Please be advised that the Company is an economic arm and instrumentality of the *************************** Mole Lake Band of Lake Superiod Chippewa, a federally recognized sovereign Indian nation (the Tribe) that adheres to federal consumer finance laws and operates within the boundaries of the Tribal land.The Company was established and licensed and is operating under the jurisdiction and laws of the Tribe and its operations are required to comply with Tribal and Federal consumer protection laws, and not subject to the jurisdiction or laws of any state. To that end, the Tribe maintains its own mechanisms and procedures for handling consumer complaints and otherwise ensuring compliance with applicable law. Nothing in this communication should be construed as a waiver of the Tribes sovereign immunity, all of which is expressly preserved.
The loan agreement terms and conditions contained all appropriate disclosures, including but not limited to the Truth-in-Lending Act (****) disclosures, as well as cancellation and the dispute resolution procedures. The **** disclosures clearly state the Amount Financed, Annual Percentage Rate, and Finance Charge,along with Total of Payments.
It is the Companys policy that all customer complaints be handled in a prompt and fair manner. We have reviewed the consumers complaint. The Company will cease and desist from further communication with the consumer. The consumers prior authorization for ACH payment and voluntary wage assignment has been revoked. The consumers phone number will be put on the Companys internal Do-No-Call list, and the consumer will be opted out of future marketing email.

I have used this company a few times in the past and comes to find out after speaking with my uncle who is Lawyer that works for a nationwide firm. He told me that it is illegal for tribal loans to offer there service in **. I needed to buy my mother's medication and this company preys on the vulnerable. My uncles firm is in the process of filling a class action lawsuit against tribal loan companies that prey on clients in states where tribal high interest loans are illegal. Blue mountain loans is not listed in the suit yet unless I want to sue and to be a part of it, I'd rather just get the high immoral interest I paid back to me. I need the money back for my mother's medication. I hope we can come to a compromise.Business response

For your reference, details of the offer I reviewed appear. There has been lawsuits recently which I tried to include in this attachment but it wouldn't let me. Here is the link ***************************************************************************************** I didn't want to be involved with my uncles law firm class action suit against tribal lenders who charge people in states high interest when it's illegal. I am left with no choice if I am not returned the illegal high interest that I have paid thus far. Thank you.

On 07/05/2024 I took out a loan with Post Lake Lending for $600. Since then, I have already paid back $844.60 which is well over the amount that I borrowed. I reached out to my attorney as i was starting to get concerned that the loan was a bit unethical as I still had quite a few payments left and the constant payments have made life extremely difficult. I was informed that the loan I was given came with a ******% interest rate, which may be in violation of Colorados usury laws. This type of lending is both shocking and unjust. I am requesting an immediate and thorough investigation of my account information, as I feel that the amount that I have paid back already is substantial and adequate. If this goes unresolved, I will be forced to reach out to my attorney further to protect my rights as a US citizen. Any assistance from the BBB in resolving this issue in compliance with state and federal law would be much appreciated.Business response

In 2022, I obtained a loan from Post Lake Lending with a principal amount of $1,700. Over the past two years, I have faithfully paid a total of $8,840 towards this loan without missing a single payment. Despite this, I still have an outstanding balance of $1,065, which is both shocking and frustrating.I feel that I was severely misled and taken advantage of regarding the payment structure and the loan's end date if all payments were made on time. The terms were not clearly disclosed, and I was led to believe that I would have my loan paid off within a reasonable period, given my consistent payments. Unfortunately, this has not been the case.I have made multiple attempts to resolve this issue with Post Lake Lendings customer support, but each time, my concerns were dismissed or inadequately addressed. It has been extremely difficult to work with their support team, who have shown little regard for the financial strain this has caused me.Upon consulting with my attorney, I was informed that the interest rates I have been charged may significantly exceed Kentuckys usury laws, which cap interest rates at 36% for non-bank consumer loans under $3,000. This raises serious legal and ethical concerns about the practices employed by Post Lake Lending.I am formally requesting an immediate and thorough review of my loan account. If this matter is not resolved in a timely manner, I will be left with no choice but to pursue legal action to protect my rights.I urge the Better Business Bureau to investigate this matter and assist in reaching a resolution that is just and in compliance with federal and state laws. I hope that by bringing this complaint forward, others may be spared from similar experiences.Business response

I tried reaching out. I send multiple emails one was received. I was attempting to try to settle but looking at the reviews it seems like you dont answer people back. Im still waiting. I agreed on lowering the payments and paying every single week was too much. Then when I did talk to you, you were rude until I got to a manager which took forever. You have no customer service. This loan was the worst choice Id ever made. A 750$ loan to pay out to almost 3400$ is not worth it especially when you cant talk to people that understand what youre saying.Business response

Took out a loan on 1/25/2024 without realizing the illegal high amount they charge. Have made almost $5000 in payments on a loan of 1500 and would have to pay tons more to complete. This is an illegal loan and unacceptable, I have paid more than triple the loan amount already. Now the website doesnt even work. This does not seem fair or legitamate. I will have have to go homeless over this if not resolved.Business response

On 6/21/24, I was encountered by post lake lending by message and of course I thought that it wouldve been a good idea to use the loan because Im in need of help. Surely I applied and got the loan for $425 with a hefty loan interest. Sure enough, I lost my job and here I am on my last leg trying to pay off the loan with no money and Im not capable of making these payments at all let alone keep the loan. Im in a very tight spot and on brink of losing my place due to this loan. Please help me. I can barely afford what I have now and paying off this loan is definitely too much. I am in very much need of help. I cant afford the loan payments let alone the interest. It is absurd amount of interest.Business response

I try to contact the company and I get nothing, their website is marked unsafe and seems i cant get throught that. 05/2024 Did a loan for another company. Was told I would get a decision after underwriting reviewed the application. Saw a deposit figured it went through not noticing Post Oak Lending. Called and asked for the application and no signature just typing. $722.00 a month since 05/31 for a ******* loan made me look because that was not my payback amount at all from other lender.Business response

I tried to get an 800$ loan then called back **************************************************************************************************************** multiple times they would deny the loan on recorded phone call then after two weeks my account said they processed the transaction after them telling us they would cancel it and deny us . When we logged into our account to check over half the money was taken out by bills and things that charge our card .. we finally had called them and gotten through to them to try to make an agreement that we could pay it back in multiple payments such as $200-$400 every month without charging us the extra $250 per month since they were the ones that messed up on there end considering they said multiple times they will deny it and solve our problem and they did not.. but instead they argued with us for hours tried saying we had to pay it back the next day and then proceeded to try to tell us we had to pay the finance fee I finally got them to agree on no finance fee but theyre saying we cannot make the agreement to pay it back in payments that we have to pay it in full on the first of August . I feel since it was there end the mess up that they should come to some agreement with us to solve the problem . Considering we said we could not afford it and didnt want itBusiness response
