      ************ Service performed service on my vehikle wyth-out my permission, wyth-out notifying me that they performed the work, performed the work against Wizkonsin Administrative Law, performed the work against standard industry prakticez, performed the work against manufakturer rekommendationz, and the work performed kauzed damage to my vehikle that rezulted in my having to kome out of pocket for additional service(at another establishment) to rektify the ir-repairable damage kauzed by ************ Service..Initially, they billed me for follow-up repairz necessary from the damage they kauzed but later re-imbursed me for thoze chargez but only AFTER I brought it to their attention that I bekame aware that they performed the un-authorized service and damaged my vehikle in the process..I have requested through Invoice that ************ Service ***** only the **** for me to repair the damage that they kauzed, az well az filed a Komplaint wyth Kontakt6.. How-ever, ************ Service iz aware that simply ignoring inquiriez by Kontakt6 will rezult in Kontakt6 just going away; and, ************ Service haz virtually ignored the three Invoicez I have sent them thus far.. The only response that I received waz the re-imbursement for the repairz they previously charged me; repairz that failed on un-authorized service that failed..Attached pleaze fynd a PDF of the Invoice that ************ Service receivez from me monthly..       The customer came in with 2 bald tires and a bent rim.  He wanted one of them fixed and he brought his own rim.  We repaired the tire that was bald for the customer with a tire plug even though he did not request a tire plug.  It was later confirmed to be bald by the company that he chose (after the tire plug) to replace the tire.  We refunded his tire repair charge with check #***** on September 9th in the amount of $18.99.  The check was cashed by Mr. ******************** If you have any further questions please call

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      The detailz of the il-legality by ************ Service are ******* and explicitly detailed in the INVOICE submitted to them every Month, a kopy of whych waz attached to the BBB Komplaint..  Now, in their Response to the BBB they admitt to this il-legality..  Az illustrated in the Moonthly INVOICE and pursuant to Wizkonsin Administrative Kode Chapter ATCP ****** "NO SHOP MAY PERFORM ANY REPAIR THAT HAZ NOT BEEN AUTHORIZED BY THE KUSTOMER."..  Additionally, they are in violation of Wizkonsin Administrative Kode Chapter TRANZ 305.30(6) az "NO **** SHALL BE REPAIRED UZING A METHOD NOT REKOMMENDED BY THE **** MANUFAKTURER..."..  Further-more, ************ Service attempts to minimize their il-legality by shifting the blame to "BALD ****Z"..  This iz all-so detailed in the INVOICE and, they are not being truth-full..  How-ever, the tire DYD NOT LOZE AIR PRIOR TO THEIR"REPAIR"..  Additionally, the tread depth left on the tirez waz with-in legal limits..  I here-by re-assert and re-affirm every-thing stated in my original BBB Komplaint az well az that of the INVOICE attached to that Komplaint..  ************ Service damaged my tire beyond repair and funktion and all I am requesting iz kompensation for the re-placement of that tire..

      Eddies Service prides itself on being a family owned and honest repair shop. Regularly, we go out of our way to get our customers back on the road in an effective and safe manner. We have many customers and reviews that can vouch that we time and time again go above and beyond for our customers. ************** has come in a total of about ten times since September 26 in 2020. Showing that he has enjoyed the service we have provided enough to continuously come back for repairs. 


      At ****************** request 6/27/22, **************, ***, put the two customer supplies tires on the two customer supplied rims. We informed ************** that one of the rims he had supplied had a dent in it, which is bad for the tire. The dent in the rim will result in the tire losing air. ************** still wanted us to continue with installing the two tires. On 06/29/22, ************** came back and said that his left rear tire was losing air and going flat. **************** words were rear driver's tire is flat after we put the rim on. Which is stated on his work order (work order number: ******). After informing ************** that his tires are bald and there was a plug previously in the tire that was leaking air, we then performed a tire repair on 06/29/22. 


      We did the tire repair without approval due to the fact that there was a leak in the tire and that is what ************** came in to get repaired. We were under the impression that just going ahead with the $18.99 tire repair would have been beneficial for ************** to get him back on the road. Due to our judgment of not calling ************** about what would fix his tire and instead of just repairing it, we did offer ************** a full refund on the tire repair after his complaint. 


