  The date was October 12, 2021. My driveway needed to be sealed again. I was given Mr. Rowsey's name. I call him right then. I told him what I needed and he said that he would not be doing any more sealing because it was getting too cool. He said he he had finished all of his other jobs but he was close by and would come and look at the driveway. He looked at it and said he had enough sealant left to do the job if I wanted it done that day. I asked him much he would charge me to do the job and he said $650. I agreed to the price but I did ask him , since he was using up the last of the sealant he had, was it still the quality as it should be. He told me that it should last a long time. So he proceeded to do the job. When he finished, it looked okay to me. So I paid him that day with my check # **** in the amount of $650. I again asked him if it would hold up and he said yes. He told me if I had any problem he would make whatever repair that needed to be made or if necessary he would seal the whole drive again. I trusted him because he came across as being a very nice person. By the first of 2022 I noticed that the drive seemed to be crumbling. I did not call Mr.Rowsey because I knew he could not do anything until the weather warmed. I called him the first time at the beginning of April. I told him I knew that it had to warm up but I wanted to get in line. He said he would come by. He never did. I have sent him texts and many phone calls. He only answered two of them. Both times he was working close to me an told me he would come by and take care of the problem while he was in the area. Well, he never did. I have still been trying to contact but he will not answer the phone. nor the texts. I am enclosing pictures. You can plainly see that the drive is crumbling. You can see all of the loose gravel that is coming out on the drive. It is like this all over. I need to get this case done as soon as possible because it will soon be too cool. I want something done.

  Scratches on a sealed driveway are normal wear and tear.  The damage was done by someone scrapping snow off your driveway.  I only do sealing so anything wrong with your driveway is not my fault.

Mr. Rowsey said that all sealants scratch. This is much more than a scratch. If he is not gong to fix it like he promised he would do I want a refund of my $650 which I paid him in good faith.   I have been out and looked at the driveway and it is normal wear and tear from snow being scraped off the driveway and she is wanting her entire driveway resealed. I do not warranty normal wear and tear or damage done from the scraping of snow.
