      I received a late notice and an associated late fee from ACS West, *** (dba Ironbridge **************************** (IBPOA)) for a bill for their annual assessment that was never received by me. I contacted the company's representative, *************************************, to ask for a waiver for the late fee. He informed me that the account would have to be brought current to be eligible for a waived late fee. I scheduled the payment on or about 4/5/2024 as it was set up in my online banking, which has no electronic option for IBPOA but this is my normal method of paying this bill. However, after a sufficient time, ****************** informed me that the check had not been received or processed by *****. On 4/30/2024, I decided to pay with an online option the original $120, which was successful. At the same time, I placed a stop-payment on the paper check to avoid over-paying and having to ask for a refund. According to the bill received after those transactions, IBPOA received my electronic payment on 4/30/24. Because the paper check generated on 4/5/24 had not been processed by IBPOA, I stopped payment on 4/30. On 5/6, ***** then received my paper check and attempted to cash it on 5/8 even though they had already been paid the same amount on 4/30. They were charged a return and bank fee for the stop payment and are trying to pass that on to me. From a legal standpoint, this is known as "double presentment" or "double depositing." On top of that, they are attempting to collect the ensuing bank fees from me, which is known as "unjust enrichment." I have explained this to ****************** in an email, but his assertion is that he did not advise me to stop payment, therefore the charges are passed on to me. However, it only seemed right and prudent to stop payment when the electronic payment had superseded the check and I wanted to settle the account as quickly as possible so ****************** could get the board of IBPOA to approve a late fee waiver.

      I would like to respond, and we certainly can work regarding removing or reducing fees as a result of what happened, however false allegations are being presented.

      I have reviewed the offer made by the business in reference to complaint ID ********, and find that this resolution would be satisfactory to me if they agree to remove the return payment and bank fee charges. I will wait for the business to perform this action and, if it does, will consider this complaint resolved. Also, the business in reference to this complaint accuses me of presenting false allegations; I would like to know what allegations they believe are false.  Every statement I made is backed up either in the email chain or on the document sent to me by the business.  In other words, if they are claiming false allegations, they should be specific and name them as I was required to do when making the complaint.  The logical error committed in this case is known as the Burden of Proof Fallacy. This fallacy occurs when the person making a claim is not providing sufficient evidence to support it. In this case, if someone says that a person has made a false allegation but does not provide any details or evidence to back up this claim, they are committing this fallacy. Its important to remember that the burden of proof lies with the person who is making the claim. They must provide the necessary evidence, as I did when I filed the complaint, or reasoning to support their statement.       ACS WEST OVERCHARGED ME FOR ***************. NOT THE FIRST TIME I HAD ISSUES WITH THIS MANAGEMENT COMPANY. I WAS TOLD ON JAN 4, **** THAT CHECK WOULD BE MAILED OUT FOLLOWING WEDNESDAY. I CALLED TODAY NO CHECK YET. I WANT MY MONEY. I KNEW IT WOULD BUT ISSUES BECAUSE ************************* IS NOT A FAIR OR DECENT PERSON. I KNEW I WOULD BE COME TO THIS.       I have been trying to get explanation of a bill that was sent to an attorney. I have been paying my *************** each month and I am now being told that my balance started with $300 and the *************** are $150 a month and the account was started in June of 2023. I have reached out to get an explanation and no response. I have also requested a number of times to be put in touch with the ***** of ********* for over 6 months and it still hasnt happened.

      ACS West continues to put violations against my home that are untrue. More recently, they are sending me a letter that is stating that I have failed to address previously reported concerns with a house pictured that is not mine. This is not the first time that ACS West has made claims that I have proven to be incorrect. In addition, it appears that ACS is targeting specific homes as there is proof of homes in the neighborhood that have violated the *** conditions (shady banks homes power washing).

      I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      No, that photo is not my home I actually believe it is **** which is a few homes down from me. Also, the letter gives previous dates stating that the issues had not been addressed when they have been. The letter is misleading not only with it not being my home but also stating that the homeowner did not comply.

      I feel like I am being targeted by ACS west by means of discrimination. There have been multiple fake violations that myself and other community members have noticed but this most recent one is the worse. They say that have complaints that are within violation but from speaking with other neighbors, it seems the African American ones are the ones being targeted the most.

      We purchased a lot at ******************* and after closing on the lot, we were told we would be contacted by the *********************** to inform us about the *** and what will be expected of us as future tenants. We waited for a while and didn't receive any communication from them despite the fact that we had contacted them by email earlier. Much to our surprise, we got a letter from an Attorney that we have been sent over for collections from ACS. We contacted the Attorney to inform them that we have not received anything from the *** including a welcome letter, an account number or anything so why would they not welcome us first before sending us to collections. All efforts to communicate with ACS and the Attorneys has failed. At the moment all we know is we have been sent to collections without first sending us a bill. An account information and what to expect. After contacting ACS in the mid December 2022, they added our email to the *** association. However, we don't have an account number to pay the bill to or anything. We went there in person and they refused to speak to us because they said they took the case to collections and they cannot comment on it. According to ACS, they sent a letter to a lot or forest, which is clearly not habitable. They refused to send the letter to the current address which was listed on the closing document.

      1. You owe me back HOA dues in the amount of $***.** You have refused to answer my emails in regards to you asking me how I would like to proceed with said refunds meaning given me the choice of how I receive said HOA dues refund from overpayment. I have requested you send me a check in the mail of the full HOA dues overpayments in total with interest. 2. Unit G, there patio leaks water down on my patio the does not allow me the enjoyment of my property. I am requesting strongly that my property be restored to what it was intended too be used for meaning stop there deck from leaking water down on me and my personal property. 3. Allowing too many renters come in that is violation of of HOA rules. Unit G owner has had 4 or more renters come in and leave within less then 2-4 months that has caused damage to my property (ceiling) due to a dog urinating on floor that has seeped down too my ceiling. 2nd the renters do not report problems to owner because they could be liable for damages. 3rd there HVAC system is leaking water that has caused damage on another part of ceiling and wall this time for the 2nd time. These renter's have no respect for the property nor rules of the HOA and committee. No one enforces these rules yet we pay dues. They still walk there dogs behind buildings and dont clean up after them and some will walk there dog so close about 1' to 2' ft from my patio that they look through my patio door. This in itself is a violation of rules. Rules say dogs should be walked in front of building on top of hill and need to pick up after there dog. If you're going too make rules and regulations enforce them do not just send out letters. People smoking marijuana in there units that's causing a very strong smell lingering for hours. They smoke it on patios also. This is not good for my breathing as goes for some others. My grandkids come over and it could affect them. This needs to be stopped. This is stronger then tobacco smell.

      I see where you are showing images of emailing me, however I do not see where I received your emails. I do check my spam box on a regular basis. We will process the refund and respond regarding your other items.

      There are no rental restrictions at Palmer Place. Also, the outside decks are not roofs. Rain will flow through them.
