Viking quoted a scope of work to cover a deck area. The quote was for $***** for *** sq.ft. There were two site visits and discussion on what the work I wanted completed. I paid $***** deposit as the vendor wanted **% deposit. The vendor completed covered area less than *** sq.ft. The vendor is demanding payment of the quote which was based on *** sq.ft. I have asked for a bill adjustment based on the work actually completed which is less than *** sq.ft. The area covered measures **** feet by ***** feet which is approx. *** sq. ft. The vendor did not inform me that they will not cover the area of the deck that was discussed and quoted. Please see attached pictures. The vendor is refusing to adjust the bill. As is the vendor is grossly overcharging me and refusing to provide an accurate invoice that reflects the work actually completed. The vendor is threatening and intimidating me instead of adjusting the invoice. I have all the documentation and communication to date to substantiate my compliant.

I have tried to explain to *********, that with the * materials in question, the shingles and weather proofing, they only come in certain sizes, so there is waste. I also explained that we needed **' boards, as the do not make ** foot boards I have provided him with a revised bill, removing ** square feet of shingles and waterproofing, as well as a few boards. The intention was never to build a *** square foot structure, which was conveyed to his wife on both meetings, rather that is the amount required when purchasing including waste. The quote does not say to install a *** square foot structure, it says *** square feet of shingles and weatherproofing, which is the quantity i buy the materials in as they are set quantities for a price break. We have discussed this multiple times, during the original estimate and follow up meeting he was not present for. The project was quoted as a lump sum for the job, and he agreed to that. We never quoted the project with a cost for each material, labor etc... When he asked me 3 times for an itemized breakout, after telling him no we do not provide that, i finally sent that to him. For 2 days there were 4 employees present, he wants me to remove 1 of the employees cost for the day because they weren't on site,  they spent the day picking up materials for his project and dropping them off. While on the project, ********* instructed our installers we needed to put eaves on all * sides of the structure, which is a big no no, he called me 3 times to convey the same message to me, i looked at the estimate and  pointed out it states eavestrough on the front edge only. He then proceeded to instruct 4 employees of mine, after they told him no, to put the 1 eavestrough on the wrong side, as it would hide it so it wouldn't be seen. As soon as we did this, he called me to tell me my guys don't know what they are doing and put it on the wrong side. We have never threatened him, the invoice was adjusted prior to him making this complaint.

We hired Viking to build * retaining walls in our back yard. **** was hard to deal with from the beginning but his team did great work. There was miscommunications between **** and his team and our walls were done incorrectly. I asked for **** to come see the work as each wall was not done to the height specified in the quote. **** became very aggressive and said he'll come back and remove all the material from our backyard if we weren't happy. He finally came to look and agreed that the walls weren't high enough. It took a week of negotiating with **** being so aggressive and rude the entire time to come to an agreement. He couldn't fix the ** ft wall so he said he would drop off boulders for us to build a 2nd wall ourselves and would get the guys back to dig down the trampoline pad so that the wall would be high enough. He only agreed to send the guys to do the fix if I agreed to sign an NDA saying I couldn't write a bad ****** review for his company. I did not sign as that is ridiculous. The guys came back, dropped off the boulders and dug down the trampoline pad. In doing so, they completely destroyed the rest of the yard with their machines and didn't add anything to hold back the bottom foot of dirt that is now exposed from them digging. I had to hire another company to come and fix the state they left the yard in and he will now have to fix the bottom foot of the wall so that it doesn't collapse with rain or snow. I told ********** would like money off as I now have to pay someone else and he threatened to put a lien on my house, showed up at my house after being told no Viking employee was welcome here, and then showed up at my husbands work place threatening legal action and saying he will get his money one way or another. I was advised to call the police, and the officer advised to take out a restraining order against **** due to how aggressive he has been. I am also a business owner and he threatened to leave a negative review on my page if I said anything.

