    On January 11, 2024 I contracted with VIHUSIGA Construction & Landscaping, LLC - ***************************************************, on behalf of my Neighborhood, to plow Our shared Alley in the 3100 ******************************************************************* . The contract was to be from January 11, 2024 to the end of the snowplowing season in April 2024. I'm the Block Captain & coordinated Snow removal in our alley for 17 years & each neighbor reimburses me for their fair share of the payment.****** required the seasonal payment of $1,000 to be paid in full & agreed to plow by 8am after every snowfall of 3 inches or more. (This price was double of what we paid prior contractors for 17 years, but I agreed because ****** guaranteed me that he could plow by 8am). I paid the $1,000 on Thursday, January 11, 2024 to ****** via ***** from my personal account to his Zelle Account. The agreement (via ***** ******** was that he would arrive by 8am after a snowfall to plow the alley so that residence could go to work, Dr. ****** etc. ****** plowed on January 11, 2024, in the afternoon, after I paid him & never showed again for the large & heavy & wet snowfall on ****************** the 12th & 12th, 2024. I called & texted ****** on Saturday, January 13th from 7:44am - 12:50pm requesting a plow! ****** finally responded via text at 1:56pm stating his Employees were supposed to *********** never did. ****** would not provide confirmation if anyone would plow our alley on Saturday, so I ended our contract due to breech of services. I agreed for ****** to keep $150 of the $1,000 I paid, for services on January 11, 2024 & that he would refund $850 via my Zelle Account. ****** agreed due to breach of contract. It is now 1-30-2024 & he is now refusing to refund me the $850 because he stated the $1,000 was for a One time plow. He is attempting to scam ******* neighbors out of $850. Please help obtain my refund of $850.00. I have all text **************************************** via text to evidence my claim. ***

    Below are the messages of the agreement we had on January 12, 2024, when the storm hit ********* and other surrounding areas. On that date, the snow was extremely heavy, I went twice at 9:45 am and 10:00 pm. In the messages, you will see the snowplowing is from December 2023 through April 2024. It snowed I did my job and now she wants a refund. I will also forward the damaging posts she is putting on social media about my business.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    The  Owner-Contractor , ********************* ********* is stating that he plowed on January 12th & 13th, 2024 after the heavy snow fall. However, he nor his employees did not plow on the 12th or 13th on the West Side of our Alley.

    That is why we were forced to hire a new contractor on Saturday, January 13, 2024

    ****** agreed to refund $850 in text & on the phone (see attached text message) see page 20 texts 

    We only receive plowing on Thursday, January 11, 2024 in the afternoon ,  after I paid him the $1,000 to contract for the Snow Season of January - April 2024. 

    My Community agreed to a reduced seasonal plow $1,000 because if was already January 11, 2024 (see page  )

    ****** agreed to the reduce price & I paid ****** via ***** the $1,000 in full (see page 5 & 6)

    I reiterated to ****** that once the snow falls on Friday, January 12th, we expect him to arrive by Saturday Morning by  8am, as agreed to remove the snow so that residents could get out (see page 7 & 8)

    Vicor agreed to arriving at 8am. When the contractor did not show on Saturday morning after many texts & calls, we both agreed that we would end the contract & I would receive a $850 refund for my community.  (see page 20)

    The $850 refund was derived by ****** keeping $150 for the (2 plows he stated his team did on the 11th) 

    I'm requesting a $850 refund due to Breach of Contract due to our snowplowing services were not completed as agreed & we (myself & ******)  both settled on this amount via text.

    I Wish ****** & his Business well, but as a Community Block Captain, I have a fiduciary responsibility to ensure services are performed as agreed. And when services are not rendered, we have a right to a refund due to breach of contract.
