled Mr. *******' group of applications and never did charge any of them the application fee. We do not charge application fees to any interested party until we are actually ready to process the applications, and we lose far more money on vacant units than we make on the applications that come in and are not approved based on our guidelines.

I am rejecting this response because: This company stated I said we authorized the checks, and then said I said we didn't authorize them. They failed to evaluate the clear distinction, or just misinterpreted/misrepresented my point. The part I denied was the fact that we received correspondence directly from transunion. This is false, we only received correspondence from bandedproperties as shown in the attached document. They claimed that transunion notified us, now they are saying they were the only ones who received it as they are the requesting party. All I asked is that they show that they ran those checks legitimately, as their was no correspondence or credit inquiries. They claim they don't profit from these application fees yet they pay a $15 screening fee for a $45/ per applicant non-refundable fee. Profiting $30. Yes, they can charge for their time to process these apps. However, they are charging double what is required to do a screening that only they can see per applicant. This property like many properties they display was taken off UtahRealEstate listing as of 08/09/2022. And on their site the property is listed as available as of 08/31/2022. It's 11/04/2022 and they still have the property listed despite having so many in-line to rent as they claim. They profit $30 on YOUR application fees per applicant after a small screening fee. They don't hold rental criteria and the manager has to have the final review which allows the leasing agent to attempt to justify the fee for their time gathering income and employment, when they already could have a decision based on background/credit results alone. They stated they pulled our background on 10/15/2022. And made a point that they didn't want to deny the inevitable. However, this couldn't be more irrelevant. Because they told us that we had until Thursday, and then changed our time to Wednesday afternoon to complete 'additional' requirements BEFORE they reviewed it on Wednesday. So this speaks to the unprofessionalism of this company, and their point doesn't have any validity. Of course, on Wednesday was the final manager review. So to their point, say we did get approved their wouldn't be anything other then lease initiation after that. So after Wednesday it doesn't make any sense about their point of "they didn't want to deny the inevitable". My point which they failed to defend because it was legitimately unprofessional. Is that this company had our results on 10/15/2022 as THEY shown. They continued for almost a week having us gather income info/ employment info additionally, wasting our time. And in addition told us that we would be given until Thursday to complete additional requirements, only to move the goal post last minute to wedneday afternoon (to which i got the message, early Wednesday morning). All BEFORE they reviewed, again like they stated on Wednesday. So that's why their point about not wanting to deny us any longer fails to hold because this was before Wednesday. I have attached when you get the correct correspondence from the screening company that allows you to request the background check/ dispute any inconsistencies. I have shown that this company has the means to profit from application fees, displayed evidence of the unprofessionalism of this company, and their unethical business practices. And shown that the correspondence we received was from bandedproperites and they fabricated us having correspondence from Transunion. As I clearly stated was not in reference to them authorizing us to have the checks ran. There isn't anything further to discuss, whoever finds this can make their own informed decisions but I would urge the general public to do their research. And I wouldn't recommend bandedproperties to any one looking for professional property management.

We provided in our last correspondence proof that we did in fact process a background check for Mr. ******* and his co applicants, in response to his assertion that we are collecting application fees without spending any time or money on those applications. We also provided proof that when they applied for one of our units previously, we did not charge the application fees because the unit was rented to someone else before Mr. ******* and his co applicants came up in line to be processed following the law in Utah. Both of these items show evidence that we are not using application fees as a means to collect income instead of renting out vacant units. Mr. ******* supports in his last message that we spend time working on applications, as he stated we worked on collecting information from the 4 applicants for nearly a week when we found information that does not meet our requirements to rent a unit from us. The application fee of $40 does help to offset the cost of the credit/background checks as well as time spent processing the rental history and income verification and communicating with all applicants. Unlike Mr. *******' assertion, we have not received 100+ applications on this property, and nowhere in our communication with him was that claimed. I would recommend that Mr. ******* contact Transunion directly to ask why their inquiry does not show on his credit report at this time, as we did process through them and receive background/credit checks from them on 10/15/2022. Mr. ******* and his roommates did not qualify to rent our unit, which is why they were not moved in. To clarify, when the information came to light that made their application unacceptable, we notified them that day, instead of dragging it out and waiting for the other items that had been requested, as the result would have been the same.