******* has been attempting to get money off of her bill since prior to the project beginning, on the first day she agreed to a $******** add on which myself and my ******* were witness to, once the add on was completed she asked us why we did it and had let us know she wouldn't be paying for that portion. Since then she has asked for $******** off, then $******** off, then $******** off, i have provided her with free materials and labor in hopes of having this issue closed, yet once we did an additional $******** worth of work, she wanted another $******** off. We currently have pending legal action to collect our funds as well as damages due to posts she has made. I cannot go into further detail then this due to pending legal action.

The outline above does not paint an accurate picture of the situation, unfortunately i cannot provide further details at this time.

      Complaint: ********

I am rejecting this response. We have tried numerous times privately (as depicted by ******************) and through BBB to settle with Viking Landscaping in order to not waste the courts time.
We delivered a Letter of Demand to ****************** and Viking Landscaping on August **, 2023, giving them *************************************************** take the amount we will need to pay someone else to fix their mistakes off our final bill. We have had a company look at the site and quote us to build an extra retaining wall to hold back the earth that Viking Landscaping left exposed. This company stressed we need to have it repaired before the winter as not only will the one wall collapse, it will then put the larger wall (built behind the half circle wall) in jeopardy.
We stress again, that we have been trying to pay Viking Landscaping and ****************** the remainder for the work they did, deducting of course the amount we then needed to spend to fix their work that was way below industry standard and put our whole yard in jeopardy of collapsing.
****************** continued to be argumentative up until his lawyer took over. We have tried to settle with him because we only wish for this to be over. Its been unbelievably stressful for us. We just want whats fair.

      Sincerely,

      ***************************

We have only done exactly as ******* has asked us to do, scrape down her trampoline pad to make it level. As noted in her email dated August *** 2023. She never mentioned installing anything else - "Then just the trampoline hole being dug down and that is perfect". We have done exactly what is outlined in this email and will pursue our funds and damages through the legal system as every time she has asked for additional items or work we complied, only to have more demands thrown at us, or money attempted to be removed from the bill.

**** did a lot of work for our condo building everything was great communication great planted some trees and 2 shrubs died and he agreed to replace them last fall and still trying to get him to come back and replace the shrubs multiple emails later he wont and now says we dont water them correctly and warranty was over, this is not acceptable he agreed to replace them and then quit returning emails and never showed up after the over $10,000 **** was paid

      Business response

We did the work for ********, everything was fine. She asked us to warranty a tree that died, and it was quite clear it died due to a result of not watering the tree. Once the tree was replaced, shortly after she told us the 2 shrubs had died. I asked her to continue watering the shrubs to see if they would come back. I had a ******* of mine who lived a few blocks away, stop multiple times to check at the end of the day to see if the shrubs were being watered, upon checking they were bone dry every time. Our warranty is clear, that any shrubs that we plant must be watered daily to receive the warranty work, and they were not watered. We stand behind our work, but our warranty guidelines need to be followed, of watering every day, in the email ********, she says they watered the shrubs twice a week, which does not meet our warranty guidelines. ******** has been extremely difficult to deal with, sending email after email after email, demanding i do something. I will not provide more shrubs to have her not care for them and they die again.

      Complaint: ********

I am rejecting this response because:
Viking never replaced our tree yes they planted it but it was never replaced as it never died. The only issue we ever had was with the 2  shrubs at the front everything else that was planted lived hence why I sent an email immediately after regarding the shrubs and he agreed to replace them in the springYour guy who came out checked the tree never checked the shrubs. I do send emails as you never followed up when you said you would replace them and I have forwarded all the emails that were sent to BBB so they are aware. You agreed to replacing the two shrubs and you should honour your word to replace them.

      Sincerely,

      *********************************

Unfortunately, as the watering guidelines were not followed ( you watered twice a week) we cannot replace the shrubs, as you indicated to me in an email you had watered twice a week. The shrubs need to be watered daily for the warranty to be provided. I have offered to come and replace the shrubs, and provide a watering program to ensure they survive, this was declined by the customer. I was told they had a watering company do the watering, when I asked for a receipt I was told it is the caretaker, not a watering company performed these duties. The story continues to evolve, but we cannot warranty shrubs which were not cared for properly. Our warranty guidelines are very straight forward, they were not met, we cannot warranty the shrubs.
