    please be advised i Ms ************************* entered into binding buying agreement,signed bye all parties and agreement with an Agent known as *********************** representative of ERA starr realty , whom i believe *** have Fraudulence against and failed to act inoccoraniance , i can provide Actual Evidence being i signed an agree document as well as seller and agent..i have contacted there office with regards unsuccessfully being told bye **** Head he himself has never experienced such a Matter, i am dis***ed and request immediate Actions be taken to assure other decent citizens don't become victimized and further incompetence of such agent should call for dismissal of licence and practices,ect

    Hello ****, 

    In response to Ms. ***************************** complaint against me and my agency, my response is as follows: 

    I apologize for the confusion and misunderstanding regarding the offer Ms. ************************* submitted. When she called me inquiring about my listing, I was very responsive to her and answered all of her questions regarding the property. When she was ready, I requested that she signed the Consent for Use of Electronic Documents and Signatures in ******************** Transactions. Ms. ************************* agreed, signed, and returned the document via email in a timely manner. The next step was to draft the Offer to Purchase for her. When I sent the offer over for her to sign, she did not ask any further questions and proceeded to sign. At that time I believe she misunderstood the email sent from the e-signing software. When a customer or client signs a document electronically, it will send a message saying that the software has accepted the signature of the signee. I believe this is where the confusion occurred. When Ms. ************************* signed the document and her signature was accepted by the software, I believe that she thought that meant she had an accepted offer. 

    Furthermore, in Ms. ***************************** complaint, she states that she has proof of a document with my signature, her signature as the buyer, and the seller's signature all on one document. I do not have a document that has all three signatures, except the last page of her offer where the Seller initialed and rejected the offer as they had decided to accept the other offer that was presented at the same time. When Ms. ****** was notified that her offer was not accepted, she demanded an immediate response and explanation from me, and I did the best of my ability to do so. When she became unsatisfied with my answer, she reached out to one of my supervision brokers, *************************. I have not had any communication or correspondence with Ms. ************************* since Friday, July 15th. 

    My brokers intend to send a message to you as well later this afternoon.

    e are *** Starr and *************************, co-owners and brokers of ERA Starr Realty here in ********************.  *********************** is licensed under our brokerage.  She is also responding to your letter received concerning the complaint from a concerned buyer regarding the actions involving an offer to purchase the buyer submitted for a property we have for sale. 

     

    After discussing the situation several times with ***** and talking directly with the buyer over the phone, we are convinced the buyer totally misunderstood the process.  When ***** sends the drafted offer to purchase to her for her review and electronic signature, the buyer believes she will have an accepted offer upon electronically signing the offer, which is not the case.    We fear she may have misinterpreted the electronic signature software which indicated that her electronic signature was accepted.  The buyer may have thought it to mean her offer had been accepted by the seller.   At that point, the offer still needed to be presented to the seller for consideration.   

     

    At this same time, this buyer was also informed there was a second buyer also now drafting an offer as well as hers.  We do this as a matter of protocol to create a level playing field for all buyers submitting offers. 

     

    Once ***** had both offers in hand, she presented both to the seller for review and consideration.  The seller accepted the other offer.

     

    So youre aware, we have printed and reviewed all text messages between ***** and this buyer.  They clearly show that ***** informed the buyer her offer would be sent over to seller for review after she electronically signs it. 

     

    We hope this sheds light on the events of this situation and helps the buyer understand better what happened.  She was treated fairly and properly from our review of the situation.
