      On April 25, 2024, I was researching home-based business opportunities. I was contacted by a representative from this company who was very coercive. Ordinarily, I would have hung up, but at this juncture, I was under immense pressure with personal issues. Desperate to find something that was doable, I went along with this. I was assured that with hard work and maintaining the website, I could make up to $800 or more in the first 3 months of operation (emphasis on could) and that in the future, this would be an income replacer - potentially $100,000 or more. I was told of one customer they had who was building a million-dollar business with them. I spent hours uploading products (that are from cheap importers and are frequently out-of-stock). My store went live in June and I had one customer who made a purchase that was refunded because ******* wasn't set up correctly. I have had two other sales - one from my daughter and one from me and both were closed as the product was out of stock. (The website showed over 100 items for each.) I have built a following on social media platforms but this program does not attract shoppers. Since this debacle, I have been doing tons of research about online shops and the reality is that most of these stores will likely not be successful. Many importers recommended by Marketactix will sell the same product to a consumer or an online store for the same price. I pushed back on this. Why would anyone buy from me when they can get it from the company for the same price or less? And these same products are on ******. The competition is outrageous. There is no support for the small business owner. As I decided I needed to make some changes, I requested the domain details so I can rebrand and I was told that "it's not a good idea". I either want them to buy it back or give me all the domain access so I can work with someone to fix this mistake and rebrand my business and website.

      After Review of the claims and allegations by **** ****** we find these to be without merit and disingenuous.
      At the onset it is important to note that Ms. ******* complaints are primarily product and or supplier related.  The contract Ms. ****** executed does state:
      CLIENT also acknowledges and agrees that CLIENT has been and will remain responsible for making all decisions regarding the name of CLIENTs business, the products and product lines CLIENT offers and sells as part of CLIENTs business, and is responsible for all decisions related to the drop shippers (if any) that CLIENT has decided to work with as part of CLIENTs business. CLIENT and MARKETACTIX acknowledge and agree that to the extent MARKETACTIX assists CLIENT in identifying appropriate drop shippers, MARKETACTIX does not have any relationship with such drop shippers, and is not responsible for the conduct or performance of such drop shippers.
      Ms. ****** modestly admits I could make up to $800 or more in the first 3 months of operation (emphasis on could)  Much to the point our contract clearly states:
      2. LIMITATIONS OF SERVICES
      The Services provided by MARKETACTIX are limited to those specifically stated in Section 1 of this Agreement, and shall specifically exclude pay per click advertising. MARKETACTIX does not represent, warrant or guarantee any increased sales, revenues, profits, or success due to the Services provided to CLIENT. MARKETACTIX does not warrant or guarantee any particular search engine ranking, traffic, and/or placement in any search engines. MARKETACTIX is not liable for any loss of sales, revenues, profits, traffic, or rankings to CLIENT. MARKETACTIX is not liable for any other changes or issues caused by other search engine optimization companies, by the CLIENT, or by any web development company used by CLIENT prior or subsequent to this AGREEMENT. Any additional work not specified in this AGREEMENT must be authorized by a written change order.

      This information is buried in the boilerplate of our agreement,  it is clearly marked as Section 2 just above Ms. ******** initials indicating that she read and agreed with the terms and conditions.   Ms. ****** insinuates that Spectacle Marketing Group LLC DBA Marketactix hereafter referred to as Marketactix solicited and initiated contact which is false.  Ms. ****** submitted an inquiry and request for information online that warranted the initial call.  Marketactix does not implement the habit of advising what other clients profitability is, however when asked a broad range is provided to show the full scope of potential positive or negative.
      After lengthy discussions about our services that could be acquired if a fit was deemed by Marketactix it is solely at the discretion of the potential client to select what services they would like to acquire at an agreed price, the same is said about how a potential client would pay for these services.
      Marketactix  institutes a multi step process to ensure there is no confusion and to prevent events like this.  Prior to billing this purchase.  Ms. ****** covered our service agreement that included the setup fee, description of services and our cancellation policy with a sales representative. Ms. ****** the client then must click through our contract form and initial all sections including the payment terms acknowledging: 
      ? The client has read and accepts all terms and conditions outlined in our agreement including the price, description of services and cancellation policy
      ? Initial, sign and date the entire agreement acknowledging the client accepts the entire agreement
      ? Input their own payment information (card information including CVV, billing address) and processing setup fee payment.
      Once our agreement has been accepted and payment information has been entered a ******** ID is attached and the clients IP address is recorded and a copy of this contract is emailed to the client.    
      The next step of our process is to verbally verify the purchase and details with the client, via a recorded call.  During this call Ms. ****** acknowledged what she was purchasing, price ($3000.00),  method of payment,  including verifying the card information and billing address, and acknowledged she read and understood our cancellation policy (including the federal 3 day cancellation policy), description of services and that nothing outside of what is written in our contract was promised.  This step is completed by  a Marketactix  employee who is not part of  the sales department and who did not receive any commission on the sale.   Lastly the verifier discloses that Ms. ****** may be offered additional services that she can choose to accept or decline on her own accord as any additional services are optional and not required. 
      It is only after Ms. ****** indicated that she understood and agreed with everything in the written contract by signing to accept our contract in its entirety that this purchase was processed.  

