A concrete driver ran into my four to five year old rain gutter after he was explicitly told not to drive any further ahead. He was stopped by me and I personally told him not to drive any further ahead as he was about 6 in from the rain gutter. Nothing could be gained to drive ahead because we had to use a wheelbarrow to get concrete to the back of the garage. When my coworker signaled for more concrete as he was about 10 ft in the garage and I have a 4-ft overhang before the garage floor the driver drove a head into the rain gutter. The driver told his boss he was signaled to drive ahead which is not true because we did not talk about a signal to drive ahead because there was no reason to drive ahead because he was 6 in from a rain gutter. The driver told ******************* his boss that a guy in concrete boots with a concrete rake spreading concrete around was the spotter which is very stupid because there's no way he could see the rain gutter from inside a garage and he's 14 ft away from the rain gutter approximately. ******************* of American materials has contacted me with emails and agreed over the phone to pay half of the cost of the rain gutter and told me to get estimates. After I gave him three estimates with the lowest one being about $3,000 he said he would only pay $500 and he will not return my emails when I said I would like to try to work this out and I would accept $1,250. I feel they should pay for the entire ring gutter because they are at 100% fault. When I asked the driver what he did he just shook his head and put his hands up in the air and didn't say anything acting like he screwed up. He did not say anything about a spotter told him to drive ahead. As I said before I personally told him not to drive any further ahead, my coworker will testify that he just signaled him for more concrete and not to drive, as we had not talked about signals to drive ahead because he couldn't I hope you can help me resolve this, thanks.
