      For approximately the last 1.5-2 years my 12 yoa daughter has been seeing *************************** (LMFT) for anxiety. Previously ******* worked at a different business before starting her own practice. We had been in phone and email communication regularly in regards to my daughters therapy with no issues. ******'s mother and I have been divorced for the last 7 years. We have a Parenting Plan in place. On 01/11/23 I sent an email update to ******* who responded that she no longer would be providing me information on ******'s treatment or updates due to recent training she received on PP and *****, yet still continued to bill my insurance company. ******* further stated that I would need to provide a court order to get medical records and information on my daughter. *******. ******* also refused to provide what training she was citing or any area of our parenting plan that required a parent to do this. ******* was sent additional emails noting the ***** law case law, *** that requires here to provide this information and official request to provide me these documents and medical updates on my daughter who is currently 12yoa. ******* has refused, and I have also filed a ***** complaint. ******* has been billing my insurance company and refusing to follow the law on this issue and out of compliance with ***** and the *** which she is supposed to follow and violating my parental rights. I hope the BBB can assist in this matter and I have attached relevant emails and documents. Thank you, *****

      To Whom it May *********************** am requesting that the BBB review the following information regarding the complaint shown above:

      I am a Licensed Marriage and Family Therapist in the ******************* (# LF ********). As a licensed provider, I comply with **************** law regarding confidentiality and access to medical records. 

      RCW 18.225.105 prohibits Marriage and Family Therapists from disclosing any information relating to a client-including even whether someone is/was a client without the clients written consent. 

      Furthermore, licensed therapists are regulated by the ********** of ******* Anyone with information about unprofessional conduct by a provider may file a report with the ********** of ****** directly.

      If you would like any additional information about the ********** of ****** complaint process or about the rules of healthcare confidentiality under ********** law, I would be happy to provide it.

      To Whom It may ******** I would like to address the unprofessional conduct of ****************. You have the attached email correspondence with her and I asked her several times what law she was citing and or training she received and she refused to respond. Only now that a complaint has been filed has **************** provided an RCW for her reasons, yet nothing of her "training." Further, **************** is citing an RCW that is not applicablein this situation as the are she is citing is for legal adults, not minor children under 13 years of age where parents have full rights to their health care. This is also supported by every health care provider our children see we are remind and sent updates to their mycharts that at 13 years of age children must then sign a waive. The correct RCW 26.09.225 which states each parent shall have full and equal access to the education and health care records of the child absent a court order to the contrary. Neither ***** (mother) or I (father) are required to obtain court orders, subpoenas, or anything else to access, obtain, or speak with health care providers, and neither parent is restricted from any of this information in our parenting plan, ***** is only the final decision maker after input directly from me after I speak with health care providers. Additionally, **************** has been billing my medical insurance for her services and now not following the law, case law, or basic parental rights. **************** does not only not understand the law she has tried to manipulate this process further by sending you a non applicable RCW, or addressing the correct RCW of 26.09.225 and the current case law of **** vs ****** ************* Had **************** taken the time to consult an attorney in this matter she would have been advised to comply and I also presented the option for her to provide us with her attorney so we could discuss and resolve this matter. To date, 3 separate attorneys have reviewed Ms. ******* responses and another therapist and ******'s currently health care providers who have all unanimously agreed **************** is violating the law, case law, and parental rights and has not provided any legal justification for her violations other than stonewall this process. HIPPA laws are very specific and address minor children start making their own health care decisions at 13 years of age and my daughter is currently 12 years old. A complaint was filed with BBB to resolve this matter for the issues above and an additionally complaint was filed with ********** of ****** who will be investigating this matter separately and **************** will be held accountable for her actions with DOH as well. **************** will also be taken to civil court for the legal expenses and pain and suffering she has caused me in this matter. I have also attached the signed consent form from BBB has requested both signed by me and my daughter who wishes to assist me in this complaint against ****************. We greatly appreciate the assistance of the BBB in this matter.