      Stated in **************** complaint on 11/23/2022, he stated that we re-imbursed me (him) for thoze chargez but only AFTER I (he) brought it to their (our) attention. We did refund him for the tire repair to help ease the situation between us and **************. However, our best judgment was to just fix the tire so that he could get back on the road. 


      We issued ******************* a check for the amount of $18.99, which was a full refund for the tire repair we did. We wrote the check on 9/9/2022. The check number was ***** and ************** had cashed the check on 10/11/2022. **************** complaints state that his desired settlement for his issues was a refund, which is what we granted him with. ************** is now demanding that we issue him reimbursement for the cost of two new tires that he went out and purchased on his own. The demanded amount he wants reimbursed is $432 for the tires that he purchased at Richlonns Tire & Service Center. After talking to our attorney, he told us that since we have offered a refund and ************** has cashed it, he has no other legal power to request the reimbursement. 


      In our opinion of the situation, we do not feel that we need to pay ************** for the reimbursement. Our reasoning behind it is that we repaired the tire that was leaking air from a bent rim, which we told him prior to installing his tires. As well as the leak in the tire was from a patch plug previously in the tire, not done by us. The tire more than likely already had a plug replaced elsewhere because the tires he supplied and asked us to install were used. Another reason we feel we are not responsible for the reimbursement is because we have already offered him a full refund for the cost of the tire repair which he was happy enough with because he cashed the check that we sent. 


      We want to please every customer and make sure their car repairs are done in a fast and respectful manner. However in this case all we were willing to do was offer a refund and try to find a solution. After trying to do so with ************** and having little to no response or willingness to cooperate from him, we are not willing or permitted to offer the reimbursement.

      In response to the message I received from the BBB dated ******** regarding the latest tripe from Eddiez Service I offer the following:


      I here-by re-assert and re-affirm az though fully stated here-in the entirety of my original Komplaint, in-******* any and all attach-ments there-to.  sub-mitted to the BBB, az well az my reply of 12142022..


      In their response dated ******** they state the following: Eddiez Service pridez it-self on being a honest repair shop...  How-ever, the following para-graphs go to quite an extant to fabrikate reality and re-write a fiktional narrative that ignorez demonstrable fakts that are established by their own dokumentation..  That behaviour iz FAR from honest..


      Eddiez Service states that I have vyzyted their establish-ment around 10 tymez and thus, they deduce, that I must have en-joyed the service [they] have provided enough to kontinuously kome back for repairz...  The fakt of the matter iz that had ****** Service aktually been honest wyth me about the develop-ments and NOT attempted to avoid responsibility I would probably still be one of their kustomerz..  How-ever, learning of their dis-honesty and re-peated deceptive
      -ness and attempt to ***** up what they had done leave me wyth no option to remain a kustomer of theirz and, I believe, that if their many kustomerz knew of thys incident *************** would certainly sekond thought returning to Eddiez Service..


      In their sekond para-graph, Eddiez Service states that At ****************[sic] request ********, **************, ***, put the two customer supplies[sic] tires on the two customer supplied rims. We informed ************** that one of the rims he had supplied had a dent in it, which is bad for the tire..  The dent in the rim will result in the tire losing air. ************** still wanted us to continue with installing the two tires.       It waz on ********, when my kar waz at Eddiez Service for other work, when I received notice that my rear driverz-syde wheel had a bent rim and warned that if not repaired the tire may loze air; not ********, az they state in para-graph 2..  Until thys point the tire had not been lozing air..  Not long there after iz when I began to experience a slow loss of air from this tire..  I now believe and, the evidence suggests, that this iz the period in which Eddiez Service first installed the tire plug (wyth-out notifying me or acquiring my approval) and then, knowing that the plug would fail, tried to obfuskate by telling me that the rim would be to blame..  Further, knowing that I stay ahead of my preventative maintain-ance, and that I previously spent in the neighbour-hood of $1500.00 at their establish-ment having tirez installed on my truck, that they thought they would get away wyth installing a failing plug by me re-placing the tirez on my kar..  How-ever, they only notifyed me of a bent rim and failed to make any state-ments regarding re-placing my tirez..  Further-more, my tirez, all-though low on tread, were not bald and were still twice the legal limit for tread depth..


