      My husband (***********************) and I applied to rent an apartment at the *********** Apartment Complex, managed by Van Metre on September 15, 2023. On September 16, 2023 we notified the property in writing of our intent to revoke our application and rent elsewhere as they hadnt given us an appropriate or timely response. We paid $100 in non-refundable application fees in addition to a $500 refundable reservation fee to hold the unit while our application was processed. According to Virginia Code , Title 55.1 Property and Conveyance, Article 1, Subtitle 3: Rental Conveyances, Chapter 12: Virginia Residential Landlord & Tenant Act, Article 1: General Provisions, Section 55.1-1203 re: Application; Deposit, Fees and Additional Information - they are required by law to return our deposit within 20 days and they have failed to do so, despite repeated communication. They refuse to answer phone calls and only respond to email messages infrequently, if at all. They also require prospective tenants to sign paperwork that forces them to forfeit their deposit illegally by establishing a timeline that draws out the application process. Therein, they strategically refuse to give answers to applications until after the established timeline has passed so whether the application is accepted or not- they keep people’s money. Despite following all protocols and being told that our money was sent out not once- but twice (without proof for either instance) we have not received our deposit back. And it has now been 27 days - which is 7 days over the allowable time period specified by the code of Virginia. This behavior is both illegal, predatory and completely unacceptable.

      Van Metre Companies owes me $187.82 (plus interest). There are two attached documents: the first is a screenshot of an email chain in which a Van Metre Companies representative confirmed I am to be owed a credit of $187.82 as of the termination of my lease agreement and returned reimbursement form. This email confirmation is time stamped at Aug 3, 2022 at 1:12 PM. The second attachment is my returned & completed reimbursement form which was delivered to multiple Van Metre Companies representatives via email (dated Oct 29, 2022 at 4:18 PM). It has been over 9 months since the reimbursement form was delivered to Van Metre Companies. I've since sent multiple inquiries to multiple Van Metre Companies employees and I have still not been sent this money via check as promised in the terms of my lease agreement and by the Van Metre Reimbursement Agreement. In accordance with Chapter 3 of District of Columbia Housing Regulations, I demand interest for this debt at standard rate of 10% (monthly compounding), bringing the total amount owed to me as of August 8, 2023 to $202.84. I also hereby notify Van Metre Companies that interest will continue accruing on this debt each day until I am sent this payment plus the correctly calculated interest via check to the address listed in the reimbursement form.

      On September 1, I received a voicemail from a Vanmetre representative regarding my complaint. The representative instructed me to call him back. I called the number provided in the voicemail today (Sep 6th). A different Vanmetre representative answered my call and took down my information. I told them that I'd like VanMetre please email me at ******************** with information about their resolution.
