I recently had the pleasure of working with David Sklar & Associates during a particularly challenging financial period in my life, and I was fortunate to interact with Jackie S. I went to this company to inquire about filing a Consumer Proposal. I filed two bankruptcies in the past 30 years and one proposal. The first Bankruptcy was not completed, the second one was discharged almost 6 years ago. I asked this company for help for a new consumer proposal. I received an email giving me dates for FOUR bankruptcies, and one CP. I was absolutely ********* and I did not even think a person could file more than three to begin with. i checked my own report with ******* and there are no bankruptcies with the dates that was listed in my email from them other than the two I do know I have done. The dates did not even match up from their email when I checked. So obviously two were added on that I know absolutely nothing about, and I believe my Trustee from 2018 would have asked me why I had claimed so many when I filed with them. The others before that would have shown up. This is about one of the most distressing experiences I have ever gone through. And I believe I would remember if I had done four bankruptcies to begin with. ****** ******** *** ***** ** **** *** ***** ** **** ** ***** ************ ** *** **** ** **** *******. This is an unfortunate situation where the complainant has had a negative reaction to our staff doing the proper due diligence required by law as per the Bankruptcy and Insolvency Act (the “BIA”), the Federal Statute that governs the Insolvency System in Canada. As licensed insolvency trustees, we are held to a very high standard and conduct ourselves with the utmost professionalism and care. We have done so in this file, as we do in all our files, and have instructed the complainant in accordance with the rules and regulations of the Federal Statute – the BIA. Any person who is planning to file an insolvency proceeding must disclose all previous instances where the relief provided by the BIA has been utilized. It is the duty of the Licensed Insolvency Trustee (the “LIT”) to perform a search of the Bankruptcy and Insolvency Records database, maintained by the Office of the Superintendent of Bankruptcy (the “OSB”), the Government body that monitors and regulates the insolvency industry in Canada. This search is required to verify that all prior insolvency events have been reported to the creditors and the LIT. This assists the creditors and the OSB in evaluating the history of filings along with the debtor’s financial information when considering the current proceeding. It also impacts what a current bankruptcy would look like as the consequences of filing a bankruptcy are cumulative. When filing a consumer proposal, as the complainant was intending to do with our office, the recovery to the creditors must be compared to the potential recovery under a bankruptcy. The period over which any potential recovery occurs in a bankruptcy scenario increases with each successive bankruptcy filing. When our office performed this search, it resulted in five (5) results that appeared to be a match for the complainant. These proceedings were filed under three different surnames, however, the first name was always the same unique spelling, all filings occurred in the Ottawa region and the birthdate was the same in all five (5) filings. The various insolvency filings are also linked in part by the official surnames and alias surnames used in each filing. Based on this information, our office requested the complainant to confirm if the five (5) previous insolvency proceedings were filed by her. The complainant advised our office that only three (3) of the proceedings were in fact hers as she has reported in her complaint. We advised her that we would look into the proceedings with our regulator, the OSB, to assist in determining if all five (5) of the insolvency proceedings were filed by the complainant or if some of the proceedings are actually for a different person. At this point, the debtor advised our office that she was going to seek assistance elsewhere. Soon thereafter, this complaint was filed as the complainant felt horrified that we would ask her to confirm the five (5) insolvency proceedings. There was no further contact with our office nor did the complainant allow our office to complete any investigation into the veracity of the results of the insolvency records search as compared to the complainant’s depiction of the facts. The complainant advises in her complaint that she would remember if she had done four bankruptcies to begin with. She goes on further to state that either somebody else took her name and filed or this is gross incompetence on the part of this company. None of these scenarios appear to be the case. We have communicated with the OSB and they have confirmed that based upon their review of their insolvency records and other details contained in the five (5) insolvency filings that they have reasonably concluded that all five (5) insolvency events are linked to the complainant. If the complainant takes issue with the official Insolvency Records, she is free to contact the OSB to discuss directly with them. We did our job as required under the law, we gave the complainant the opportunity to confirm what the official records show and we were willing to investigate the issue further in accordance with the complainants concerns and comments regarding the apparent accuracy of the official records.
