Good Day. I am reaching you to complain about Action Collections (ACRM). * **** ***** *** **** ***** ********** ***** **** ** **** ***** They have been persistently ******** ** about a Debt collection for an ***** Furnace I had installed in my Residence in Orkeans Ont back in 2013. I entered into a financing agreementand with a finance company called **** *********. ACRM is claiming that the parent company to **** *********, ****** *********, has a collections file with them for the amount of the furnace, saying i never paid. I had a Pre Authorized agreement to withdraw payments from my bank account and even updated them (****) when I switched banking instutions. I called ACRM today to discuss, their calls to me are now URGENT. They asked for all kinds of verification info, address, phone; etc and I refused. They already have this. They could not continue discussing the file because I refused to give them the info for verification. I am rejecting this response because:Good Day BBB and ******** ** Thank you for your recent correspondence regarding my complaint against ACRM. * *** **** *** *** ***** **** **** *********** They responded with a copy of my original contract with **** *********, which I fully acknowledge as being a representation of the contract that I ********** entered into with ****, back on 13 April 2013, over 11 years ago now.
They also include my Consumer Proposal that I alerted ACRM to, in my efforts to help clarify and resolve this matter. I note that ACRM did not include any of the email correspondence between them and me where I have supplied them with supporting comment and documentation to help prove that their collection action against me in fact is wrong as I see it. **** ** ***** *** ** ******** ** **** * ** ****** ** ****** ** ***** *** **** *** ** ****** ****** **** **** ** **** **** ****** ******** ** *** ***** ***** **** ******* I have repeatedly told ACRM that I had a Pre Authorized payment agreement with **** ******** (never heard of ****** ********* ***** before this). I could not have gotten financed without it. That was 13 April 2013 when I provided the Pre Authorized void cheque from ** ****, as per the terms of the financing agreement. I know for a fact that **** was with drawing monthly payments from my bank account. ACRM knows about this Pre Authorized agreement, they are the ones who provided me with a copy of the void check that I provided back in 2013. I do not have bank records from back that far to show the payments having been withdrawn. Nor are there electronic statements available from **, back as far as those years. I may be able to get something from the Branch where my accounts are **** * ****** ** ****** ** *** **** *** ****** Now that I have a copy of the void cheque to reference.
Furthermore, on 4 October 2016 (as a result of my Consumer Proposal) i sent **** ********* updated Pre Authorized payment instructions as I had changed Banking institutions, from ** to ***. This is hardly me avoiding payments and living up to my obligations under the contract with ****. Matter of fact, after a bit of back and forth emails, **** ********* acknowledges the change of Pre Authorized payment information and states the following (on 28 Oct 2016):

I am rejecting this response because:I am partially rejecting the latest ACRM response. Let me begin by acknowledging that ACRM is indeed correct in pointing out the duration of the original contract, up till 2028 at the agreed to repayment schedule. My prior comment about believing the contract was completed was made without going over the entire contract. I was incorrect on that comment. ACRM now acknowledges I did indeed pay a total of 1229.04, based on the records they have. I contest that additional payments were made beyond the what their records show, up till 2015. This is based on an email I have from **** ********* in October 2016, when I updated **** with new Pre Authorized payment information. They acknowledge the change and clearly state that that FUTURE payments and the NEXT payment will come form ***, the new account. As I have stated previously, at the time of the **** email to me in October 2016, there was no mention from them that I was missing payments since the last date that ACRM has, 3 March 2015. Nor has there been any mention since my last email from **** in 2016. With the exception of what I am experiencing now as a result of the action which is being taken against me.
ACRM states that they have made every effort to to explain the issue on numerous occasions. ACRM has repeatedly demanded full payment, and list an outstanding amount that equals the initial cost of the furnace, $4370.94. Yet they admit that they have records showing I paid $1229.04. ***** **** *** *** ********* ** *** ******* ****** ** *** ******* **** ******** **** ***** ***** ACRM has made several offers saying the creditor will settle for less, $2841.11, an opportunity to save $1529.83. **** * ***** * **** ** ****** *** *** **** ** *** ******** ******* **** ** *** ********* ** * *** **** **** *** **** *** ******* ****** **** **** ** ********* * ***** ** *** **** ******

The creditor has not received any payments that are not listed on the statement of account. The total debt today is 4370.94 - as a courtesy and as you were advised there is no interest being accumulated, since the last payment made in 2015.

