I am writing to file a formal complaint against Brick Road Estate Sales & CleanOut Specialists located at *************************************. I engaged their services to handle an estate sale for my property, with the understanding and verbal agreement that I would receive 60% of the proceeds from the sale. I received only a portion of the proceeds that were due to me. When I contacted the business to inquire about the missing funds, I was informed that it was my responsibility to cover the sales tax and cc processing fees. Additionally, the treatment I received from the owner of the business was disrespectful. I have documented evidence, including text messages, that demonstrate the poor treatment and lack of cooperation I experienced throughout this process. Furthermore, the estate sale company left one of the buildings that they took stuff out of to see, in a state of disarray, where curtains were missing and rods broken and missing. There was no reason to destroy my property and leave me clean up after then and rebuild the curtains. Below are the key details of my complaint:* Agreement: I was to receive 60% of the proceeds from my estate sale. * Actual Payment: I received less than the agreed amount, with deductions made for sales tax and credit card processing fees, which were not my responsibility. According to the estate sales company, the sale made $7300. I should have received $4380. In reality, I received $3340. She also took additional stock out of my warehouse to sell at an auction and I have not seen any accounting on that at all.* Time frame - my sale ended on 5/19/2024. I got the partial payment on 6/15/24 after numerous attempt to contact the owner of Brick Road Estate Sales & CleanOut Specialists.* Communication: The owner treated me poorly and was uncooperative. I could not reach the owner for weeks and eventually I resorted to finding her at an estate sale she held in *******. I have text messages that substantiate my claims.

    Business response

    07/25/2024

You will basically get everything you need from the attachments but Incase I did respond to each one of ******'s issues below.

******: I received only a portion of the proceeds that were due to me.

BR: This is correct, she showed up at my place of business making a big scene. I was embarrassed and frazzled. I miss counted the money. I explained this to her later and paid her accordingly.

******: When I contacted the business to inquire about the missing funds, I was informed that it was my responsibility to cover the sales tax and cc processing fees.

BR: ****** didn't contact me I missed 2 phone calls from her and didn't reply to 3 text messages so ****** showed up in the middle of an estate sale, demanding I pay her, making a huge scene. There was so many other ways she could have handled the situation but I guess that's out of my control.

******:Additionally, the treatment I received from the owner of the business was disrespectful. I have documented evidence, including text messages, that demonstrate the poor treatment and lack of cooperation I experienced throughout this process.

BR: I do not think I was disrespectful at all, she was rude, demanding and very pushy. Taking advantage of me at my place of business during a sale, leaving me frazzled and embarrassed. I could barely think at that moment let alone properly count out the exact amount owed to her. I was cooperative and willing to help all the way. You will see by reading our text messages. In the end I was able to figure out what happened, explained it to her and paid her like she wanted.

******: Furthermore, the estate sale company left one of the buildings that they took stuff out of to see, in a state of disarray, where curtains were missing and rods broken and missing. There was no reason to destroy my property and leave me clean up after then and rebuild the curtains.

BR: We did not destroy her property, at one point I told her we left the room a mess and I wanted to come out and pick it up. (SEE ATTACHMENT LABLES 3&4)

I wanted to get back and fix it, I was told from the beginning I was doing a clean out.

Below are the key details of my complaint:

    *    ******:Agreement: I was to receive 60% of the proceeds from my estate sale. * Actual Payment: I received less than the agreed amount, with deductions made for sales tax and credit card processing fees, which were not my responsibility. According to the estate sales company, the sale made $7300. I should have received $4380. In reality, I received $3340.

BR:As you read through all the messages you will clearly see I just needed a chance to review the paperwork and find the discrepancy but she was very pushy and demanded answers now that I couldn't give without looking into it. I eventually found the discrepancy, explained it and sent her the difference.

******:She also took additional stock out of my warehouse to sell at an auction and I have not seen any accounting on that at all.

BR: After you read the messages where I very clearly recap the situation about the warehouse you will see how I was willing to help, doing her a favor so she wasn't charged a disposal fee, renting a vehicle to get it all in one load and doing it all labor free. Youll see how I was actively engaged in conversation (attachments 1&2) the whole time we were loading her items and she waited until I was all done loading to tell me she wasn't going to be charged by the warehouse, which is weird because the owner of the warehouse was in the warehouse the whole time with us, it was raining outside, and never once was he on the phone with anyone.