      After further review of the  complaint filed by Ms. ****** thoroughly as we take matters such as this very seriously.  We are struggling to identify an actual complaint against Marketactix.  Given the language of the contract executed by Ms. ******* as previously stated her complaints are regarding product and supplier issues which we covered.  ************* would like to assume ownership of the domain we are more than willing to transfer the domain to her.  Ms. ****** would need to register an account with GoDaddy and provide Marketactix with the email address used to establish this account.  Once we have this information we can initiate the domain transfer which she would need to accept.  This transfer would also include any associated costs to renew the domain moving forward. 
      As all deliverables owed under contract were fulfilled and the complaints Ms. ****** has are not Marketactix service related,  it is for these reasons that we do not believe Ms. ****** is entitled to the refund she demands.  ************* would like to move forward with the domain transfer, she is more than welcome to contact us once she has completed the aforementioned instructions.

      I am rejecting this response because:

      I did not state the company called me first. I did acknowledge I was looking for something to build a business and I found this group. They called me after I input my contact information. What I did say is their phone tactics are coercive and misleading. There were two men I spoke with on April 25; one was coercive and said he had ***y other people to help and I had to make a decision now and then because he did not have time for me to ****** this. The second *** poked into my personal information as to how much money I had available to invest so as to start a business. Once they had a number, the pressure was to make a decision and lay out the credit card information. This seems to be a pattern with the group.

      I kept copies of all the documents that were signed and I have read them over. It was unnecessary for them to copy/paste in the replay. The complaint I have is that you set up a business and took funds from me and yet you know these businesses have zero chance of success when the promoted supplier is a foreign company with sketchy delivery/product availability. 

      Furthermore, to say my claims are "without merit and disingenuous" is an insult. You are in business to make a profit. You sold me a plan so I could set up a business and my plan was to turn a profit. You sold me a lemon.

      My name is ***********************************. I am 73 years old and live on my SS income of $1771 a month and am in elderly housing. On January 11, 2024 I was online looking for an internet job to supplement my income. I came across Marketactix thinking they were a job hunting company. I explained that to a man who said he was the Account Manager. He started talking about opening an online store and how great it would be for me. I told him my age and that I have no experience whatsoever with the internet and even less with social media. I also told him about my SS income. He said it would be easy. I just pick out the products and put them into the store and maintain them. NOT SO: The distributor was from ***** and each product had to be manually revised, as I understood without mention of brand names or shipping from *****. Very time consuming and I felt uncomfortable with it. I asked if I could get an American distributor and was told there very few who didnt charge a fee and we would go over it at the next session. (a lot of questions I had were answered that way). My sessions were 1 weekly for 12 weeks. I didnt realize how short a period that was until I started. How could I learn from the bottom up in just 12 hours? Then I was told after a sale I would have my profit put directly into my checking acct. daily or weekly. HE DIDNT MENTION that first they take out the cost of the product from my acct. and then I received the difference 3-5 days later. My first 2 sales were a nightmare from the shipper who I could not get ahold of and had to cancel because the product came up as SOLD OUT! I emailed them and they shipped one of the mirrors anyhow. I was charged back $200! Marketactix would not help me get my money back. I worked to launch a complaint to Shopify and they returned $79 of it. Also one person from Marketactix said she had never seen this happen and I shouldve looked up the distributor to see his rating. I didnt even know I could do that! I had so much more happen

