      A written contract was provided via email September 2023, I signed the contract and provided the requested $10,000 deposit in October 2023. Every since receiving the funds his communication dropped drastically. I was told 3 weeks to one month out several times. He gave me countless excuses as to why he needed to push the start date back. Finally January 3rd he provided me with a "tentative" start date (January 15). I emailed him multiple times between January 3rd to 15th with questions, none of which were returned. He is not returning my emails. I have called him but it appears that he has blocked my number now. $10,000 deposit, and no work to show for it. I have all communication history via email, text, phone call records

      I hired Alpha-Pac NW Construction to build a deck for me, paying them $3,7601.09 on Nov 30th 2022. The work was supposed to begin Dec 7th, but the contractor did not show up. At the end of the day, they said that they had to pick up materials, but would be there in the morning of Dec 8th. He left equipment in my yard that day, but did not work on my deck. No construction materials were delivered.The contractor said he would begin on Dec 12, but didn't show up or call to reschedule. On Dec 14th, I asked when he would start. He told me that his fiance was in a coma. At that point I told him I didn't want to move forward & asked him to pick up his equipment and refund my deposit. He told me that he already bought materials. I offered to reimburse him for materials already purchased, provided he drop off the materials that day and provide receipts. He dropped off the materials that day, but did not provide receipts or respond to multiple attempts to contact him again to resolve the situation. I would like a full *********** can take his materials back --> the new contractor said he can't use most of the materials anyway (wrong size lumber, concrete not needed, wrong type of saddle in pier blocks).

      After signing her contract, on the date agreed upon to start work, ******* messaged me saying she still had too much snow to left where work was supposed to happen, and wasn't comfortable with me working at that time. Although I don't care about working in the snow, I agreed to her wishes. That being said, my fiance was currently in the hospital and had almost lost her life. While that was a very difficult time, and quite tough one me, that was not an excuse, but rather an apology as to why communication wasn't as responsive as normal. ******* does not control my schedule, and I had other jobs that still needed to be done, along with being with my fiance at night in the hospital. I purchased her materials, which I have no desire nor reason to take back, which are exactly what I had specified in the estimate except for the beam wasn't 20' but rather 2 12' beams, and due to the weather running sonotubes and deeper footings would have been pointless. I changed my plan, where any contractors contract states he's in charge and it's my choice and site to choose how works done, to accommodate to the cold and wet conditions. Furthermore, When asked, I told ******* I would be there that Friday, 2 days away. Knowing my new start date, considering she'd already canceled the previous start date due to weather, she does not make my schedule, nor have the right to breach contract. The day I told her I would be there was the earliest I could be there, after all, her putting off the original start date doesn't get to affect my other jobs nor customers dates. After giving her my next available date for work which was already on my calendar, and taking my apology for not being so communicative as a good reason to break our contract, I immediately dropped off her materials, and loaded up my equipment and left. Being a small contractor, her postponement of starting work and breaching of our signed contract had been extremely hurtful financially and stressful regarding time and scheduling.

      I am rejecting this response because: This message is regarding complaint #********. I did not see the contractor's response from a week ago until today; I do not wish for this complaint to be closed yet. The contractor has not offered any remediation to my legitimate complaint, which begins with the day when he didn't show up as expected. Prior to that there was a mutually agreed weather delay, and if he had requested to work despite the weather that would have been OK with me. He never asked. Instead, we mutually agreed upon a new start date; he didn't show up. I fired him for being unreliable, prior to any work being completed. A refund was promptly requested. My offer to negotiate a partial refund (minus the cost of materials) was ignored. The contractor has refused to contact me since he left the unusable materials in my garage. He has done absolutely nothing to resolve this issue, but instead has pocketed my money (much more than the cost of materials from the quote) and walked away.  This is not the behavior of a reputable business.

