They have been hunting me and my family for the vacuum payment for over 10 years now! There was not aggreement to buy the vaccuum by me this is my ex spouse who I responsible for the vacuum! Merchants Acceptance Corp. (MAC) has investigated this consumer complaint and has determined that the debt it legally owed and is well within the statue of limitations for debt collections. No calls have been made recently to the consumer, the only attempt to contact is the letter provided by consumer that was sent on 3/28/2025. MAC obtained a judgment against the consumer on 6/9/2016 in **** County District Court, case# ***-11279. Attached is a copy of the judgment. The judgment is valid for 10 years and can be extended for an additional 10 years if there is still a balance owing. No contacts or attempt to collect this debt are in violation of any debt collection laws or regulations, the debt is valid and owed by the consumer.Initial Complaint

I signed a contract to purchase a ************** on 01/18/2024 at around 8:00pm. This was financed by Merchants Acceptance. I received a letter in the mail dated 01/18/2024 with my payment amount, number of months and that 1st payment of $112.37 was due on 02/25/2024. I was told that there was a promotion of 0% interest for the first year then interest would accrue after the first year if not paid off. I received no notice that the promotion period was ending. I sent emails or messages through the website but got no responses. I called Merchants Acceptance on 02/06/2025 which was well before the first year ended (02/25/2025) asking to get a payoff balance. I was told that $490.83 in interest had been added to my account because it was past the promotion period. I have paid every payment on time and even a few dollars more than the required payment. I should have until 02/24/2025 to pay it off without the interest. I was told there is nothing that can be done and that my payoff is $2,219.64. Merchants Acceptance should honor the 12 month promotion. I ask that Merchants Acceptance reverse the interest charge of $490.83.Business Response

Merchants Acceptance Corp. (MAC) has reviewed this consumer complaint and has determined there is no justification for a billing adjustment on this account. The consumer entered into a retail installment contract for the purchase of a Patriot Home Cleaning System on 1/11/2024. That contract contained a 12 months Same As Cash(***) promotion. I have attached a copy of the entire contract along with a separate attachment pointing out the 12 months *** promo and the terms of the *** promotion. All Same As Cash promotions begin from the date of the contract, this was verbally communicated and confirmed with the consumer on our verification call that took place at the time of the sale on 1/11/2025 and is also found under the terms and conditions of the written contract. I have reviewed that recording and confirmed the consumer was advised that the Same As Cash promotion starts from the day of the contract. The customer had until 1/11/2025 to pay the amount financed $3,108.81 to avoid paying any finance charges. The consumer did not pay the amount financed by 1/11/2025 and MAC is under no obligation to waive the remaining interest charges.Customer Answer

I am only asking for the company to reverse the interest charge of $490.83. If you will not do the full amount will you do at least half $245.42?

Merchants Acceptance Corp. (MAC) has reviewed and investigated the consumer complaint. We have determined that the finance charge earned and collected to date is correct per the terms of the agreement. As outlined in the contract submitted by the consumer under the section labelled PREPAYMENT 'The unearned Finance Charge is calculated using the Actuarial Method'. The finance charge rebated on this account under the Actuarial Method resulted in $445.68 in finance charge being waived due the early customer payoff.Customer Answer

I am rejecting this response because:
The company did nothing to credit back any interest paid to date. I paid the loan off because the imposed interest rate was insanely high for the small original loan amount. The company should have waived the interest charged in January 2025 since extra amounts were paid each month on the loan. Truly sad that this company is so stringent!!!

When I got the surveillance system it was not explained to me that you had 3 days to cancel it if you do not want it anymore. Whomever I was speaking with told m that it was not his problem that, it was explained in the contract and that I had to keep up with the payments regardless if I did not want it any more. No one ever said explained that to me. They also hound you about a missed payment years ago. Keeps trying to get me to give them a debit card number over the phone. They also said that I had missed a payment again and it comes directly out of my account and I have proof to show it. This makes year 4 and I regret I ever purchased this security system with them. Their website also does not show you your contract only have the option to make a payment.Business Response

At no point within the cancellation period did the customer express a written intention to cancel the purchase. Furthermore, the customer has made 35 payments on the account thus acknowledging and accepting the debt. Please people dont buy a ***** from any salesman that comes to your door. They need to stop selling these dinosaur of vacuums. Its sad that they dont want it back and dont give any option to. Im dealing with a garnishment from almost 4 years ago and I signed the agreement 9 years ago. They are scammers and this is so sad. The vacuum cleaner isnt worth what they charge us for. I should have listened to my husband that day and left it alone. Now Im stuck with something I I dont want. I know Im not gone get through to them and resolve anything Ive read to many complaints. Date of **ntract 10/24/2024.. a Thursday after business hrs, around 8pm. ***** solicited my business by offering a free cleaning demo from their shampooing . I agreed and they came back late Thursday. I became interested in the shampoo attachment vs. the kurby vacuum primarily because I just got my ***** serviced, a $200 job. They wouldnt sell the shampoo attachment separately, so the sales men ran some numbers and reluctantly I agreed. They set the system up and moved it upstairs. The next day I got a chance to really go over the numbers and realized those figures where not any good for me. They inflated the price on the ad card which they put on the table, a $2300 price tags. No one would. So on with demo and small talk revolving around the shampooing which I liked but **uldnt purchase separately. The salesmen made several calls to someone and told them I was interested but not at the $2300 mark up. $1500 is what they said which is starting price in my opinion, really, and still rather expensive giving todays market **mparison. $65 month 3 yrs $700 interest. Or, $200 month for 6-7 month to avoid interest all together. Once I had my head cleared I wanted nothing to do with those numbers. I immediately initiated a return process or so I thought. I hadnt looked at the small print on the other side of **ntract which states 24hrs on one hand, than, 3 business days on the other to return *****. I called finance ** who said they would call ***** in ******** Ca to let them know I wanted to return thier vacuum. The finance **mpany didnt say anything about the procedure for return on the back of their **ntract. Instead the finance **mpany tried to slam me into the deal as well but agreed they would call and see what ***** ** in Stockton Ca would say,and that they would call back before end of the day. That was Friday. Meanwhile I got somewhat finilar with the back of **ntract, so I signed and dated it reflecting my intentions . After which I reach out and got nothingBusiness Response

I am filing this complaint against [Merchant Acceptance C] for reporting inaccurate or derogatory information on my credit report, which is a violation of my rights under the Fair Credit Reporting Act (FCRA). According to 15 *** 1611, it is unlawful to knowingly and willfully furnish false information regarding a consumer's credit report . The derogatory account on my credit report is inaccurate and does not reflect my current credit situation .Moreover , under Section 617 of the ****, consumers have the right to dispute inaccurate information and expect timely removal or correction of this information by the reporting agency. The consumer took out a loan for the purchase of a ***** Home Cleaning System with MAC on 12/10/2019, see attached pdf file of the original contract. After the consumer defaulted on the loan it was charged off and pursued for legal action against the consumer. A judgment was awarded to MAC by the Superior Court of California County of Siskiyou on 10/18/2022, see attached copy of signed judgment. MAC is actively collecting on this valid consumer debt and it was not written off to income and thus is valid to be reported to the credit reporting agencies.Initial Complaint