      Dear ****************,
      After Review of the claims and allegations by ************************************* we find these to be disingenuous.
      At the onset it is important to note that ****************** has previously attempted to dispute the charges for her purchase, the result of that matter was ****************** rescinding all disputes and opting to continue with her program and executed an agreement on March 5, 2024.  Shortly thereafter ****************** filed a Washington State AG complaint on June 20, 2024 that was closed on June 24,2024.  
      Ms. ******** makes reference to her age and living situation, let the record show that Marketactix does not ask potential clients their specific age.  We do however ask if the potential client is over the age of 18.  
      While this complaint is almost identical to the complaint ****************** filed with the Washington State AG there are some additional statements which we will address.  ****************** states that at her own  assumption Marketactix is a job hunting companyand that she came across ***
      For the record this statement is false.  ****************** actually submitted an inquiry regarding building a commercial website and based on the type of inquiry ****************** had already started that process before ever coming into contact with Marketactix.
      Additionally it appears that the roots of Ms. ******** complaints are regarding two failed consumer transactions and the performance of her chosen suppliers and implying that Marketactix is to blame.  This agreement does state:


      In consideration of the foregoing, and subject to the following conditions, the Parties agree as follows:
      1. Settlement of All Claims
      Release and Settlement of Claims against Marketactix. CLIENT irrevocably and unconditionally waives, releases, and forever discharges MARKETACTIX from any and all claims of any kind, past, present, or future, known or unknown.
      Indemnity and Hold Harmless. For and in consideration of the sums described above, CLIENT also agree to defend, indemnify, and hold harmless against any and all claims.
      Since completing that agreement  all deliverables owed under contract have been fulfilled and approved by ****************** as indicated by the Acknowledgment agreement executed by ****************** on May 13, 2024.  If ****************** truly was unhappy she would not have executed this agreement.

      The next step of our process is to verbally verify the purchase and details with the client, via a recorded call.  During this call ****************** acknowledged what she was purchasing, price,  method of payment(s) including verifying the card information and billing address, and acknowledged she read and understood our cancellation policy, description of services and that nothing outside of what is written in our contract was promised.  This step is completed by  a Marketactix employee who was not part of  the sales department and who did not receive any commission on the sale.  Lastly the verifier discloses that ****************** may be offered additional services that she can choose to accept or decline on her own accord.  
      It is only after ****************** indicated that she understood and agreed with everything in the written contract by Initialing all sections including our description of services and cancellation policy and ultimately signing to accept our contract in its entirety that this purchase was processed.  For the record ****************** executed two separate contracts dated: January 12, 2024 and January 29, 2024. 


      The root of Ms. ******** complaints are pertaining to two failed consumer transactions and the performance of her chosen suppliers and implying that Marketactix is to blame. 
      Ms. ******** claim regarding a consumer chargeback for a purchase via the website developed for ****************** and moves on to complain about where the products are being shipped from.  While the chargebacks are  unfortunate it does prove the product and services provided by Marketactix were fulfilled.  That being said, our contract does state in Section 5 located just above Ms. ******** initials indicating that she read and agrees with the terms:
      CLIENT also acknowledges and agrees that CLIENT has been and will remain responsible for making all decisions regarding the name of CLIENTs business, the products and product lines CLIENT offers and sells as part of CLIENTs business, and is responsible for all decisions related to the drop shippers (if any) that CLIENT has decided to work with as part of CLIENTs business. CLIENT and MARKETACTIX acknowledge and agree that to the extent MARKETACTIX assists CLIENT in identifying appropriate drop shippers, MARKETACTIX does not have any relationship with such drop shippers, and is not responsible for the conduct or performance of such drop shippers.
      ****************** concludes her complaint by associating her experience with her chosen suppliers and a language barrier and deeming that Marketactix is somehow responsible.  Given the language of the excerpt from Section 5 of our contract her complaint is targeted incorrectly.  ****************** was on the right track by attempting to resolve the matter with her chosen suppliers.  Unfortunately this is not not something Marketactix can assist her with as Marketactix does not have any relationships with any suppliers, additionally dealing with supplier issues is not something Marketactix is responsible for as this would go against what is stated in our written agreement.
      It is for these reasons that we do not believe ****************** is entitled to the refund she demands and certainly not for an amount over the actual purchase price.  If ****************** still wants to utilize the support and training she is welcome to do so, however Marketactix will only provide support for service related issues as outlined in the two separate contracts ****************** executed with Marketactix.