      After two months of this tire lozing air, very slowly at first and then gradually to the point of requiring to be filled daily or even multiple timez a day, and believing this to be a rezult of the bent rim, on ******** I purchased for the rear of my kar TWO new rimz to re-place one rim that waz dented..  I purchased two so that both of the rimz would be identikal, even though only one, the driverz syde, needed to be re-placed..  On ******** I delivered to Eddiez Service my kar and the two new rimz for installation on the rear of the vehikle..  Eddiez Service waz to remove from the kar both of the rear wheelz, remove from the rimz the tirez and re-place thoze tirez on to the NEW rimz..  Then install thoze new rimz, tirez mounted, on to the kar..  This waz all done same day and, I received my kar back, same day..  The two rimz that I supplyed to Eddiez Service were not damaged and neither of them had any dents in them, az Eddiez Service FALSELY klaimz in para-graph 2 of their response..  Further-more, they go on to falsely klaim that they notifyed me that one of the new rimz waz dented and that I insisted that they kontinue wyth the work order..  This iz utter non-sense and a blatant lie; and, I challenge Eddiez Service to provide the service rekordz that support thys false klaim..


      The following day, ********, I awoke to find the driverz syde tire kompletely flat..  I notifyed Eddiez Service and on ******** returned my kar to them for service..  Later receiving a message that my kar waz ready I returned to Eddiez Service to be told by ******** that the problem waz a bad tire plug uzed to previously repair the tire..  I asserted that I never had any repair work done to my tirez since I purchased them new and that the only establish-ment to service my kar had been Eddiez Service..  ******** stated that they dyd not install the plug and that my *************** $18.99 for the re-placement of the bad plug..  In para-graph 2 of their response, Eddiez Service states that it waz at this tyme that they notifyed me that my tirez were bald and they then performed a tire repair..  This iz false; ********, nor any other reprezentative of Eddiez Service, dyd NOT make any allegationz of bald tirez at this time..  Further-more, it may be asserted that the tire plug installed on ******** iz all-so an un-approved repair; how-ever, when I assert in my komplaint that ****** Service performed service on my kar wyth-out notifying me and wyth-out my approval, I am referring to the installation of that tire plug initially, back on ********..


      There-fore, in their sekond para-graph, the following blatent liez have been established:
      I dyd not supply bent rimz for installation;
      Eddies Service dyd not notify me that I supplyed bent rimz;
      I dyd not insyst that Eddiez Service kontinue wyth the installation of bent rimz;
      Eddiez Service dyd not here allege that my tirez were bald;
      Pursuant to Trans ******(2) Wiz. Adm. **** my tirez were not bald;
      Eddiez Service performed the ******** repair BEFORE informing me of a bad plug;
      The omission of an important fakt that will be detailed in later paragraphs..


      In their response, Eddiez Service openz paragraph one stating what an honest establish-ment they are..  Then, in the very next paragraph and, in only 148 wordz, they manage to spout off the 7 demonstrable and blatant liez cyted above..  Additionally, in their response to the BBB dated ********, Eddiez Service tellz a kompletely dyfferant story, stating that I kame in wanting a bent rim fixed and I brought a rim; not that I brought a bent rim..  I kannot think of a better bill-board for the pride of being family owned and honest than that sekond para-graph, especially when kompaired to their previous state-ments; but wait, THEREZ MORE


      In their third para-graph, Eddiez Service states that We did the tire repair without approval due to the fact that there was a leak in the tire and that is what ************** came in to get repaired. We were under the impression that just going ahead with the $18.99 repair would have been beneficial for ************** to get him back on the road. Due to our judgement of not calling ************** about what would fix his tire and instead of just repairing it, we did offer ************** a full refund on the tire repair after his complaint...  This ENTIRE para-graph iz a blatant lie, az followz!!


