    I signed a contract on 5/16/2024 to have my house sided with vinyl siding, install a utility door on my garage, demo my deck and reconstruct, replace soffits' fascia and install gutters and gutter guards. I previously worked with Sitz Construction who remodeled a LL bedroom after a plumbing leak. I worked with ****, worked with his crew and was completely satisfied with the work. Therefore, I hired him for this next project. The deposit was due at signing in the amount of ****** which was written on 5/16/24. Project was to be started in August. Sitz construction did not start the work in August, I spoke with ****, he stated the siding was in the shop however was waiting on the soffits and trim materials which were on back order and the project be started as soon as materials were received. Emailed him in September stated he missed my email, broke his hand and was delayed in his responses. He would look at the schedule and let me know when the project would start. Stated he was behind with other projects. He called stated project would start in October. October came and went, spoke with **** on November 20, he was sick and projects delayed. Stated the project would start after Thanksgiving and before Christmas. Project was not started. Tried calling him but always a reason why he could not take the call. Spoke with him around November 27/28 stated he was behind, was having employee problems, Wanted to come out and begin tearing off the deck. I was not comfortable with him tearing off deck as his track record up until this point was not accurate. Sent him a certified letter stating I wanted to end our contract and request my deposit back, He stated on 1/14/25 he received letter, was sorry I felt this way and he would receive payment for other completed jobs and send me a cashiers check for my deposit, deposit never received. I hired a lawyer to send a letter requesting my deposit and to date nothing received. Terrible communication and inconsistent.

    Sitz Construction has not finished our deck we paid him 2 installments so far. The first one was in June for $12,500.00 & another check for $10,000.00. In July his crew came & started the deck install they put in the posts & some of the frame (I say some because they used part of our existing frame from our old deck) then they left. And we have not seen them since. First he stated that the supply company gave our boards to someone else & he was waiting on new compost boards. But now he has an excuse everytime we actually get ahold of him. My husband texts or calls him several times a **************** (we do get a response which isn't alot) we are told he is just finishing up another ************ are next on his list. But it has been 5 *********** have a "started" ************** more. I have called him at least 3 times myself. Once time he answered & stated he lost his phone & couldn't contact my husband the last 2 times now I have left messages. Then we received a subcontractor invoice from the supplier ***** telling us that we have a lein waiver on our property for the materials??? I called *********** will not tell me anything since Sitz is their customer???? I don't know what to do from here?? I am completely stressed out over this & out $22,500

    Sitz Construction did not pay ***** Building Products for materials used to build our deck. We paid Sitz with the understanding that with that money they would paid *****. At this time they had not yet paid the bill, and ***** is going to put a lien on our property. The lien is in the amount of ********.
