I purchased a car on August 7, 2022 exactly 5 months ago from Smoots Auto Center. I’ve had it in and out of the shop ever since I got it. The second day I had it I called smoots about a sputtering and black smoke coming out of the car and they had me take it to their car mechanic and they claimed to have fixed a hose that causes that. Picked it up from the car mechanic and it was continuing to do the same thing. I called and made another appointment with the mechanic but the car lot said the mechanic will have to charge me for any work done because my warranty was done so I cancelled the appointment because why should I have to pay for the car when I didn’t have it more than 2 weeks. I then proceeded to have the engine light come on and it said I needed new spark plugs so my husband and I got all 4 brand new spark plugs. Car continued to have things breaking on it. Took it to a new car mechanic two different times and this last time I took it which was on Wednesday January 11, 2023 my car was still doing the sputtering and blowing out black smoke and my car no longer has heat. They said everything was breaking due to there being an oil valve leak which caused the engine to not get oil into which made the cylinder 3 go out. Which means we need a whole entire new engine. The mechanic said the damage to the engine had been there before we got the car and that the lot sold us the car knowing what was wrong with it and was just trying to cover it up for a quick sale. We called the car lot yesterday and respectfully asked if there was a way they could help us out with a new engine considering we’ve only had the vehicle 5 months they transferred us to their car mechanic shop and they quotes us a $2,600. How is that helping us out? We should not have to be putting in a brand new engine that was messed up when we bought it. I’m extremely disappointed and had no idea I bought a car from a bunch of crooks and I’m still making payments on it. Looking into the lemon law as well.Business Response

I've tried setting but they continue to ignore my administrative process!! I enter into this contract March 7th 2022, and its been a headache!! Attached you’ll find documents I’ve sent to ******************* (the owner) via certified mail. Also is a list of violations/fraud committed against i the consumer by Smoots Auto Center .. what I demand as my remedy is- You have 14 days to refund the down payment provided to your company on (MARCH 7th 2022) in the amount of ($2,500.00); return all previous payments made to you; provide me of my original instrument or compensate me for the amount of ($12,595.00) provided to you on my behalf listed under the amount financed; issue me my title for the vehicle; and update the consumer reporting agencies that the account is paid in full. Without an affidavit response with a rebuttal, point for point, then I am conditionally accepting your non-reasonable response, as frivolous, and I will file fault judgement in the favor of the interest of I the consumer, attorney, and administrator in fact. So that you are aware an unrebutted affidavit stands as truth in commerce!I asked them for verification, and they didnt 1.Please verify and identify whom the original creditor is by name and address and produce documentation. 2. Please verify the amount of the alleged debt with correct characters and produce documentation. 3. Please send a certified copy of the original application holding the original wet ink signature and produce documentation. 4. Please send a certified copy of the original contract holding the original wet ink signature and produce documentation. 5. Please verify and identify whom the original borrower is by name and address and produce documentation, including but not limited to the original loan check, front and back. 6.I demand all responses be made by mail only, notice do not respond by telephone, I notice and demand all communication be conducted by certified mail only, thank you, so be it;Business Response

To Whom it May Concern,
We have complied with every request that has been sent to us by *** **********. We have sent out all the document's that has been asked by him. It's unclear what his demand's are except a new car and for us to pay him for this. vehicle. We have tried multiple time's to contact him by phone and he refuses to comply with that. Recently, he's demanding no phone contact. We are always willing to help our customer's out with any issue's they have but he has never once asked or informed us of issue's. Our vehicle's are sold as is and he did sign. that form as well. We have sent him every document to show him what his amount's are. We would be willing to help him if he could get his account current, he has stopped paying and since then started the complaint's. He is requesting all orginial documents with wet ink signature be sent to him but legally we have to keep the wet ink document's so we have sent him copies of them all.

yes so i bought a car from smoots auto in july only had the car for 3 weeks and it over heated now i took it to there shop and they saying its going to be 3 thousand to fix the car they new the car was bad from the get go so now there trying to say it was my fault that it did that there not tryign to give me my money back or another vehicale at all i want my money back or anorther vehicale