      My issue raized regarding the tire repair that waz performed wyth-out my approval koncernz the initial installation of a tire plug on ********; not the re-re-pair of the plug they dyd on ******** whych they state in the first sentence of thys paragraph..  My Komplaint states to the effekt that Eddiez Service performed a repair wyth-out my approval AND wyth-out ever notifying me..  The re-re-pair they performed on ******** waz all-so kondukted wyth-out my approval but, they dyd notify me az they charged me for this work..  Their dis-honesty wyth thys sentence attempts to shift my Komplaint from the origin of the issue to a later event..  The Komplaint I filed iz based on the krimez, plural, kommitted on ******** az my Komplaint iznt only that Eddiez Service installed a plug wyth-out my approval; my Komplaint yz that Eddiez Service installed a plug wyth-out my approval, wyth-out notifying me, in a lokation on the tire NOT ALLOWED by the tire manufakturer (probably not allowed by any tire manufakturer!) nor the industry standardz and rulez regarding this repair, that destroyed my tire beyond repair, initially lying about performing this work, kreating a dangerous situation for me, and refuzing to akcept the responsibility of their aktionz and re-imburseme for the pre-mature re-placement of two of my tirez..


      Additionally, the latter part of the fyrst sentence states that there was a leak in the tire and that is what ************** came in to get repaired.; this iz all-so a deceptiver state-ment, if not an out-ryght lie..  I waz told that my bent rim waz kauzing my rear tire to leak..  I replaced both rear rimz and, over-nyght, my rear tire went kompletely flat..  I had no idea what kauzed my tire to go kompletely flat and I took my kar back to Eddiez Service for them to figure out what the problem waz and to korrekt what-ever they had gotten wrong..


      In their sekond sentence of their third paragraph, Eddiez Service states that they went ahead wyth the repair for my benefyt..  What ***************************** failz to mention here iz that this tire plug re-repair all-so later failed wyth-in two weeks..  And, when returning to Eddiez Service for this situation to be addressed on ********, I later received a tele-phone kall from the perpetually un-happy ******** who only then stated that a tire plug will never hold in the lokation where it iz..  Placed on hold, the kall waz then picked up by a Service Technician who stated that the Plug should never have been installed in that lokation, being only a half-inch from the edge of the tire..  (This iz the important fakt omitted from their earlyer paragraph)..  So, by their own wordz, Eddiez Service waz under the impression that just going ahead wyth [an il-legal] tire repair would have been beneficial..  see Trans ******(6) Wiz. Adm. ****..  see all-so the **** Tire Manufakturerz Associationz ******** Repair Procedurez which state that A plug by it-self or a patch by it-self iz an un-akceptable repair...  Additionally, the rulez stipulate that tire repairz must stay wyth-in the central three-quarterz of the tread, known az the minor repair area...


      In their fourth paragraph states that Eddiez Service states that they re-imbursed me for the tire plug repair **** to eaze the situation; pleaze note, how-ever, that ****** Service, knowing full well that they are 100% in the wrong, have never stated that they are wrong despite admitting what they have done and while knowing that what they have done iz im-prpoer and il-legal..  Pleaze all-so note that the phone ************************* stated on ******** that I would receive from ************ NEVER been placed


      In their fyfth paragraph Eddiez Service kontinuez wyth their kornukopia of liez, blatant liez..  They state that my dezired settle-ment for my issuez waz a refund, which iz what [they] granted..  Again, they neglekt to inklude important detailz; that being that their refund only kame after they received my initial Invoice..  They further deliberately in-korrektly state that I am now demanding that [they] issue [me] re-imbursement for the **** of two new tirez..  From the very fyrst Invoice/Komplaint sent to Eddiez Service I have only ever requested three thingz, az ******* stated on Page 10 of the monthly Invoice:
      1) refund of the tire repair of ********;
      2) re-imbursement of 1/2 of the **** to re-place two rear tirez on 07272022;
      3) 2 hourz labour (charged at Eddiez Service hourly rate) for the time I lost wyth Eddiez Service installing multiple tire plugz that failed and ultimately destroyed my tire beyond repair and use, the time I lost having that destroyed tire replaced, the time I spent drafting their initial Invoice..


      Their initial Invoice totaled $474.00..  The math iz $18.oo + $216.00($4322) + $240.00($120 x 2) and they responded wyth a check for $18.99  Never haz Eddiez Service received an Invoice from me in the amount of $432.00..  Note: In their initial Invoice, how-ever, az well az in every subsequent monthly Invoice, (see both Page 10 and Page 11) they were notifyed that every month that their Invoice iz left un-paid would rezult in an additional hour of Labour, at $120.00/hr.(the same hourly rate for Labour az charged by ****** Service) being added to their balance due..  The kurrent balance due on their Invoice iz $935.01..  Interest iz an incentive to motivate one to pay what they owe promptly..


