I was given a project length of five weeks and we are into week 16 already and the project is still not complete. I would like some financial compensation for the time that it's taken, and the inconvenience to my tenant who has now moved in and has no air conditioning in 35° weather.

    Hi ******,

It's unfortunate to have this timing occur.  We are at the mercy of subtrades in this moment.  We can discuss how this will have impacted you.

    Complaint: ********

I am rejecting this response because:

I have spoken to one of the sub trades, and it appears that Junctura did not communicate the fact that they were ready for them to complete their part of the work. I also believe you control the subs as it's your job to manage them and give them adequate time. The fact that this job has taken three times as long is unacceptable and to point fingers at the sub trades is not fair.

    Sincerely,

    ****** ******

By the way, this job has been paid for in full. The last payment was June 5

Right now I have a credit of $1257.07

    HI ******,

Would be happy to sit and figure something out once the sub has enabled the airconditioning.

I am rejecting this response because:
We still need to sit down and figure this out. I will say the company has put forth quite an effort yesterday to get the job finished.

Date of first down-payment: Feb 6, 2022 Amount of Money I have paid so far: $95 271.56 Junctura committed to build an addition to our home and to do some renovations to our existing living space. Nature of dispute in a quick recap - We have had many issues since the very beginning of the project. Late project start date. Duration of the project was 22 days on the contract. We are currently on week 17 and counting. Changes made without communication. Ordering of windows without our approval. Foundation taking longer then needed. Leaving our removed exterior back wall to our house covered by tyvak paper only for a week ( anyone could have broken into our home). Not covering the roof between working days causing a flood in our home. Loosing our house key. Installing our windows incorrectly which will void our window warranty. Not installing our siding as per proper installation. Leaky window from improper installation. Leaving live electrical wires hanging for over a week which can cause serious injury to our 3 children if touched. (At this moment this has not been corrected). Incomplete work. Issues being resolved: I have voiced my concern about the window installation and they are doing nothing. They are doing nothing about the leaky window. They have not fixed the dangerous electrical wires that are currently still hanging. They have not communicated with us regarding the windows that were ordered. They have not completed the job. They have not been here at all for 1 week to complete the remaining work.

    Hi *********,
We appreciate your frustrations.  We are indeed committed to finishing your project despite the obstacles that both yourselves and ourselves have faced.
    - Changes made without communication:  The designer omitted windows in the permit drawings making your design not work and against OBC code.  The designer confirmed discussions with you, which we carried out.  This caused additional delays as we had to reposition/reset and put additional planning in place to have everything moved.... At no additional cost to you.
    - Foundation Timing:  Definitely took longer due to sub accessibility.  As mentioned in our last in person meeting, we, as a result of the subtrade issues purchased our own equipment and started a concrete division to try and bridge the gap in time.  There were some challenges getting the work done due to launching a new division but the work was completed at no additional cost to you.
    - Windows ordered without approval:  What was being ordered was emailed Aug 24th giving sufficient chance for changes prior to receiving windows on Oct 12th (installed same day)
    - Leaking on a couple occasion: This was a major renovation/addition, requiring an area to be fully exposed over multiple days.  Climate/Environment exposure should have been anticipated.  To have fully sealed that space was not possible.
    - Window installations: All windows were installed properly and qualify for warranty
    - Siding: All siding was installed properly and qualify for warranty
    - Wiring: The areas that had exposed wires were due to patches made and left allowing you painting to save on costs.  Electrical team was onsite (this morning) to affix the patched/loosened wires.  Notification was given of the issue at 8PM on Oct 18.  Plans were made the next day to free up a team to go on site the following day, which occurred.
    - Lost Key: We provided a lock box for our staff to not cause onsite access issues and unfortunately it was indeed lost.  We rekeyed the home at our cost.
    - Work not yet complete:  To save additional costs you took on the demolition portions to which you finished Sunday (Oct 16th).  Management made plans from there to have staff do additional work requiring to shift around other projects, not knowing when your demolition work would be done.

Once your project is signed off a 1 year workmanship warranty will be provided.

    Complaint: 18248606

I am rejecting this response because: This is incorrect. They have not completed some of the issues that are still outstanding.

There are 2 areas in the soffit that need to be replaced. 1 where the electrician ripped the sofit while installing the pot light and 1 piece that was dented when the electrician was installing the pot lights.

The warped piece of siding I asked to be replaced is still warped.

There are still no weep holes in the bottom J Chanel as there should be.

There is still an old electrical outlet that needs to be removed on the old fridge wall. There is also still an electrical outlet coming through the floor behind our temporary sink that has never been removed.

The switch outlet beside the patio doors is crooked.

Junctura has not contacted me to see if all these issues were infact rectified.

I am also requesting mediation regarding the remaining the balance.

    Sincerely,

    ********* ********

All remaining items have been addressed or dealt with.  Project is now closed.  Installation warranties to be provided on final payment.
