******** * ********* ********** ********* ******* ******** ***** ******* *** ********** ** *** **** **** **** ** ******* ** *** **** **** ***** ********* *** ******* *********. Resolve Recovery called a phone number on a Credit Bureau file my brother used, and rather than confirm my contact information, they disclosed my private information and suggested that he settle the account. My estranged brother was not a reference or co-signer, and my consent was not given. When I inquired about the communication, they stated the phone number was on file. They acknowledged that a manager had spoken with him but would not discuss their ******* practices further. After not agreeing to a settlement, I asked Resolve Recovery to navigate the legal process so a mediator could be incorporated. Resolve Financial Recovery then contacted other family members for their involvement, including my spouse, which is unreasonable and excessive. As I understand it, they can call family members, friends, and other contacts to obtain my contact information, which they already have. Instead, they misrepresent the situation and apply unreasonable pressure to settle. All of this began when I had medical concerns that required surgery and a long recovery. My health insurance claim was denied. My employer asked me to resign. My debt was sold to a collection agency that practices outside ******* *** ****** boundaries.

This correspondence serves as Resolve Financial Recovery’s official response to complaint # ********. Resolve Financial Recovery takes all complaints very seriously and strives to conduct business in a professional manner. Upon receiving the complaint, Resolve Financial Recovery reviewed the account details. The complainant had emailed our office in October of 2023, prior to any discussions with his brother explaining to us that his brother would be assisting him in the matter and to forward all documents to his brother's mailing address. Messages were left for the complainant to call our office on a phone number which the complainant is saying now belongs to his spouse. This is a number that was attained from the complainant's credit bureau, so it would have been used by the complainant as contact number in the past. We have gone ahead and moved the account into a non-contact status queue, and the complainant will no longer receive any correspondence or phone calls from our company. The complainant has attempted to resolve the account in the past for a below parameter settlement. We will now offer a below parameter settlement to resolve the matter should the complainant still wish to resolve the account. Please call the office and we will assist in resolving the matter and come to an amicable solution.

      Better Business Bureau:

I have reviewed the response made by the business about complaint ID ******** and find that this resolution is satisfactory to me.

I requested mail correspondence with the collections agency, and I hope they will respect my wife's privacy as they have agreed to.

For clarification, I did ask the collectors to use an address, and my brother provided some assistance with email drafts, but I wanted to limit his involvement. I did not consent him to take over the matter or share my details.

      *** ********** ******** ******** ********** ***** *** ******* ****, I offered a reasonable settlement. They used ********* practices to pressure me into settling at their preferred amount.

Case # In Request for Debt Validation: #******

      Dear Resolve Financial Recovery Inc:

I am writing in response to an email received on October 20th, 2023 in which you sought payment for a debt under my name. In accordance with Canadian laws, I am formally requesting validation of this alleged debt. I would like to emphasize that I do not acknowledge ownership of this debt, and I contest your right to come after me for its collection.

Please provide me with the following details, as required under Canadian regulations that I am entitled to receive:

      1. Name and address of the original creditor.
      2. The account number associated with the debt.
      3. The current outstanding amount.
      4. A comprehensive payment history.
      5. Verification that supports the claim for the amount currently owed.
      6. Information concerning the age and amount of the debt, inclusive of the last billing statement from the original creditor.
      7. A detailed breakdown of any interest accrued, payments made after the last statement, and the legal basis for such                  interest.
      8. The date the original creditor marked the account as delinquent.
      9. A copy of you contract that shows my agreement and wet signature to do business with Resolve Financial Recovery Inc.

Additionally, kindly clarify whether this debt falls within the statute of limitations under Canadian laws and elucidate how this was determined.

Be advised that unless the requested information is furnished, you have not met the criteria to report this debt to credit bureaus under Canadian laws. If you cannot provide the requested validation in 5 business days, you are obligated to immediately remove this account from my credit report, as per Canadian regulations.

Lastly, I am hereby revoking any permissions granted for you to contact or communicate with me by any means, other than through mail via the postal service, as stated under Canadian laws.

      Sincerely,

Resolve Financial Recovery takes all complaints very seriously and strives to conduct business in a professional manner. Upon receiving the complaint, Resolve Financial Recovery reviewed the account details. We will provide the information from the original creditor. We have not refused and the complainant has not requested this information prior to yesterday via email and this complaint. This is not a question of fraud as the complainant made payments on the account for over three years. The complainant is requesting we provide this information in less than 5 days or we will have to remove it from the credit bureau. We will request the information and provide it once we obtain all the details. It would be impossible for us to provide the information within the five business days like the complainant is requesting. The complainant has also requested that we only communicate through regular mail, which would also take an additional 3-5 business days as we are in Ontario and the complainant lives in Nova Scotia. If you would like to call the office our number is 1-************.

      Complaint: ********

      I am rejecting this response:

Firstly, I must express my concern over what seems to be a contradiction in your communication. After explicitly notifying you that I wished to communicate solely through postal mail and revoking any other means, I received an email from you. This email pertained to my account with RFR, specifically mentioning your colleague, Steven, and insinuating that I should be pursued legally, which is both unwarranted and inaccurate.

In my previous correspondence, I had requested a formal contract that includes my agreement, along with a wet signature, to engage in business with Resolve Financial Recovery. Additionally, I asked for a detailed payment history, as you claim that I have made payments to RFR. I kindly request you to review my initial letter, where these requests were outlined. Moreover, I would appreciate you providing substantiated evidence of the debt you claim I owe.