      In their syxth paragraph, Eddiez Service kontinuez lying and even kontradikting them-selvez in two sentencez..  The sekond sentence states that they repaired the tire leaking from a bent rim and the third sentence states that they repaired the tire from a previous tire plug..  In their previous state-ments they ak-knowledge repairing this tire; how-ever, had they aktually repaired the tire it would not have needed additional repairz, nor would they have re-imbursed me for them..  Again, remember that they failed to state that the repair of ******** failed and waz re-re-re-repaired on ********..  In this syxth paragraph they finally klaim that the tire plug waz initially done not by [them] but, this iz a lie az I began experiencing loss of air immediately after Eddiez Service told me I would; how-ever, they falsely stated that it would be from a bent rim and not from the tire plug they il-legally installed on ********..  My re-placing both rear rimz establish this fakt..

      The syxth paragraph addz more komplikated liez to the fairy tale told by ****** Service..  Again they falsely state that I supplyed a bent rim for installation, which I dyd not, and, that they warned me about it leaking, which they dyd not bekauze that never happened..  How-ever, here they all-so kontinue wyth their fourth sentence in which they falsely state that I supplyed to them uzed tirez to install, and that they probably all-readt had a plug in them..  Blatant out-ryght liez!!  When taking my kar to Eddiez Service on ******** I provided two new rimz to be installed on the rear of my kar; I dyd not provide any tirez..  Eddiez Service waz to re-move from my kar the two rear wheelz, then re-move the tirez from thoze rimz and mount thoze tirez on to the two new rimz I supplyed..  They were to balance the tirez and install the new set of rimz mounted wyth the tirez from my kar on-to my kar..  Again, no-thing but lie after demonstrable lie from Eddiez Service..


      I would **** to note that ****** Service, whopridez it-self on being an honest repair shop admits to performing the tire repair wyth-out approval; that doeznt seem very honest to me..  Additionally, this un-approved tire re-pair waz not itemized on any of my Invoicez received from Eddiez Service; that doeznt seem very honest to me..  Further-more, the re-pair waz exekuted in an area of the tire not permitted for such repairz; seemz pretty dis-honest to me..  Konkomitantly, the fakt that the tire needed to be re-paired meanz that the tire waz damaged; and never notifying me that my tire waz damaged certainly doez not seem very honest to me..  In addition, responding to the BBB wyth seven paragraphs of kontinuous lie, even kontradikting their own previous state-ments/responsez to the BBB ******* indikate that Eddiez Service iz not an honest broker..  Further-more, all of theze instancez are enumerated in the Law in the Wizkonsin State Statutes az well az the Wizkonsin Administrative **** az requirments; see Motor Vehikle Repair, Chapter ATCP 132 Wizkonsin Administrative ****, and Standardz For Vehikle Equipment, Chapter TRANZ 305 Wizkonsin Administrative ****:

      ATCP ****** Repair authorization. No shop may per- form any repair that has not been authorized by the customer.
      Note: Customer authorization is required for all repairs, including repairs under $50

      (1) REQUIREMENT. Before a shop starts any repairs a shop representative shall prepare a written repair order that clearly and legibly describes the repairs authorized by the customer.       (2) CUSTOMER COPY. Before a shop starts any repairs a shop representative shall provide the customer with a complete and accurate copy of the repair order under sub. (1) for those repairs,
      (3) REPAIR ORDER CONTENTS. A repair order under sub. (1) shall include all of the following:
      (d) The repair price information required under s. ATCP ******, if any.
      (f) Notice that customer is entitled to inspect or receive any components, parts or accessories replaced or removed by the shop.
      (g) A description of the repairs authorized by the customer.
      (h) The date the repair order is written.
      (i) The signature of a shop representative.

      ATCP ****** Additional authorization. 
      (1) ADDI- TIONAL REPAIRS; AUTHORIZATION REQUIRED. 
      (a) Before a shop starts any additional repairs, beyond those previously authorized by the customer, a shop representative shall contact the customer by telephone or other means, and shall provide the customer with all of the following:
      1. A description of the proposed additional repairs.
      2. A good faith estimate of the price for the proposed additional repairs.
      3. A good faith estimate of the total repair price, including the previously authorized repairs and the additional repairs.
      (b) No shop may perform any additional repairs, beyond those previously authorized by the customer, unless the customer autho- rizes those additional repairs after receiving the information required under par. (a). Authorization may be given by telephone or other means.

