I have been paying off a loan of $1000 for the last 11 months at ****** a month. I called and was told that I would not finish off paying the loan until January 2025 totaling up to $4000. So I took out a $600 loan with Loan At Last unaware of a 660% APR, making the loan payoff over $3,000. Its absolutely highway robber & should not be allowed regardless of tribal immunity. That should not be an excuse nor a loophole to go and **** customers of their money. ******************** should be held accountable to the fullest extent of the law and should immediately be shut down and not allowed to operate.Business Response

I logged in on the website and it specifically said 1550 for the loan payoff. I attempted to pay today and was charged 1667 and im extremely upset. The website should have never said that amount because thats what I was expecting to pay. I have been a customer with ********************** since September 2022. I have paid off a couple of loans in the past. Around august 2023 I was going through a hardship and the company settled the loan with $50.00. I took out another loan and I was approved for $1,000 the payments were $110.00 weekly I reached out in September and asked if I can change my frequency to bi weekly. I started to pay $224.00 every two weeks and then I ended up lowering my payments to $115.02 I ended up making two payments so far. Loan at last ended up extended my loan for 60 days I began paying March 22,2024 I was able to make two payments on April 19th I asked if my payment can be deferred to the end of the loan term due to a hardship which was done I reached out a week prior to see if my payment can be rescheduled the agent who i spoke to rescheduled it for May 16th and May 17th. I thought my finances would improve but my expenses have increased and I am on a fixed income. I reached out on May 14th,2024 and I spoke with an agent named **** via live chat and I explained the situation to her and she told me that unfortunately the skip a payment option has been used and the payment has been scheduled she offered to schedule me a call back to discuss other options she told me that there are other options available and that they might lower the payments. **** scheduled the call back for Wednesday May 15th at 10am I was up early and I did not receive a call back to discuss options and now I am in a bind. I am on a fixed income and Im barely getting by. I would like to have these payments lowered or settled the account for what has been paid because it is causing me to be tight with finances and Im struggling to make ends meet. Loan at Last is a "tribal lender" that is not a licensed/legal lender in my state, IN, which they were aware of when the loan was issued. They are charging a usury amount of interest based on Indiana's laws. I have revoked any and all ach authorization once this was brought to my attention.Loan at Last is operating under the *** de ******** Band of Lake Superior Chippewa Indians, which is a recognized tribe, however, they are doing business under another LLC, which is not associated with this tribe in order to illegally offer payday loans as a tribal lender.Because they are not licensed in my state, and are operating illegally, my contract is null and void.Business Response

I have reviewed the response made by the business in reference to complaint ID 21645177 and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Unfortunately, I am not a member of your tribe, and I have never visited your reservation. I am not subject to your laws. Period. The laws of my state prevail and as such, the contract I signed is null and void as you are charging a usury rate of interest. I will pay back principal only.
It is irrelevant that you are governed by the laws of the *** du ******** Band of Lake Superior Chippewa Indians. You are located in ********* and are a tribal lender, who is not licensed in *******. The loan agreement may be valid under the laws of the *** du ******** Band of Lake Superior Chippewa Indians, but it is not valid under the laws of Indiana, where I reside. My address was listed on the loan application when I applied, so Loan at Last is well aware of where I live and knew it was illegal to lend to me in the first place. Tribal lenders are still required to comply with state lending regulations.

D. Indiana 44. In *******, with limited exceptions, any entity that makes consumer loans is required to have a license to make such loans in *******. Indiana Code 24-4.5-3-502. A separate license is required for making small loans of less than $550. Id. I took a loan out with Loan at Last for $1000 with 27 bi weekly payments of $124.42 at ******% with total finance charge of $2,179.41 for a total payment amount of $3,359.63, Ive already paid $995.36 on this account. Well I did a loan for 1200$ and my payments were like 321$ every 2 weeks. And when it came time to pay for the payment I didnt have the amount of money on my account and they charged it anyways. And put me in the hole -169$ so now Im screwed for like 3 weeks until I get paid again and I contacted customer service and they told me that I should have read the terms and conditions and blah blah blah. I wasnt thinking of that at the time I was worried my water was going to get cut off. And they wouldnt give me back the money they took because its already processing so they cant its not even processed all the way on my bank account. Would not help me at all. Only thing they did for me was change it to where the payments werent automatic. And I didnt even have that option when I first signed up for this loan it should have been offered.Business Response

The Company is a wholly owned and operated subsidiary of LDF Holdings, LLC (LDF
Holdings). LDF Holdings is a wholly owned and operated subsidiary of the ******************************************* which is a wholly owned and operated economic arm and
instrumentality of the Tribe. The Tribe is a federally recognized Indian tribe, organized under a
Constitution pursuant to the Indian Reorganization Act of ****, 48 *************************, et

accurately and clearly reflected in the loan agreement that the customer signed before receiving
the loan. The customer also received a TILA disclosure that outlined the amount and date of each
payment required under the loan agreement. Due to its immunity, the loan is not subject to state
law and the Company is not required to be licensed with any state. The customers loan is legal.
The customer agreed to the Terms and Conditions of this loan on 01/17/2023 and a TILA
disclosure was included in the loan agreement that the customer signed. The customer chose the

I acquired a payday installment loan from Loan at Last on 09/01/2022 with an effective date of 09/02/2022 for the amount of $1974.15. My payments are bi-weekly for $325.26. The amortization schedule does not list or show how the payments towards the loan are distributed (what amount goes towards principal, interest, and/or fees.) No statements are made available, so I am unsure what they are really doing with the money. I say this because I checked my payoff amount in the first week of December 2022 and the payoff amount was $2042.06. I looked online today, 02/02/2022 and called to confirm my payoff amount as of today, which is $2052.96. I am very concerned because how is my payoff amount today higher than it was in the beginning of December, when they received three payments in December and two payments in January, which were all on time as the payments are setup for automatic withdrawal. The rep could not provide me a statement of sort and only stated that interest rates are compounded daily. At this point, this company is operating under bad practices. In the *****************(which is where I reside and resided at the time of the loan) they prohibit payday lending from any and all vendors, as they deemed illegal. If the APR is above 33% they are violating the law and operating unlawfully. At this point I am requesting a full resolution of having this loan (outstanding balance) be dismissed.Business Response

In response to customers complaint, it is a standard practice for businesses to charge
interest for their products and services. The payoff amount is the sum of the principal amount due
on the loan plus the finance charges accrued up to the date of the prepayment. The customer can
pay off the loan at any time to save on interest charges. The Customer received a TILA disclosure
which included their payment schedule. For an amortization schedule, the customer should contact
our **************** and a representative can assist with providing an amortization schedule.
