On 8/8/23, *********************** of ************** LLC in *******, ********* mowed my lawn and left a multitude of scratches on my sidewalk. These scratches looked like marks from a riding lawn mower blade. These scratches are definitely permanently in the concrete as they did not rub off or wash off with a day of rain. *********************** also stated he would charge $50 before doing the work and then charged me $100. When pressed for a refund of my money due to the damage to my sidewalk, he blamed me for the damage stating it was due to years of neglect. *********************** would not refund my money whatsoever. I would like a refund of my $100 payment and repair to my sidewalk.

      BBB of *********,

Thank you for notifying me of this complaint.

The scratches ***************************** is referring to are not scratches and they are not from a lawn mower blade. They are string trimmer marks that had removed thatch and debris from the sidewalk. The color in the lines are what the color of the sidewalk should be and are showing through the stains of dirt that was there before I completed the edging performed at a 45 degree angle against the grass. I did not claim the "damage" was from years of neglect, but rather the thatch, dirt, and grass that was overgrowing was from years of neglecting the edge of the sidewalks.

As for an attempt to find a resolution, I mentioned to her that pressure washing the sidewalks would remove the stains from the sidewalk and I offered her to sign up for a pressure washing service, but she refused.

Not only this, but the sidewalks she is referring to are not hers. A police officer confirmed with me that the sidewalks are public property and don't belong to her. Along with that, he mentioned that had I placed a scratch on the sidewalks, it is considered normal wear-and-tear and I am not subjected to any civil or criminal prosecution.

As for the price, on the 7th of August in our initial phone call, I quoted her a starting rate of $50 and if it costs more, I will notify her. ****** responded in understandable manner if the price costs more. I have a recorded phone call of this dialogue.

After the service was completed, I called her on the 9th of August and told her the final price of $105 after sales tax. She accepted the price and sent it to me the next day. Unfortunately my Call Recorder App did not record this phone call. However, why would she send me the payment via Venmo if she did not agree to it?

As for finding a resolution for the price of the service, I was not able to come to any conclusion and I told her I did not find it justifiable to give her a refund for the work done. She then proceeded to call me immature, a liar, and a thief. I told her that I'm sorry that she feels that way and I asked her if there was anything else I could help her with.

I would like to mention that she committed a fraudulent chargeback to the payment she made and I am now being incurred a negative balance of -$105 with *****. I tried to find an amicable resolution by sending her an invoice for the $105 and asking her to pay it within one day. She refused and demanded I "stop harassing her."

I have exhausted all the possible solutions to the balance due and I find that I have no choice but to send her a Demand Letter for the balance due or I will be filing a small claim.

Thank you for taking the time to read my response to this complaint.

If you have any questions or concerns, feel free to reach out to me.

      Best regards,

      Pat's Lawn Care LLC - ******************************* - Sole Proprietor - ************* - ****************************** *****************************************************
