    On November 29, ******************************************************************************************************************** ******* ************* was at work in ************* **. I didnt order door dash or zaxbys. ******** told me on the 29th that they were working on a ************ been 2 weeks they arent even allowed to do the refund i was told today. Also i called the zaxbys in ******* ********* they told me they couldnt do anything for me i needed to just cancel my card and get a new one. It was 2 orders one for ***** & *****. ******** told me it was zaxbys issue & i needed to take it up with them because it was done in the app.

    On August 29, 2022, I ordered an oil painting through the "Instapainting" website, intapainting.com, supplied a photograph, paid $61.08 to initiate the project, and was set up with an artist going by the name of Ms. **************** There was some back and forth communications over the next week as this project was supposedly in progress, some fuzzy drawings in various forms of what was to be stages of completion. On September 6, 2022, I was informed that the portrait was complete, and was set a digital photo of what was to be "The Portrait" of our daughter that was taken from us in 2017. I was instructed to send the remaining balance of $305.40 for a total of $366.48. I was out of town at the time, and upon my return on September 8,2022 I made the final payment, and approved the shipping of the imaginary portrait. On September 12, 2022 with still no response from the artist, I requested assistance from instapainting.com directly. I received an email from "*****" with instapainting stating that they had contacted the artist, and that I should be hearing from her soon. The following day, I received two final emails from the so-called artist stating that the portrait had been shipped already, and that a tracking number would follow, never to be seen. Since then there has been no more communications from the artist or Instapainting.com, and now it appears that the website has been taken down. I would like to have the business refund the entire amount I was charged due to their own fraudulent activity.

    Hi, please note your order was indeed shipped by the artist via UPS on 09/14/2022 and a tracking number was provided on that day. Our website has not been taken down, as you can see by visiting Instapainting.com in your browser. If you receive your painting and notice that it's not a real painting then simply contact us (with the evidence) and we will suspend the artist that sold you a fake painting and refund you immediately. It's frankly not a very profitable scam for artists to do on Instapainting.com, but if it were to happen there would be absolutely no risk to you. If you end up receiving some sort of fake painting please follow up with us either here or by contacting our support department at ********************************** and we will take care of you.

    I am rejecting this response because:

    First, the tracking number provided "farex2209015171yq" is not a valid *** tracking number according to the *** website. This doesn't resemble any *** tracking number that I have ever seen. The business states that the item was shipped via *** on the 14th, but when I was once again able to get on the website, it shows that the item shipped on the 13th. What is the items current location, and when if ever can I expect it?

    Second, I was not able to open the website on 9/14 and 9/15 on any computer, phone, or tablet, but was able to open it on 9/16 after making my complaint to BBB.

    Last, There are way too many anomalies that need to be addressed to just accept this response. As I see it at the current time, I am out $300+, with no way for me to verify anything with the information I have been provided by the business.

    Hi, your *** tracking number is 1Z524RR70393894587 via *** on 09/14/2022. It is showing as delivered to *****, **. As the particular artist you ordered from resides in ***** please understand there is a time discrepancy as they are 1 day ahead. Additionally some artists use shipping agents(for international shipments)  that provide a different tracking number when they initially ship it, and only receive the US tracking number once the shipment is handed to the US carrier. That is why the artist updated the tracking number for you after a few days to the *** one. In any case *** says they delivered the item so if you continue to have issues please contact our support department so they can open an investigation with ***.

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.
    I previously sent the following email to the BBB website to atone for my haste in submitting my complaint. Both parties are at fault, as the seller provided incorrect tracking information, and I apparently initiated a complaint prematurely. In my occupation, communication is key, as should be in any situation.

    I sent in a photo of a home to the company and said I wanted and oil painting of the house. The company sent me artists and I chose the one that painted the most realistic. I saw his previous work and it was very good. I dont believe the artist that painted my picture is the same one that painted the examples. I have requested over and over again for a revision and I have not gotten it. The painting is sloppy, the home looks dirty the window panes are crooked the steps are crooked. I have stated this with the artist requested revisions over and over. I called the company and they keep saying you need to request revisions from the artist. They refused to give a refund. I have an asked for another artist to do the painting. I havent gotten anywhere.

    We've attached an image file of the original photo you provided and the painting. This painting was done consistently with the advertised services of the artist you chose. Please understand that when you look at pictures of other houses or people done by the artist, they will look perfectly realistic to you because those subjects depicted are not familiar to you, and thus you may not have any particular concerns about minute details. But in reality, there are many differences between the painting and the original photo because these are all hand made, and in fact to achieve a hand made artistic look those small differences are inherent in the process. However for details that the customer are particularly concerned about, one can always provide specific instructions to adjust those details.

     

    Please note that we reviewed your change requests to the artist and they were all general and unspecific. Comments such as "Roof needs to look more like the photo" or "The color of the house should be the same as in the photo." which you requested are not actionable or helpful revision requests because they are unspecific and can be openly interpreted. Because the painting is hand made and is fundamentally not the same as the photo (otherwise you may as well get it digitally printed), it is impossible to satisfy those requests because your painting will always have differences by nature of it being a hand-made copy. Instead, to help your artist effect the changes for the details you care about and to effectively communicate what you have in your mind (keep in mind they cannot read your mind), please provide specific instructions on how to change the painting from the current state. If you believe the color of the house is not the same, please tell them how to change it from the current state, for example by saying "make it darker" or "make it lighter." And please use our website tools to annotate specific parts with these comments. If you simply state "it is not the same" then it is the same as saying nothing at all because it is in fact not the same thing as your photo as it is a hand painted copy. We cannot arbitrate on differences of opinion so if you say it is not like the photo and the artist says it is, then that is not something verifiable. However if you **** a specific spot and ask them to make it darker or lighter we can easily see if this change request was completed.

     

    Remember your artist is just another person like you, and cooperating with them is just like cooperating with a colleague. They are professional painters, but they are not mind readers, and they have no incentive or gain to make it any more difficult for you. So if they aren't "getting it" it is likely a communication issue of what you are imagining the painting should be in your mind. Just like working with a colleague, effective communication is key to making progress the work. Please revisit the painting and use the annotation tool to **** specific spots with objective actionable changes. As a tip, please describe how you want it to be changed based on the current state of the painting, and not by referencing the original photo. The artist can see the original photo, so any differences are just inherent in the fact that it is hand painted. If you don't like a specific part, then jus describe how you want it to be changed without referencing that it should just be "more like the photo."