There has been no unlawful debt collection practices. Notices via regular mail and email have been sent advising that the account if left unpaid would be reported to the credit bureaus. The complainant knew there was an outstanding account even before the account was transferred to our office. This account was already in an unpaid R9 status with the original creditor prior to our office taking over the account, it was also previously listed as a collection item prior to our office handling the account. Our office has ordered the back-up and will supply the information once we receive it. We do not keep unnecessary documents stored, as we have purchased over 30,000 accounts from this particular creditor. They are available, but we still have to order them. We are no violation of any debt collection laws and/or credit bureau reporting criteria. We encourage the complainant to seek clarification of how credit bureau reporting works directly with the credit bureaus, and to check a copy of the their credit report, as we are not the only collection item listed. The complainant is always welcome to call the office and discuss the matter over the phone. 1-877-259-6607.

It is evident from their two responses to this complaint that the business, *** * ************ (Resolve Financial Recovery) does “not” have any “legal” documentation, including the original contract/agreement “currently” in their possession.
Due to the fact that I filed a complaint with The Better Business Bureau, Resolve Financial Recover has decided to “ask” for/”order” “back up” from the original creditor since October 31, 2023. Why should I give Resolve Financial Recovery time for them to locate/request the original contract?
The business **************** (Resolve Financial Recovery) is not here to “**********” discuss any information about any collection item on my credit report which does not relate to them. I will not discuss anything over the phone with Resolve Financial recovery.
I am requesting **************** (Resolve Financial Recovery) provide a “validation of debt” including: The original signed contract, original source of payment(s) and a detailed breakdown of how the current amount was calculated.

      Complaint: ********

I am rejecting this response because:

I do not owe any debt to the business Resolve Financial Recovery (****************).

On November 23, 2023, I contacted ********** and filed a dispute against Resolve Financial Recovery (****************) and the claim they recorded on my credit report. Their claim has increased from over $6,000 to over $12, 300 to over $12,400.00. I also provided additional information proving I do not owe any debt to Resolve Financial Recovery. Going forward I will also be submitting a formal complaint and include this Bureau file to Consumer Protection Ontario for them to investigate the ******* practices of Resolve Financial Recovery (PFR).

Resolve Financial Recovery contacted me via email October 31 2023 demanding payment of a “trumped up” claim of over $12, 300.00 (now they added more ******* fees for a new ******* claim amount of over $12, 400) and threatened consideration of legal action.

After I requested from the business Resolve Financial Recovery, “validation of debt” (via The Better Business Bureau), they contacted me again via my personal email claiming to provide “statements”. I then requested them to resend me validation via The Better Business Bureau complaint resolution portal. However, to this day (Friday December 8, 2023) they have not, because they cannot validate, and cannot prove their claim
      amount.

Greetings! sometime ago I received a phone call from an unidentified party. During our conversation, I explicitly verbally requested that they furnish me with tangible evidence of any contractual agreement existing between us. Unfortunately, they were unable to provide such documentation and have persistently intruded upon my privacy through both telephone calls and mail correspondence, causing unwarranted complications without any legal basis. Consequently, I am filing a formal complaint against them with your esteemed organization. It is important to note that I have no knowledge of their identity nor have engaged in any form of business dealings with them whatsoever. Therefore, it can be unequivocally stated that there is absolutely no valid contract in existence between myself and the aforementioned party.

      Complaint: ********

I am rejecting this response because:

I am faced with a distressing situation where I have been subjected to continuous and relentless phone calls from a collection agency. These calls occur more than five times daily, causing me immense frustration and anxiety. Despite my efforts to address the issue by reporting it to my phone service provider and blocking their numbers, they persist in contacting me through unknown means. **** ******** ** ******* ******l.

The consequences of these incessant calls have had severe ramifications on various aspects of my life including my credit score, time management, and overall well-being. It is important to note that there is no valid reason for me to initiate contact with them as they possess inaccurate information within their records. Moreover, they have gone so far as to submit false credit reports about me. with no legal rights as they have no signed contract with me.

Given the circumstances at hand, I would like it known that I expect prompt resolution of this matter by deleting the credit report. While considering options such as involving BBB (Better Business Bureau) may seem reasonable under normal circumstances, but what I seek is not (Binding Arbitration) but rather proper acknowledgment of my rights and privacy being violated.

Therefore, if necessary steps are not taken promptly by that agency to rectify this situation then regrettably, I will be left with no choice but pursue legal action in order to obtain the desired outcome that protects my interests effectively.

      Sincerely,

      ***** ****

As stated in our previous response we would like to speak to the complainant so we can figure out exactly what the issue is and how we can assist in removing the derogatory notation on the complainant's credit bureau. As a collection agency we simply report to the credit bureaus the information we have on file. Occasional reporting errors can occur, but we did not manually place the collection item on your report, it is done digitally and in mass volume.  If the information that we have submitted to the credit bureaus does not match your information then you should be filing a dispute with both credit bureaus to have the item removed. As mentioned previously, we did receive a verification request from one of the credit bureaus and the DOB did not match and we responded accordingly indicating we had a different DOB. Filing a complaint with the BBB has brought the matter to our attention but we cannot assist you any further through a response to your complaint. There will be no more contact made on this account, but it will remain a collection item until the matter is properly dealt with. Complaining to the BBB or pursuing legal action will not help the item get removed faster, but a call to our office will. We are understand that you were not satisfied with our previous written response, but if you call our office we will assist you in correcting the error. 1-877-259-6607 Ext. ***.

It isn't a simple matter of us clicking a button and removing the collection because what we had reported to the credit bureau is the information we had on file, and somehow ******* and ** have mistakenly associated the info with you. I just left you a voicemail to call me back at Extension ***. We will assist you in getting the item removed but we do need to speak to you. I am sorry I missed your call on the 21st, but I have now returned the call and left a voicemail message. Please call call back and we help you fix this.