      ATCP ****** Repair invoice. A shop shall prepare an invoice covering every repair made by the shop. The shop shall provide the customer with a complete and accurate copy of the repair invoice before the shop returns the customers motor vehicle to the customer. The repair invoice shall clearly and conspicuously disclose all of the following:
      (3) The date on which the repaired motor vehicle, component, part or accessory is tendered back to the customer.
      (7) An itemized description of the labor, parts, components and accessories supplied in connection with the repairs, including items supplied without cost or at reduced cost because of a shop or manufacturers warranty. If units of labor time based on flat rate average time are stated on the invoice, the actual labor time shall also be stated.
      (8) If any item under sub. (7) carries a warranty from the shop or manufacturer, a statement or notation indicating that fact.
      (10) The identity of each person performing the repairs, including the name of any shop that performed all or part of the repairs as a subcontractor. If a shop employs more than 10 repair personnel who work in teams, the repair invoice may specify the name of the team leader whose team performed the repairs, instead of the individuals who performed the repairs, provided the shop keeps records indicating which team members worked on each repair.
      (11) The following statement, printed verbatim: Motor vehicle repair practices are regulated by chapter ATCP 132, ***. Adm. ***** administered by the ****** of ******** Protection, ********* ***** of ************ Trade and ******** Protection, *******************************************- sin 53708-8911.

      ATCP ****** Prohibited practices. 
      (2) No shop may misrepresent any of the following:
      (d) That a repair has been made.


      (4) No shop may:
      (f) Falsify or destroy any document or record required to be produced or kept under this chapter.

      ATCP ****** Repair records. 
      (1) A shop shall keep all of the following repair records:
      (a) The repair order and repair invoice for each repair, including any additional authorization documents.
      (b) Records identifying the individual repair personnel who worked on each repair.
      (c) Invoices for motor vehicle parts, components and accessories purchased by the shop.
      (2) Records under sub. (1) shall be retained for at least 2 years, and shall be made available for inspection and copying by the department upon request.

      Trans ****** Purpose and scope. 
      (1) The purpose of this chapter is to prescribe minimum equipment requirements for vehicles and standards for the equipment used on vehicles.

      Trans ****** Definitions. Words and phrases defined in chs. 340 and 341, Wis. Stats., are used in the same sense in this chapter unless a different definition is specified. In this chapter:
      (41) Tire and rim means the rubber tire and its mounting surface on which the vehicle is suspended. The component parts are defined as follows:
      (a) Bead means the part of the tire which is shaped to fit the rim, made of high-tensile steel wire wrapped and reinforced by the plies.
      (b) Belt means the layer or layers made of fabric or other material located under the tread area.
      (c) Cord means the textile or steel wire strands, or the like, forming the plies or other structure of the tire.
      (********* means the space between 2 tread ribs.
      (e) Major tire groove means the circular grooves where the wear indicator bars are located.
      (f) Ply means the layer of rubber-coated parallel strands or cords forming the tire body.
      (g) Rib means the tread section running around the circumference of the tire.
      (h) Rim means the metal support for tire and tube assembly. Tire beads are seated on the rim.
      (i) Sidewall means the portion of the tire between tread and bead.
      (j) Tread means the portion of the tire that comes in contact with the road.

      Trans ****** Tires and rims. 
      (1) The tires and rims on every vehicle shall be maintained in proper condition and in conformity with this section and s. ******, Stats.
      (2) ********** shall have at least 2/32 inch tread depth in every major tire groove measured at 2 points no less than 15 inches apart.
      (6) No tire shall be repaired using a method not recommended by the manufacturer and there may not be tread or sidewall cuts or snags in excess of one inch in any direction as measured on the tire, deep enough to expose or damage the body cords, nor may there be any bump, bulge, knot, sidewall separation or failure or partial failure of the tire structure.
      (8) The rims may not be damaged, dented, bent or otherwise distorted, rusted or corroded.
