On April 6, 2023 we signed a contract with ***************** of All American Construction.to remove and rebuild 2 decks, remove and repair damaged siding around the decks and remove 3 trees which were in the way. We paid him ***** dollars down. The following week he told us he was not going to to part of the contract, remove the trees, which was approximately **** dollars. Furthermore he said he didnt build in enough money to do the job to begin with and wanted more money. At this point he had done absolutely nothing on the deck or siding. After several contentious texts and phone calls in which he was extremely abusive and threatening he blocked all communication. Prior to that we went in to apply for building permits but were told we needed additional information from the contractor. However, since he blocked communication, we were unable to get the information. Two weeks later we got a letter from his attorney saying since we didnt get the permits the contract was considered terminated. We then contacted council to see what our options were. He drafted a letter requesting the return of our down payment of *****.00. ************ said he spent the money on materials but we could have the materials he bought. We then requested receipts which ************ refused to provide. To this date we have no evidence ************ actually purchased any materials. We then attempted mediation but ************ refused all potential dates saying the mediator which ************ chose from a list was biased. Issue is still unresolved. We have since been told that ************ has a history of bullying clients. We had to hire another contractor to do the job since the decks and damaged siding were allowing water to get into the house.Business Response

I am rejecting this response because:
I have a letter from the businesss attorney stating the contract is terminated due to failure to obtain building permits and I have a statement from the business that he was blocking all communication so I was unable to get the information needed to obtain the permits. The business refused to provide receipt for materials supposedly purchased.Sincerely,

I can assure you that All American Construction LLC does not engage in any of the activities described in complaint and always is respectful to the highest degree with all customers. In all of our contracts since the inception of our business there is a Intellectual Property clause ( ie ), non disclosure agreement ownership being All American Construction LLC exclusively, and for any customer having to get permission from ********************** to divulge any information related to the Contract. Facts can be misconstrued, twisted, ****** picked, half truths, deception, and just plain lies. All American Construction LLC obeys all laws and follows rules and regulations at State, County, and Federal levels. We also install a stipulation into all contracts that we are not responsible for building permits if needed, and that this responsibility is on the customer.
As in some cases there are good Contractors and not so good, as in some cases good customers and not so good, this is the now normal a unsettling fact we all live with. We have always done our best work and maintain an excellent reputation for work done. We maintain and opened ended line of communication for customers with Texts, email, and stipulation in contract by mail, which we can't control. We have a mandatory mediation clause in all of our contracts which is in place to settle any differences that *** occur, but some customers *** opt out of this step and go straight to law suit or media outlets to wage their complaint. Though this would be a violation and breach of the agreement, some people still ignore these steps, like building permits, contract obligation and just being honest.
I would imagine that any good company would keep all records of conversations, texts, emails, letters, and contracts if ever needed. We are always committed to resolve any dispute if it is possible. Sometimes though, the person making the most noise is the person also perpetrating the wrong or injustice. We still try and continue to try to repair and make better the world we all live in.

I am rejecting this response because: AACs response was simply denial followed by accolades for the business. In reality AAC has had 3 complaints lodged against it, including this one, in the last 3 years. They have also had their bond sued a number of times.These complaints echo my own in many ways. AAC took my deposit and after the check cleared immediately began changing what they agreed to do and actually refusing to do some of the things agreed to in the contract. They stated they didnt build enough money in to do what they agreed to do and wanted more. When I disagreed they became extremely verbally aggressive, threatening and intimidating and then terminated the contract. No materials or work on the house was ever provided. This follows the pattern expressed in other complaints. AAC maintains they keep perfect records but when documentation and receipts were requested none were available. AAC came to my house and verbally abused me and my wife. They also verbally abused us over the phone which is why I had to request he not show up to my house until we had some issues resolved. We were still working on that when we got the letter terminating the contract and saying the deposit had been spent. The letter stated the reason for termination was building permits were not obtained, however AAC refused to provide the information we needed to apply for the permit. I believe AAC entered into this contract and realized they were not qualified to do the work and so looked for a way out without returning the deposits. I base this on comments AAC made to me regarding taking out the trees was too dangerous for him and not being used to working on a deck more than a few feet off the ground. I did not research this company before signing the contract. That mistake cost me ***** dollars and a lot of stress and I have nothing to show for it.

Please forward this material to appropiate people showing that *********************** has been not revealing the actual facts and has frustrated the process of fulfilling the contract and engage in any meaningful dialogue of settlement. You can also see that there is a IP Non disclosure clause in all of our contracts which mean simply any and all contents belong to All American Construction LLC.
You can also see that this effort went on for months and when he was suppose to have a mediation time set and he hired another Contractor and started working on his house without a permit. Pictures don't lie.
We have copies of everything Texts, Attorney letters, and original demand letter.
This by itself is material breach and enough, He was the one that used F U to me me on a phone call twice and than I went to texts. Never was I disrespectful or rude just informative.

Our official response to all of Claims waged against All American Construction LLC by *********************** are false. The proof we have provided through documents, texts, and pictures show that *********************** is on a malicious campaign to Disparage and defame All American Construction LLC. We maintain a firm foundation in the Laws and regulations of this great ****************** ignores the laws, like a building permit while expecting us to work without one. Changes the structure of the contract by breaking his lawful signature by ********* said contract and demanding a full refund weeks after committing to it. No just cause just because he is mad and having a melt down. If this is printed on the BBB website it is done without our expressed permission from All American Construction LLC owner and author of all IP property, and will be subject to penalties, fines, damages, for Defamation & Disparagement.
We hope that we can reach a compromise soon, or we will consider all options.
