      Was going through the car wash and the machine snapped my side view mirror. I parked my car afterwards and filled out an incident report. The owner emailed me telling me he is not liable due to the age of my car, which is a 2013 *** in great condition, and that it did it on its own. I have never heard such a thing and my car has been washed many times. What I know is I had a side view mirror going in and it dangling from my car coming out.

After coming out of the car wash Mr. ****** filed an incident report stating damage to his drive side mirror. Our posted disclaimer stats that we are responsible for damage caused by equipment malfunction, damaged caused by any other reason is the responsibility of the vehicle owner who accepts lability upon entering the car wash. It also states on our disclaimer that we recommend mirrors be folded in. when the incident report was filed out staff inspected the equipment and did not find any malfunctioning equipment. I myself inspected the equipment the next morning as well and found all equipment operating correctly. Another part of the inspection is also looking at other cars from that day before and after Mr. ****** went through the car wash. No other mirrors show any damage, this was also observed closely for the entire day of May 19th no other damage to mirrors where observed or reported. This supports that no equipment was malfunctioning as well as not repair parts where ordered or repairs conducted. When reviewing the pictures and video, again I noticed no equipment was malfunctioning and it was noticed that Mr. ******'s car has major sun damage. Mr. ******'s car paint is peeling off as well as the plastic to the mirror is faded from black to white. An indication that the car has spent a lot of time in the sun. The sun will cause plastics to deteriorate over time and become more brittle. Mr. ****** also submitted on his claim his car is a 2003 which makes his car about 19 years old, plastic again will deteriorate over the course of 19 years. Because of the age of the car (19 years) and the major sun damage as well as no other damaged mirrors prior or after Mr. ******'s visit. It is apparent that the damaged mirror was due to the condition of the mirror and not because Grand Slam Car Washes equipment malfunctioned. Attached is a picture of our disclaimer that is posted before you enter the car wash as well as the mirror in question that you can see the sun damage. I have just come back to Virginia from California as I was stationed there. My 2003 vehicle drove me across the country. Sun damage happens to the exterior of cars, we see it all the time on hoods, bumpers, and different parts on the cars. However, on my car, my side view mirror has no sun damage nor deteriorating plastic. To add, sun damage on paint does not affect how the vehicle functions. Paint simply chips off or fades. To come to the conclusion you have based on camera footage where it is impossible to see any plastic from where the mirror was hanging to where it broke is not the truth. I called my mom on ******** right after I parked because I did not know what to do and someone came out with an incident paper, I filled it out and left. She was on ******** with me the whole interaction. I've included pictures of the mirror. Please note the area where the mirror snapped and the plastic that has no wear and tear, sun damage, rot, or anything that would suggest it was "holding on by a thread" so to speak, and the paint on the rearview mirror with no sun damage. Also, you recommend folding in mirrors, but you should know, since you're very knowledgeable about my car, is that the mirrors don't fold in. Isn't it true that your carwash machine has tore paint off of a vehicle after going through but did not do it to the vehicles going in after that? Because that did happen. So isn't it a fact that something that may happen to one car doesn't mean it will happen to every other car after, but it will happen again. The mirror was intact upon entering and broke upon exit. One cannot also make guesses as to the condition of a vehicle due to its age. Therefore, Grand Slam is liable for the damage to the mirror.
