Me and my partner were look *** to book a office in ***************. They took the money. And then said the office was not available. Tried to book another and got no response. This happened two weeks ago. Has to call the bank to get a stop payment dispute because they don't answer now.Business response

Hello. I am sorry if there is any confusion here, but when the pending reservation request was denied, there was no charge placed on your card. There is an initial pre-authorization charge pending at time of request, but when denied it is automatically voided. No charge from Davinci Meeting Rooms should have settled on your card. If you find otherwise, please reach out to me directly and we can review, however, I did also double check with our accounting and they also show no charge to refund. I hope this helps. DaVinci is a complete Bait and switch organization and not transparent about their services and fee schedule. Less than stellar and while I would like an office set up, the bait and switch they play is unacceptable.Business response

We are very sorry for any misunderstandings here around a $15 fee. Rates can change at any time. This is not decided by Davinci, but rather our partner locations. In this situation, there was a fee of $15 to get mail forwarded out, which the client was previously used to receiving for free. During these challenging times, it is hard to expect our partners to continue to deliver services for free, which we hope our clients can understand. davincivirtual seems great but then we signed up 3 years ago and a few months into it we weren't able to cancel. we've tried for years now. even tried blocking the payments from the bank, and WE NEVER GAVE THEM OUR NEW CREDIT CARD NUMBER. but somehow they have the updated expiry date on their system.HOW???????????????? did they guess? this is fraud.Business response

To Whom It May ****************** are very sorry for any confusion regarding your account. We have not received any prior requests to cancel until this past Monday. I can see that your account was scheduled for termination shortly after we received your notice, per your request. I can assure you we processed your request as quickly as possible, but again, no prior requests were received. Also, in regards to your credit card information, "Sem Ponnambalam" updated the card information online on 3/16/22. I would assume that since the card was updated, there was no previous intention of cancellation. Also, the services have been provided this entire contract term, so we are unable to process a refund. The company keeps billing me and sending late fees when all I want to do is cancel my service. Then they want to talk to me first when I do not have time to talk to anyone. They will not accept a simple email to cancel my service. They are a fraud.Business response

We are happy to waive our 30 day notice policy and cancel this client's account immediately, including waiving the current declined amount that is past due. I am very sorry to hear of your concerns. However, looking at your account, the rate increase is not 50%-100% increased. You currently pay $95/mo and the rate increase was for $15/mo, bringing your new monthly total to $110, which is about a 15% increase. Also, according to our terms of service, we are allowed to increase rates with 30 day notice, which was provided. I am rejecting this response because: According to your terms of service the contract is 6 month term, then it's auto renewed month to month as per your website tos.Your agents misrepresented the facts claiming that the location raised their rates, so you have to raise the rates 15%, when in fact this location costs substantially less than what you have quoted. The market rate more than 50% less than your stated $95 per month.
Your company Davinci virtual Office misrepresents facts, has a habit of misrepresentation and your services are not as described or defective services. This is a pattern of behavior that is clear if you examine all the recent complaints and reviews on the BBB website.

Again, I apologize for any confusion, but according to our terms of service, we allowed to change our rates as needed as long as 30 day notice has been provided to the client. Also, the website may reflect promotional pricing for new customers. Please see section 4 of our terms of service (outlined below but also found in this link): https://www.davincivirtual.com/terms-and-conditions
4. MODIFICATION OF USER RATES. Retail rates for services published on Davinci or Davinci related websites may reflect promotional only pricing limited for a certain amount of time or available only to first time customers. The Company reserves the right, in its sole discretion, to change User pricing upon thirty (30) days' notice.

I am rejecting this response because: according to your referenced terms section 2 attach below,the original contract term has not expired. Therefore you broke your own tos, meaning that you misrepresented your service. You are at fault.2. TERM; AUTOMATIC EXTENSION; TERMINATION or SERVICE DOWNGRADE. For Davinci *************s Services, the Initial Term is one month. *************s services Product Downgrades or Terminations do require a 30 day written notice as specified below. For Davinci Virtual ********s, Davinci Virtual Offices, Davinci Virtual Meeting Room packages and Davinci Virtual ******** services, the Initial Term of this Agreement is six months, in each case commencing on the date stated on Client's Contract or, if contracted online, the date the Clients order is processed online or Clients order is processed over the telephone. Unless properly terminated or downgraded, this Agreement will be automatically renewed and extended for successive periods equal to one month (each, a "Renewal Term") until terminated, as provided herein, by either Client or Davinci. If Client chooses to switch Virtual Office ******** related services during any term of agreement, agreement term shall start again for a 6 months term at time of switch. Client may terminate or downgrade Services upon expiration of the Initial Term or any Renewal Term by giving written notice of termination / downgrade 30 days prior to the end of the existing Term for ************* Services and 30 days prior to the end of the existing term for Virtual Office ******** Services. For *************s Services, once a written notice of termination / downgrade has been received, *************s Services will terminate / downgrade on the last day of Client's following complete recurring billing cycle. No prorated refunds shall apply and Client is still liable for any and all overage charges if applicable during final term of agreement. Client's written notice to terminate the Agreement must be in writing, and must be sent by either (a) email addressed to ***************************************** or (b) by certified mail, return receipt requested, sent to Davinci Virtual, LLC, attn.: Contract Terminations, **********************************************************. Davinci's written notice to terminate the Agreement shall be sent by either (a) email to Client's email address on record with Davinci, or (b) by first class mail to Client's last known address on record with Davinci. Upon termination of the Agreement for whatever reason, it is the Client's responsibility to notify all parties of Client's change of address and/or communications services. Subsequent mail sent to the virtual office location will be returned to sender if applicable and all virtual mail box and communications services will terminate at that point.

I am rejecting this response because: Your companies unfair and deceptive business practices violated your tos. It's clear from the recent reviews on this BBB site that Davinci new business model is misrepentation of services. Can you explain why you say that the price of my contract was promotional prices and you need to increase prices because of market conditions when the market rate for the exact same location is substantial less than the rate your currently billing me, while offering less services?
