I am the daughter of *******************************, and also his attorney in fact and executor under his will. ******************************* was a resident of this business for over three years. He died on January 25, 2024. His contract with this business states in Section VIII (C) that if the agreement is terminated by the residents death, the notice requirement is waived, and the resident will only be charged for the prorated monthly rate for the days he actually resided in or retained use of his apartment. Since we turned in the keys on January 30, he should be entitled to a refund for the last day of January, along with the refund for the care charges from date of death. The refund for care services from January ***** should be in the amount of $348.39. Instead of issuing that refund, this business is sending a bill for rent through February 9 in the amount of $733.82. My husband and I have sent numerous emails asking for the refund or an explanation why money is still owed under the contract, but have received no response other than to say they will look into it. Now the billing statements are threatening to send this account to collection, still without explanation.