When she told me she was going to be charged a disposal fee by the warehouse I told her I would empty out the warehouse & not charge her a *****. Never once did she tell me she expected to be paid. It wasn't until I told her I was going to take everything to an auction and drop it off did she ask if she was going to be compensated for her stock.

This is what didn't make since to me, is first she was ok with being charged to throw it all away, then she seemed ok with letting me foot the bill to keep her from being charged, but then once she realized I was going to sell the items she wanted in on the proceeds. I just decided to deduct my labor and rental fee and give her the remaining money made. At this point I don't really care about the money.

    * Time frame - my sale ended on 5/19/2024. I got the partial payment on 6/15/24 after numerous attempt to contact the owner of Brick Road Estate Sales & CleanOut Specialists. *

******: Communication: The owner treated me poorly and was uncooperative.

BR: I did not treat her poorly, all our communication was done by text messaging so you will see I was not and I tried to cooperate the whole time.

******: I could not reach the owner for weeks and eventually I resorted to finding her at an estate sale she held in ********

BR: IT WAS NOT WEEKS I tried to meet in 6/5, she told me she was out of town 6/6 & 6/7, next business day was 6/10 she showed up to my sale on 6/14, This was rude and disrespectful to do at a place if business, there was many other ways to handle the situation. I have text messages that substantiate my defence! Please refer to attachments 1-5, total of 10 screen shots of our communication.

I am the administrator of my later uncle's estate. I entered into a contract with this business mid-May pursuant to which the owner, ***********************, was to pick up the household goods at the decedent's house to sell at her location. She picked up some of the goods on or about May 17th. She has yet to inventory the items properly, advertise a sale, report the results to the estate and provide the estate its share of the proceeds, along with any receipts for the remaining donated items. I have called and emailed numerous times. Others in the Olympia area have done the same on my behalf since I am in ************. Only one response thus far. I just want her to do the work that she agreed to do. I have an estate to settle and had relied on her to handle this aspect of estate settlement process professionally. If the BBB is not able to encourage this business owner to fulfill her responsibility I will be left with no alternative but to take legal action- which I would like to avoid. However, I am out of time and patience. The estate inheritance tax return must be filed by November.

I hired Brick Road Estate Sales to conduct the sale at my home. The sale was 6/16/23-6/17/23. We had agreed she would remove all items that were not sold after the sale at an additioal cost. She told me it would take 2 days. It is now 7/1/23 and the house has not been cleaned out, there is furniture leaning against the front of the garage, trash in the front of the house, empty boxes and junk on the front porch. I have received no payment of any kind for all the items sold. She sent me an email with an attachment that had 9 items listed and totals for the sale that have no supporting information. I requested an explanation for the numbers, (including $800 for hauling away items left after sale) and have received no response from her. I have called, texted, emailed and she refuses to communicate and has not provided any payment.

In Apr 2022, my sister and I interviewed several estate sales business in the ******* ** area to find a business to handle an estate sale for my fathers property located in his former home in ***** **. My father(*****************************) relocated to Virginia, and with no family in the area, we needed a business that we could trust to handle the sale. After meeting twice with Brick Roads Estate Sales and Liquidation LLC owner ***, we agreed to have her handle the sale of my father's estate (contract attached). We agreed on sale date of ***** May conducted at my fathers ***** home. *** and I communicated regularly prior to the sale, including verbally agreeing to extend the sale an additional day (16 May). After the sale, I confirmed with *** that they would have the house cleared NLT 19 May to enable contract work to begin to prep the house for sale. She agreed but indicated she needed more time to clear out an adjoining shed and the garage, which I verbally approved. In June, I began inquiring about status of the sale and any payments, which were to be provided 10 days after the sale. I received no responses to any inquiries. Finally on 26 Jun, in response to a text message, ***'s mother (****), notified me that *** had been hospitalized. This explain the lack of communication. **** indicated she had reviewed our estate sale file, and that she (****) would send payment for our sale proceeds of $858.52 . She confirmed the mailing address and also sent a spreadsheet identifying gross sale amounts and costs (attached). In Late Jul I reached out to Brick Roads to get an update about payment. Despite numerous messages, I received no updates. Finally on 16 Aug, *** responded via text indicating she was still getting caught up, but would mail payment tomorrow (17 Aug). To date no payment has been received and there has been no reply to the multiple messages left asking for an update.Would like assistance having our payment sent ASAP with receipts per the contract.