      For one, theres nothing wrong with the material purchased, considering theres many ways a job can be done and the material purchased is deck material, pier blocks with that will accommodate a 4 post or how it was going to be used in the application, to carry the name in a low deck build. Ignorance is not bliss ********************. Second, I had agreed with the postponement due to the fact she was uncomfortable with me working there in the icy conditions, to insist on working would be futile and pointless, her home, her wishes. But I wouldve gone and checked site conditions the following morning, and assessed them. She messaged the night before, when I did tell her that I was figuring the weather would be bad but my plan was to check in the morning and go from there, but thats fine. This part is irrelevant and only further proves my point, she postponed, of course I agreed, it was unreasonable to do that. Where her thinking is thoroughly skewed is in her reasoning in firing a contractor after a postponement where I didnt miss multiple rescheduled dates or times, but was, during a winter storm as well as handling family emergencies and health problems with my significant other where she did almost die, I was doing the best I could in handling  the schedule of other jobs, running my business, sales meetings, customer estimates, and jobs scheduled for work, and after answering her question, in which I responded with a date for start and an apology why I hadnt communicated better, which to be completely honest, was none of her business yet I had the decency to try to enlighten her on what was going on, to receive her response of firing me, breaking contract due to the fact the contractors standard contract allows for foreign after seven (7) days after WRITTEN notice of infractions where firing is allowable IF the contractor doesnt rectify the fireable offense. If I sign a contract for a car and realize I want another car, do I get to say oh, I withdraw my consent to purchase this vehicle.? No I dont. Thats asinine. I didnt show unreliability, her impatience and ignorance in how to handle a contractor, scheduling, and unforeseen occurrences have cost me more than her half down deposit. The fact that she is continuing to harass me and smear my name is despicable and disgusting, merely because her choice to break a contract in which she has no footing to resulted in me not allowing her to waste anymore of my time or energy dealing with her ridiculous attempt to pass the buck. I have given her no reason to all of a sudden withdraw her consent from our contract nor should I be subject to her tantrums and online smearing of my company nor the wasted time Ive endured at her attempts to cause me problems, and furthermore the sickening tries to get me to lose business all because a she decided to go against our contract. I feel that Ive expressed my side very clearly and would like this closed and ******************* to never contact me or my organization again, he slander and one sided pointless attacks have gone on too long.

      I am rejecting this response because the contractor has not offered any remedy or resolution to my complaint. The facts remain: He did not show up for 7 days after the agreed starting date. If his personal circumstances were preventing him from doing the work, he needed to arrange a new start date with me. I am not obligated to continue with a contractor who is not delivering upon his word. He was aware that I expected a refund if things didn't work out, and did not tell me that my deposit was non-refundable. (See attached screenshot where I explained that I would only pay by credit card in case I misjudged him and needed to recover my money.) There was nothing in the contract stating that my entire deposit was non-refundable; I would never sign a contract with such a stipulation. 

      The only acceptable remedy is to have my deposit refunded. I hope he reconsiders; my only other option to recover my money is a lawsuit.

      It states in the contract that work will be performed until ********* completes work. *******'s "ignorance" on the point of a contractual down payment is absolutely ridiculous. This is becoming a downright laughable display of "I don't care that I signed a contract, or that he gave me a start date when he could start work after I had postponed the schedule, or that he already bought materials, I'm going to throw a fit and completely harass him and expect my non refundable down payment for his troubles to drive around, spend time gathering material, waste his time as much as possible, get the materials from him, then force him by being an insufferable human being and smearing his name and then demand a refund on top of him burning a ton of fuel, time, energy, and material costs above the money every contractor collects before a job as a retainer for their work but I dont care as long as I can get my way" I have ever seen. I can't go hire a subcontractor to do a job for me, sign a contract stating that work will be done and he will be paid, then postpone the date and when he's unable to start when I want due to the fact I'm not his only CONTRACT job I fire him and expect a full return because I "withdraw consent" due to my ignorant and self centered entitlement. What is the point of a contract if there's no consequence for breaching it? That's  asinine for it to assume that because "I changed my mind and give me my way" is the basis for a full refund. Contractors collect a half down deposit to deter certain types of despicable people from using them and taking advantage of them, and/or wasting their valuable time and money, resources, fuel, and patience just to end up getting shafted when an impatient and entitled homeowner decides to change their mind or hire a cheaper and probably less qualified contractor or do it themselves because ******** showed me how to lay some caulk!" What incentive does that give a contractor when a job is signed? How does a contractor put faith in a customer following through if they can just back out of a contract with no ramifications and ignorant to the fact work done doesn't just start at the swinging of a hammer? A contractor puts alot of time and energy into a project, starting way before a homeowner even sees them face to face. The hours put in to project and bid is clearly unknown to a person such as one who'd breach a contract even after being told of the tentative start date when the contractor has other obligations to other homeowners who aren't actually trying to shaft them. But ******* blatantly uses her ignorance is bliss approach to contracts and doesn't put any regard or merit into the fact that the contract stating I do the work until completion means that by taking my work away from me doesn't mean I don't get paid for work done already just to get her little deck job ready to start. So, *******, let's dance in court, shall we.
