Retirement Unlimited RUI" at Bay Lake, Virginia Beach, VA has taken $3,382.50 of mine and provided no services or goods for it. They said it is a non-refundable community fee and had me sign a document which was not given to me nor explained to me during a time of duress when I needed to place my mother in a nursing home. Please help me get this large sum of money that they refuse to give me back.Business response

Ms. **** executed a deposit agreement with the community to secure an apartment. Because the community invests significant time and resources to prepare the community for new move-ins, this agreement explicit states the deposit provided is nonrefundable. The nonrefundable nature of the payment was discussed with Ms. **** prior to her execution of the agreement. The deposit agreement is executed by all potential residents who request the community hold an apartment for an immediate admission. We make business decisions based such as staffing coverage, maintenance of the space, and hold the room from any other potential purchasers when potential residents agree and provide a deposit. I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. [The Director at Bay Lake, *** ********, is refusing to refund $3,382.50 of mine that has been taken from me under duress. He has informed me that he has the ability to issue this refund back to me, but simply refuses. This is a large sum of money being kept by him for no goods or services by Bay Lake.Nothing was explained to me when I provided my credit card that I would not get this money back if my mother couldn't go in Bay Lake. He says it was on the form I signed, but the only documentation I was given at the time of my appointment at Bay Lake, were glossy marketing-type brochures. It was a very stressful, coerced situation when I was at Baylake and felt quite pressured to move fast, even though my mother couldn't be moved in. Please help. I desperately need my $3, 382.50 returned from Mr. ********, BayLake, and/or the mega- coporation that took my money.Thank you. ***** **** ] Regards, ***** ****Business response

Retirement home at Woodland Hills ***** ***** ***** ******* *** ***** deducted $3,290 from our account in March in error. We were charged for nursing and personal care for an entire month of March, but Dad (******* *****) died early morning on March 1st. They put in writing that we were due a $3,290.00 credit but have refused to actually credit the money. They do not answer phone calls and will not respond to e-mail **** *****Business response

A team member communicated with the customer to better understand the basis of the complaint. Upon determination that a refund was appropriate, the matter was submitted for processing and a check was issued to the customer. Please see attached check.
