We hired ********************* of A & D Excavating to both regrade our driveway and line it with railroad ties to retain the stay-mat/gravel and then to clean out the drainage swale surrounding our property on 2 sides to its original construction dimensions of 4 feet wide and 3 feet deep, then to use 6 foot wide landscaping cloth to line inside the drainage swale (3 feet on either side) and then to place medium sized granite rocks on the inside, lining the inside from top to bottom. While this was going on we were closing on the sale of our home in ******** and had to go to ******** while approximately 30% of the work was done. We paid our bill which was approximately a total of $9,000.00.The deficient items are:1. There is a railroad tie that was supposed to be cut at a 45 degree angle at the right turn out of the property which is installed/cut at a 28 degree angle, everybody runs off the driveway and into the lawn while turning out. That is why we needed it to be at a 45 degree angle. 2. **************** literally dumped the last bit of rock from his trailer bed into our drainage swale which everything went into the ditch including all of the small aggregate, sand dirt etc and he literally created a 20 inch wide all all the way to the top of the drainage swale, a dam which has backed up up the entire drainage going behind of that point and diverting the water into our leech field and septic system. This made the complete opposite of what was needed!3. The drainage swale was constructed to be 4 feet wide and 3 feet deep, **************** was told this by myself a number of times, he was told by my wife ***** who is a General Contractor and has been for 32 years, as well it has been part of the town of *********** record since July of 2019. In the ****************, when a construction item has been completed and left as such, legally that is referred to as "acquiescence". The ditch is only 8" deep instead of 36 inches deep and because of that water has to travel uphill to drain!
