We build spec homes we are grateful for our many customers and our great rating with this agency. Around March of *********************************** about purchasing a spec home we were building. The home was in the process of construction. We wrote a contract with the buyers for them to purchase my spec home with a detailed outline of all things to be used in the home. The buyer was aloud to pick out cabinet knobs, lighting and flooring color not product for the home to there taste. In May just before closing they asked to Finish the basement and were given one month to complete the basement. The Thursday before closing an occupancy inspection found a code violation for a handrail being to close to the wall and a 1/4"x 1/4" drill hole in an I joist which the inspector let go on the first inspection but asked for engineering for liability reasons as the buyer had threatened him with reprimand from the state for not doing what he wanted earlier in the project Both of these have been repaired the joist requiring no repair at all. On the Friday before closing we then contacted the lending institution about the issue; the buyers were using an FHA guaranteed loan and unlike other loans occupancy is required to close. We then immediately contacted the buyer to let them know we would not be able to close. We did not have occupancy I asked them to total everything they had into the house in ******* money and other money so we could refund it to  them if they did not wish to purchase the home. As stated at the beginning of the complaint we offered immediately to give them there money back. The week of closing we did have a family vacation planned to ********* my sister that lives in ****** was bringing her son to the main land for Dyslexia summer school and as we don't see each other much it seemed like a great time to take a vacation. The vacation was planned in February when we found out they would be in **********. The house is being completed now that we are home. We have no intention on selling the home for more  money other than the increased cost of what we paid the complainant to cover cost we incurred.  We are sorry things didn't work out with this couple and truly wish them the best. Attached you will find a release given to us from the potential buyers from the date of closing. Multiply times while building this home as a spec home we were threatened by the buyers with both legal action for not doing what they wanted instead of what was stated on the contract. They yelled at the Trim ********* at which time their poor behavior and rude treatment toward the people and contractors involved got them asked to leave the property. They were referred to as the crazy's by there banker.

We were brought in on there family life multiply times when the buyers husband was caught, according to his wife being un faithful, then tried to use this as an excuse to back out of the deal multiple times. That is definitely something we did not sign up for when they offered to purchase my home. Sometimes you have to chalk things up to lessoned learned and stay away from toxic people. They were allowed to purchase this home it was there decision for it to not successfully happen. They were well aware that this is a spec home and not a custom home from the begging. We were being kind enough to let them chose a few things and ended up here.

The borrower did call the potential buyers the crazy's and told me they to had stopped talking to one of the buyers because of his crazy behavior. We are not in cahoots with any building officials from the county. The buyers voluntarily walked away from the sale. I had signed the deed prior to leaving on vacation so they could close while I was gone if they wanted to proceed with the sale. We offered them there money back.  The price of the home will be increased to cover the additional costs that are incurred which include my time writing this email. As I said before we are sorry it didn't work out. We paid the buyers there money as they asked in the complaint. They voluntarily walked away they could have purchased the home they decided not to.

The buyers requested there money back ASAP we provided it as well as extra. The buyers voluntarily left the purchase contract. The last response says that as of today the house has still not passed occupancy the occupancy letter is dated 7/14/22 today is 7/18/22 this statement is false. In the event that a joist repair came back and occupancy was available to the homeowners before I returned, I signed the deed so they could close without me present. Please contact ********************* for verification of that fact. We forgot to address another accusation that we sent the appraiser away. I never spoke to the appraiser on site nor was I present while he was there.  We did not jump ship. We did not go bankrupt. We did do everything we could to attempt to sell them the home including an email that states "if you choose to not purchase the home" which was shared with the title company as well. The buyers voluntarily left the home and signed off there opportunity to purchase it for the price negotiated. We did fail to get occupancy before closing as these are the first buyers we have dealt with that were using an FHA loan we did not know of this requirement. When we found out we couldn't close we immediately contacted the buyer offered to give them the money back and gave them the option to purchase the home. The buyers walked away from the purchase they could have made.  *** Jensen

he blatantly lied to you he told you in a previous email that he wasnt even going to sell the house for that much more money than the 301 that he sold it to ***** and I for and all of a sudden its on the market today for ******* so I think $53,000 is a little bit more money dont you think ***** than what he sold it to me and ***** for the title company manager ***** the manager specifically told me that we could not close unless *** Jensen was there to sign and close the same day and time as ***** and I and why would he sign off on the deed knowing that the appraisal was never done and the inspection failed  and a week later all of a sudden it doesnt need any repair  it doesnt need anything done to it and theres no work no problems how does the inspector for the house fail it for safety code and then all of a sudden there no problems with it and he does too know about the appraisal hes the one that has to coordinate the date with the appraisal company and it was scheduled for Tuesday, June 21 and he specifically told them not to appraise it because the basement carpet wasnt laid yet thats exactly what he told him
