I have a contract with this company to make our master bathroom shower a roll in for my wife. She has stage four cancer and is not mobile so she is in a wheelchair. The only full bathroom is upstairs on the second floor and since she is not mobile she is unable to shower since (October 11th). The contractor is demanding i pay the contract in full before he will complete the work. The bathroom is not even half way finished and it is causing a hardship for my wife. I have already paid him approximately 70% of the contract ($11,200) and it clearly states that the last payment will be made after the project is 100% completed. I have a text message from the contractor that the project will be completed by today (November 10th) but i have not seen any workers since October 25th. I need the bathroom completed as promised or a refund of the project so I can hire someone else to complete the work.Business Response

Dear *** It was Lovley to talk to you , basically we had this entire install of tile set up via my tiler ( who is a union tile installer ) who works in Virginia and other states , in any event the customer ( who is a retired ******* ) started to dictate to my tiler how to do his job , all this happened when I was in Ireland attending to a family matter , The customer changed his mind three times on the tiles for the floor after I left for ******* , He went from Tile at the beginning to VCT to porcelain to Marble tiles , we returned the VCT tile to ****** , he claimed he had something else picked out at **** ***** , So with my Supervisor ******* and **** my tiler not knowing what was going on , we had no choice but to postpone the tile install , until I came back from *******. I have now left him a voicemail and email last week with no reply , ???? His actions to date make me and my work partners very leery of this man so my suggestion is he pays my tiler the day he finishes his tile work , then the last two thousand after his project is done 3 days after the tiler is complete, very simple process , We are here to help people not take advantage of them , I gave him references of my past people we worked for and he called them all , he even went to one of there homes in ***** to look at the workmanship , no but the ******* Mr ***** is telling a union tiler how to do his job , We are here to finish his job , absolutely ready to go back and finish his project for his but we need full transparency and his cooperation and we will have him a shower asap , Thank you for your time We want to help him get a shower , he must step aside and let ******* and **** do there respective jobs , his glass partition that’s sits on the granite half wall is in at the glass company , his towel bars are in , we have everything but he has to pick a new floor tile ? ***,I was very hopeful that we had reached a resolution on my case but after Brendan agreed in writing on Thursday to supply the items, I received an email from Brendan today stating he was not going to do so. I am attaching the original email he received and all the email’s responses. I am very disappointed that he is going back on his word and hope that your assistance will get a resolution. Dear *** Please read below , I spoke with ****** ******* yesterday regards **** ****** project. As you know by now, I am an unrestricted Licensed Builder in Massachusetts. Having successfully built multi-million-dollar buildings in the past years. I work in Conjunction with homeowners along with building inspectors in ********* , ******* and many surrounding counties when it is necessary to pull permits. I built a huge addition last year in ******* , just to name one. ****** ******** is the head building inspector of ******** ****** , The boss man. ****** agrees with me the work I performed for Mr ****** I do not need a permit. I explained the unfortunate circumstance of what is going on. Mr ***** was trying to intimidate me putting my Builders license on his email top front and Center as if I am working illegally , message last Saturday, No Reply !!!! from **** . This Project could have been completed while I was in Ireland if the home owner stood back and let a professional union tiler do his job. I could have been done over thanksgiving ; **** offered up his weekend to make this work for **** and get the shower finished, two times now. Basically, the list he sent to me , I sent to Home Depot and to **** my Tile Setter. It is not practical or real what is on that list. I will have nothing to do with paying for something that has nothing to do with anythingI am here to tell you I do not participate in Illegal workmanship. ******* is a Master Eletrican , All my Subs carry license where necessary. I have worked all my life with Honesty and Integrity. We are now after trying to call him including **** my Tile setter also left him a long that was previously discussed by the homeowner and I. I can furnish you the contract details , There is nothing on their close to his list . We are giving him a shower with ¾ inch lip or maybe no lip at all **** is saying recess the concrete floor but no Todd keeps seeking outside advice and continues to tell us what to do. He went and looked at my projects ***** **********, called all my customers including ******* ***** whom I pulled a permit for a built a huge two-story deck for. I am not supplying any list to him from **** ***** that has absolutely nothing to do with the project description stated on the contract. There is 5,000 dollars left in the project, more than enough money to finish everything up. I also will furnish him the, Matt Black Towle Bars 300, I will furnish him the Glass Partition at ********** ***** 550, I will furnish him the tiles for the bathroom floor 450, ( 4 times he has changed his mind on flooring since we started the project) this is the reason for all the Confusion otherwise we would be finished by now, I just spoke to ******* ( owner) at ******** *****, She gave him his Granite ledge and said he was a very intense man asking her advice how to install the tiles correctly ?, same as he did to the **** **** tile guys, **** suggested to **** to have a rainfall piece of granite coming down the front of the shower wall ( looks better )and guess what **** ordered that without even asking me if this was ok , Anyhow I will pay ******** ***** as I will pay ********** ***** and I will supply the Grab bars, and I will supply the tiles for the floor and I will supply him some money for Grout and thin set and paint. This is more than my part of the job / work done and he has 5 thousand dollars left to pay another tiler. I have a Brazilian Tiler; I can give him his number . I will still try to help him get his shower done. The sad part is **** will not stand aside , and his wife who is sick is the one suffering and without a shower. I told him from the get go this will take time do it correct but he tells everybody it to long yes, it is **** you did this, Ask all my People, my vendors they are many we are not all wrong in our judgement of what is going on here , Again **** was willing to give up his thanksgiving weekend. If I supply all the above to ****, he will need to sign off a release form supplied by my attorney and he will have everything on the list above and in Conjunction with the Contract written, Thank you, *** , I have Tried my best , Regards Brendan O Neill
