      I traveled to ******* wisconsin on February 15th to buy a car after i was approved for a loan. (which is 2 & a half hours away from where i live) The car was $14,894. Test drove the car and everything seemed fine until i was driving home, i noticed my car was vibrating. I didnt know what it was and didnt know if it was the road. i texted the dealer and asked him when he changed the oil last. turns out he never changed it. brought it to a mechanic to have him change the oil, see what the vibration is and check over the car in general. On February 21st, the mechanic said he had to change the oil, replace air and cabin filters, add fuel cleaner and replace spark plugs. he also proceeded to tell me my drivers shaft is rusted out and loose which he thought at the time, that was the reason for the vibration. i got that fixed which was another $350 on March 2nd. i texted the dealer i bought my car from & he denied that it was ever rusted or anything wrong with the car in general. and he refuses to answer any of my messages. I got my car back after getting it fixed to realize that my car is still vibrating. so i bring it back to my mechanic and he tells me that there is something wrong with my transmission. a transmission shudder. i can change the fluid, replace torque converter or just get a brand new transmission. i even brought it to a another mechanic to get a second opinion. the second mechanic called the dealer and they didnt answer. i bought this car and was not disclosed any of the issues that this car had and the dealer will not answer me. The dealer also said he brought the car to ****** for inspection but completely lied about taking it there and refuses to show paperwork from ******.

      To Whom It May ********
      In response to the complaint received by your department from **************************;
      *************** did, in fact, purchase a vehicle from my dealership. The vehicle was a 2014 ****** Rav 4. The vehicle was purchased by the dealership, on January 12, 2023,from ******************************. This vehicle was test-driven by me before purchase. I drove the vehicle for approximately 20 minutes, reaching speeds of 70 mph, which is the highest legal speed limit, and the speed I am required to test the vehicle to.  Please note, my dealership does not purchase vehicles for resale that have any indication of moderate to severe mechanical issues. If there were any indication at the time of my personal test drive of mechanical issues, failures, etc. I would not have followed through with the purchase. Everything checked out, besides an indicator light that was illuminated on the dash. This light indicated a minor issue with the tire pressure sensors. This was a minor issue and easily remedied, so the vehicle was purchased.
      During the time the vehicle was in possession of the dealership, there was no vibration as indicated in ***************** complaint. My assistant, who drove the vehicle from auction to the dealership, did not mention any type of vibration or any other indication something was not working properly the entire way home.Being as this was a 3 hour drive, any issue(s) would have become apparent during this time.  None did.
      I personally replaced the faulty tire pressure sensors with new sensors once on the lot. Since this is considered a safety function, the vehicle needed to be reset by the manufacturer for the indicator light to go off. This was done by **************** on 02/09/2023. There was also a basic diagnostics test completed as part of this service. The receipt for this is attached as well. As you can see, there were no other issues reported by the manufacturer.
      After being serviced at ****************, the vehicle was thoroughly inspected by me again, adhering to the requirements of the state of Wisconsin, to ensure the problem had been resolved. The issue and indicator light were both no longer present. This is clearly indicated by the attached buyers guide, which was filled out accurately and completely and was visible in the window of the vehicle the entire time it was on our lot. A copy was also given to and signed by *************** signifying she received it and reviewed it. Again, this was just a tire pressure sensor issue. This type of issue only causes a light to appear on the dash letting you know of the issue. It does not cause any type of mechanical issue.
      *************** arrived for her scheduled test-drive of the vehicle, after inquiring about it the day prior. She test drove the vehicle for approximately 10 minutes. She returned happy with the vehicle and ready to purchase. She was asked if she had any questions about the vehicle and if she was happy with the way it drove, ran, felt, etc. She stated that she did not have any questions and that it was to her satisfaction.
      *************** contacted me by phone the day after her purchase, which was completed on 2/15/2023. She stated that there was a vibration she was feeling and that the mechanic, for whom she refused to provide any credentials for, stated that the drive shaft was completely rusted off. I replied that the drive shaft was indeed fully intact and in working order at the time of sale, but if she wanted to bring the vehicle back to us, we would be happy to attempt to recreate what she was feeling and diagnosis what, if anything needed to be repaired. We cannot accurately diagnosis or repair any issue on a vehicle without seeing, hearing or feeling it. *************** was informed that since the vehicle was purchased with no warranty, manufacturers or otherwise, and was sold As-Is this was clearly explained verbally at the time of sale and acknowledged and agreed to by ***************, shown by her signature on the attached As-Is agreement/notice. Since my dealership does not offer any warranty services unless purchased by the customer through one of our in-house lenders, all our vehicles are sold this way.
      Regarding ***************** claim that the diagnostic test was a lie, please see the attached receipt of said diagnostic testing. This receipt was not requested by ***************, but rather an unidentified person stating she was her aunt, through a texting link on our website. I advised I would need an email address to send that to but never received one.  *************** did not provide one on any of her correspondence either, as I would have just sent it directly to her had I had one on file.
      I have provided sufficient evidence that the vehicle in question was in satisfactory mechanical condition at the time of this sale both by my determination and ***************** at the time of sale. ***************** claims seem to be made from anger and frustration and as proven by the enclosed documents, have no truth to them.  
      Though I sympathize with ***************, the alleged issue was not present at the time of my purchasing the vehicle, at the time of my inspection, at the time of the testing done by ******, or at the time of sale. The vehicle was sold as-is and we are not required to fix, repair, or replace anything as the issue is not due to fault of the dealership nor oversight of the dealership.
      We,as a dealership, cannot predict if or when anything will happen to the vehicles we sell in the future. The best we are capable of is inspecting it fully, using the proper diagnostic testing equipment and repairing anything discovered that needs repair during this inspection.
      In the future, I would suggest *************** approach these matters in a more civilized manner as the slanderous attack on me professionally, as well as personally, by her aunt, or whomever it was that contacted us on ***************** behalf, can have legal repercussions if we were to choose to pursue them for slander. We are not choosing to do that currently but reserve the right to do so. This is a route we are prepared to take if needed.
      *************** has failed to make any claim that has not been proven to be false, nor is there any evidence that we, as the dealer she purchased a used vehicle from,are at fault or liable for the alleged mechanical issues she claims to be experiencing with said vehicle.
      With respect to all evidence stated above, we will not be refunding, replacing, or repairing anything for ***************. She and her aunt have been very rude, disrespectful,demanding and accusatory. We refuse to tolerate that behavior in our establishment.But most importantly, the issue is not due to fault of the dealership. Please see the highlighted portion of the As-Is Agreement signed by ****************