I accept what ACRM is saying in regards to the documents that they have provide me to this point. I accept and acknowledge that the contract is Amortized till 2028. I just noted that the Term was for 60 months, which likely contributed to the earlier mix up about me believing the contract was done. Also that **** ********* was named in my Consumer Proposal in 2016. They are named a a Secured Creditor though. I am not disputing that I entered into the contract. I did so faithfully and now that I have been reminded that it is still in play I accept there is a balance.
I am trying to find answers to this whole affair. * *** ********** **** **** ********* ** ********* **** ***** ******* I had mistakenly believed that the contract was finished. I entered into the contract in 2013 and my last contact with the Creditor, **** ********* was 2016. Its a long time ago. Plus, I had everything in place for the Pre Authorized payments to be withdrawn from my Bank account(s). As they were being withdrawn from the beginning of the contract. **** acknowledged this in their responses to my emails in October 2016 when I provided them with UPDATED payment instructions. Yet ACRM and ****** ********* only has payment records till 2015. In my last response I had asked ACRM to go back to Simply and ask them when I started missing payments, **** ********* does not mention anything about it in their reply of October 2016 and promises that future payments will continue from my *** account. This business keeps calling me claiming i have a debt that i know nothing about. I gave them the reference number ******* and they want me to provide my address and date of birth after letting them know my name. ACRM called me to notify me about a collections in my name. It was $75 for a telecommunications I have never visited. I explained I was a victim of identity fraud. I provided them my mailing address for them to mail me the records they had to file a police report, as they instructed. Now they are calling not me, but my girlfriend, multiple times a day. 5 times in one hour on a weekend, waking up my newborn. I have explained this to them multiple times. They are now going as far to raise their voice at my and ramp up their ********* phone calls. PLEASE MAKE THIS STOP. I am begging you. I was more than happy to work with them to get this resolved, but the level of ************ *** lack professionalism has gotten to be to stressful to work with. I would like to specifically highlight Joanne as the employee here who has been constantly calling me *** ** ************ **** *** **************. Your information is inaccurate. The allegations being made are unfounded and not based on facts at hand.
yes, we have called two separate numbers, we have done so since December 5, 2023. These calls are not **********; they are an attempt to collect an unpaid debt.
The calls have been made during the dates times and frequencies described in Ontario regulations.
Electronic and Regular were sent in December, 12.09.2023 to the address on file.
You have contacted our office twice, both times you have alleged this is a debt caused by fraud. Proof is required; if you are unable to provide such provide ( a complete fraud report from your local law enforcement agency) we will assume this allegation is also not based on fact and therefore expect repayment of your debt obligation.

1. Agency contacted me via phone first, without prior attempt to reach me through mail, although in possession of my address.
2. I then contacted a live agent with Action collection in order to ask for a cease and desist, I asked the agent for an appropriate department email, to which I proceeded with a cease and desist request (by email at [email protected]) Nevertheless, I received an answer by email from the agency basically telling me "we will stop contacting you only when you pay your debt in full".
3. I then called back a second time and spoke with a live agent again. I explained the situation and asked about how to stop receiving calls. The agent did everything to deviate from the topic and attempted to collect information about me. Finally, when he understood I am not going to pay up, he told me that he "put a note" in the file and I will not receive further calls. Nevertheless, I receive another email, this time from a certain Kyle M*, senior manager. This time, the email pretends to "provide, AS PER MY DEMAND (!)" payment instructions to settle a debt... I never asked for payment instructions. I do not recognize any debt Action collection is trying to collect. I wish to be contacted by mail and in writing only. I find the agency is bareknuckle violating all regulations and norms regarding debt collection. Putting words in my mouth - as done in abovementioned case of emails - is *******, especially since the agency is supposedly recording conversations. **** ** **** *** ****** *********** ********* ** ******. I wish for the administration to contact me in regards to this matter and I especially wish to confirm that the agency notes that I DO NOT RECOGNIZE ANY DEBT, contrary to what seems to have been entered into the system.