      January 5, 2024, I have to be truthful about the promises that I will be making tons of money to use my credit card as collateral or investment and create my own business to mention ****** says, You do not need experience or a degree to make a lot of money and able to visit your family and buy a home, etc. I only need the internet or devices to make lots of money. I asked you about why I have to apply for a credit card for $58,000, and then I had to be honest to you on the phone directing me on how to get things going. We tried ********** and Discover, and I got denied, and I told you because my three credit scores ******* and locked. We were on the phone back and forth, and I was forced to act fast because I only had one day to get the discount on this store's website and get started. This was February 24, 26 2024. I told him that I had good news six days before the denial: I got approved for $11,500 by **********. Then, I was able to be true to you. Every time I asked you a question, you had to interrupt, and you gave me a hint that I wasn't sure about the reason I am disabled, as I keep saying to you, but avoid and then avoid. The next day, I had to think about this first, and then I asked how much time it took to start the website. You told me I have to wait, then you said you need to introduce your Boss (******), then another pause and wait, wait, then you said ok. I met ******, and he explained to me how things work. I was convinced by how motivated you feel even though I had to stop for a second because I had not gotten a straight answer regarding my concern about being a disabled person.       After reviewing the complaint filed by **************** we are struggling to identify what the actual complaint(s) are.  **************** provides information that is not accurate, alleging he will be making tons of money Our contract actually states that we do not make any suggestions, promises or guarantees about sales or profits.  
      Marketactix institutes a multi step process to ensure there is no confusion and to prevent events like this.  Prior to billing this purchase.  **************** covered our service agreement that included the setup fee, description of services and our cancellation policy with a sales representative. **************** the client then must click through our contract form and initial all sections including the payment terms acknowledging:

      The next step of our process is to verbally verify the purchase and details with the client, via a recorded call.  During this call **************** acknowledged what he was purchasing, price ($10,500.00) and a second purchase on March 20, 2024 ($13,000.00)  completed with three different methods of payment,  including verifying the card information for all three cards and billing address, cancellation policy, description of services and that nothing outside of what is written in our contract was promised.  This step is completed by  an  Marketactix employee who was not part of  the sales department and who did not receive any commission on the sale.  Lastly the verifier discloses that **************** may be offered additional services that he can choose to accept or decline on his  own accord.   This process was conducted for both dates.

      The claim that **************** was forced is untrue as **************** made two separate purchases one month apart from each other, executed two separate contracts and participated in two separate recorded verification calls.  With regards to **************** being disabled, this is not a topic we can ask legally as it poses a challenge either way.  Is Maretactix discriminating for denying service to a person with a disability or is Marketactix preying on a consumer knowing they have a disability?  That being said, Marketactix does not make a practice of inquiring about any disabilities. This topic is one of the reasons we implement a recorded verification process to ensure that all parties understand and agree to the description and terms of services.

      Outside of the addressed statements we are not able identify an actual complaint about the service or product(s) delivered which **************** provided examples of deliverables in his complaint.
      We have made recent efforts to speak with **************** without success as his phone goes straight to voicemail and he has been unresponsive to our emails.

      I am exhausted from trusting some unknown who has a thriving, Motivated, Supportive, kind website such as Marketactix LLC. I stood before them, hoping that I was trustworthy and honest to myself first and that they would look at me and put shoes into my shoes. The individuals I spoke with are *****, ****, and **************** I will send you a brief description of texting back and forth, and I have a voicemail from them. I'm afraid I have to disagree with them regarding or not mentioning that I'm disabled, and we agree on things I need accommodation. They promised me that this would be training with a coach if I decided to cancel it and then refunded my money, $10,500 weeks delinquent. I mentioned several times that my disability could be a factor in the road. They ignored it as part of my conversation with each of them. I fully believe that the bottom of these comes to the advantage of the fact that I am aware this will be a problem personally and mentally as epilepsy costs me to make a risky judgment on my behalf. I am willing to trust a marketing company that doesn't see me as a victim of false information and does not introduce any Pamphlet to work, guidelines, or workbooks on what the company is all about. It's all disrespectful about my right to disable; ignore the fact as long as money comes along. They declared the hat everything was based on the settlement I agreed on without my authorization and explained to me the cost and hardship of which they convinced me to apply for a credit card. I stand that I did what was necessary, but I continue to bring up my disability. I have more stories and evidence to provide about them if needed. I have to say one last time honesty brings ******* to business and people's respect, is money dishonest is a disadvantage specific to disability.
